the Commissioner’  ‘Compensation by his award
\ndated 08\/07\/2eoS.II ‘I’he’i”f:Jo.1I:ii\\niSsioner has awarded the total<\/p>\n
Compensation of RS. 1’,6;_”V\/’i,949if–.<\/p>\n
I~~i\u00a2’31i_1’1e\u00a7i..ieounsel for the appellant while seeking<\/p>\n
i’a._ieVn’hanCeme_nt V__vo’f,:t’he Compensation would contend that the<\/p>\n
i””C.O’Inn*IiSSionerv… has erred on two counts while deciding the<\/p>\n
N-,i’eor12;aensati_on. It is contended that the Commissioner Ought to<\/p>\n
 reokoned the disability as stated by the Doctor at 90% and<\/p>\n
d<\/p>\n
.g–.-\n<\/p>\n
In<\/p>\n
was not justified in reckoning only 80%. With regard to wages, it<\/p>\n
is contended that the Commissioner Was not justified in retjkoning<\/p>\n
only a sum of Rs. 2,065\/–. As such if these two-u”aspect.s’<\/p>\n
considered the appellant would be entitled_to\u00bbh4igher  <\/p>\n
The learned counsel for respondent howeVer1’_i_soiight.to<\/p>\n
award. it is contended that the evidence of the .Doevto’r_’ha.s been = L’<\/p>\n
meticulously noticed by the Cnommissioneir and  \u00abreference to the
\nsaid evidence has noticed the”.tiin.Aci_ioIiali  and thereafter
\narrived at the disabilityaand as error whatsoever.
\nEven with regard.   ijnolildocizmentary evidence
\navailable to   the statement made by the
\nclaimant. Therefore   document the Commissioner
\nwas j’ustified” in looltingnilntol the Minimum Wages Noti\ufb01cation in
\nrespect. the same has been relied. Hence<\/p>\n
the award \u00abin..iitsvier:itir’ety does not call for interference nor the<\/p>\n
 “claimant is entitled’ to any enhancement.<\/p>\n
i    .1.nlA.i.–‘the light of what has been contended a perusal of the<\/p>\n
 fqirould indicate that thiissue relating to the wages has been<\/p>\n

considered by the Commissioner while adverting to point No_._4_. In<\/p>\n
this regard the evidence of the claimant has been noticed._’w.h’erein<\/p>\n
he has contended that he was earning Rs. 120\/~  .<\/p>\n
month he was getting a sum of Rs. 3,600\/~_._ TheiiC0nj;missionesr_ <\/p>\n
has also noticed the objection of the Ins7ura_nce” Cor_n’paiinyi,i <\/p>\n
was putforth before him. Thereafter  has <\/p>\n
referred to a decision of this court  on the
\nMinimum Wages Noti\ufb01cation  \ufb01xed was in a
\nsum of Rs. 2,065\/– in respectgof.   In the absence
\nof documents it  trtlsijcfiatijtheiiiiioimhissioner would be
\nentitled to r’e_1yWages Noti\ufb01cation. However,
\nwhile placing Wages Noti\ufb01cation the
\nCornrnissio\u00a7ne1’t..woii1d\u00bb  l\\\\\\’%LV\u00a7; to keep in View the date of the
\n :iiof._._the  and also the area in which such<\/p>\n
(3l’1′}pi(i”J’~\\\/.iI’1″}\u00a7;”\u00a3’}:’tiA”i\u00e9:”‘~1,t1’1dCl’T\ufb01akC1″1. In the instant case, the Minimum<\/p>\n
T’  Noti.ficati’o:1Viir~eilied is dtd. 12 \/06 \/2002 while the accident had<\/p>\n
 on” 08\/2004 and as such there was more than two<\/p>\n
 p i”irearsii.baci{iA.i.–and there is likelihood of enhancement of wages during<\/p>\n
fhesaid period. Further it is also to be noticed this court in<\/p>\n

respect of hamals has been taking more than Rs.100\/<\/p>\n
year 2004 and as such in the instant case it would  <\/p>\n
to reckon the daily wage at Rs. 1 10\/-. If -th’at–.i.s diuoneio<\/p>\n
income would be a sum of Rs. 3,300\/-.\n<\/p>\n
4. The next question that arises for’-considerationdis}with,2′<\/p>\n
regard to disability as reckoned by  Though the
\nlearned counsel for appe11ant\u00ab.._i.1i’:i’a_s  the Doctor had
\nstated 70% in respect Of the   thereafter and
\ntherefore in all  of the evidence
\ntendered byilthe,  indicate the details of the
\ninjuries and  V  rendered. Though the
\nevidence inirespect of, injuries has been stated by two Doctors
\n the Commissioner has taken note of<\/p>\n
the e’vjde’nce’V~iij~_.tihei”oackground of the avocation of the claimants<\/p>\n
xihiand functionai’ .disability was ascertained. In this regard the<\/p>\n
.._.f;g;jnisi’deration._.bf this aspect while deciding point No.5 would<\/p>\n
“‘Vindicatc-._t_hat the Commissioner has adverted to this aspect in<\/p>\n
J<\/p>\n
an
\n9:\n<\/p>\n

detail and therefore there is no error committed by the<\/p>\n
Commissioner in so far as the disability reckoned.<\/p>\n
5. In View of the wage as reckoned above if th.e..comp’ens.ation  <\/p>\n
is recaicuiated the 60% of the said amountcf  <\/p>\n
have to be reckoned for the purpose \u00abof icomputatioini’ of titeil<\/p>\n
compensation and the very same reIieyiar1.t factoriiasi-iiniciicated by
\nthe Commissioner is to be notjiiced. Tlheipideriifative thereof would be
\na sum of Rs. 3,35,491\/– since I haveihviretairied’ thei__disabi1ity at 80%<\/p>\n
as indicated by thei’\u00abCb’mrr3_issic-\ufb01ery.  the said amount<\/p>\n
amounting  Rs.– 2i,iES’8,3.9i2,,\/\u00bb–‘wou1d– have to be awarded. Since the
\nCommissioner  already ,.aW_arded a sum of Rs. 1,67,949\/~<\/p>\n
appellantpgjivould be ..erititied to a difference of the amount as<\/p>\n
 ‘i”>e_ said amount would be paid to the claimant<\/p>\n
 from 30 days after the date of the award<\/p>\n
 to be cavlcuiated from 08\/08\/2005, but the interest for 211<\/p>\n
 for thie;..de1ay in filing this appeal shall be excluded. The<\/p>\n
 am:oLiri’t..sha11 be deposited by the Insurance Company within a<\/p>\n
if<\/p>\n

period of 6 weeks from the date of receipt of a copy of this order. <\/p>\n
