Justice M.SASIDHARAN NAMBIAR\n\n Dated :24\/02\/2010\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.3538 of 2009\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p id=\"p_1\">    Petitioner is the first accused in C.C.No.389\/2006<\/p>\n<p>on the file of Judicial First Class Magistrate&#8217;s Court-<\/p>\n<p>II, Aluva, taken cognizance for the offences under<\/p>\n<p>Sections 120B, 420, 464, 465, 466, 468 and 474 read<\/p>\n<p>with <a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> of Indian Penal Code. Prosecution case<\/p>\n<p>is that in furtherance of their common intention to<\/p>\n<p>cheat, the two accused approached Branch Manager of<\/p>\n<p>Kalamassery South Indian Bank for a loan in favour of<\/p>\n<p>M\/s.Lakshmi Wood Industries &amp; M\/s.Metal Make Engineers,<\/p>\n<p>owned by the petitioner and as collateral security for<\/p>\n<p>the loan, furnished title deeds in respect of the<\/p>\n<p>property comprised in Sy.Nos.112\/1B\/2 and 112\/1E\/2,<\/p>\n<p>which are water logged areas and also produced a sketch<\/p>\n<p>which was created by affixing the forged seal of the<\/p>\n<p>Village Officer, as if it is genuine, when, in fact, it<\/p>\n<p>is a dry land and obtained the loan and thereafter,<\/p>\n<p>failed to pay balance of Rs.25,53,198\/- and thereby,<\/p>\n<p>committed the offences. This petition is filed under<\/p>\n<p><a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of Code of Criminal Procedure to quash the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRMC 3538\/09               2<\/span><\/p>\n<p>proceedings  contending  that the   disputes  with  the<\/p>\n<p>second respondent Bank were settled subsequently and<\/p>\n<p>the entire amount due to the Bank was paid and in view<\/p>\n<p>of payment of the dues and settlement of the disputes,<\/p>\n<p>it is not in the interest of justice to continue the<\/p>\n<p>prosecution.\n<\/p>\n<p id=\"p_1\">    2. Second respondent appeared through a counsel<\/p>\n<p>and filed a joint petition (Crl.M.Appl.No.878\/2010),<\/p>\n<p>along with the petitioner, stating that entire disputes<\/p>\n<p>were amicably settled and second respondent received<\/p>\n<p>the entire amount due from the petitioner and Annexure-<\/p>\n<p>A2 certificate has already given to the petitioner<\/p>\n<p>recording settlement of the liability and returning the<\/p>\n<p>title deeds deposited and in view of payment of the<\/p>\n<p>entire amount due, second respondent has no objection<\/p>\n<p>for compounding the offences.\n<\/p>\n<p id=\"p_2\">    3. Learned counsel appearing for the petitioner,<\/p>\n<p>second respondent and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p id=\"p_3\">    4. Prosecution case in essence is that petitioner,<\/p>\n<p>along with the second accused, availed a loan from the<\/p>\n<p>second respondent Bank and failed to pay Rs.25,53,198\/-<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRMC 3538\/09               3<\/span><\/p>\n<p>due and for the purpose of availing the loan, to make<\/p>\n<p>it appear that the water logged land belonging to the<\/p>\n<p>second accused is a dry land, which was furnished as<\/p>\n<p>collateral security, a certificate from the Village<\/p>\n<p>Officer and a sketch were produced.     But, they were<\/p>\n<p>forged and thereby committed the offences. As held by<\/p>\n<p>the Apex Court in <a href=\"\/doc\/1157676\/\" id=\"a_2\">Manoj Sharma v. State<\/a> (2008 (4) KLT<\/p>\n<p id=\"p_4\">417), when the offences alleged against the petitioner<\/p>\n<p>are   purely  financial and  personal  in   nature  and<\/p>\n<p>petitioner has cleared the entire liability with the<\/p>\n<p>second respondent and second respondent stated that<\/p>\n<p>entire disputes were finally settled, it is not in the<\/p>\n<p>interest of justice to continue the prosecution.<\/p>\n<p id=\"p_5\">     Petition is allowed.
