MANOHAR\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">JUDGMENT<\/p>\n<p>1995 (1) SCR 357<\/p>\n<p>The following Order of the Court was delivered :\n<\/p>\n<p id=\"p_1\">A notification under s.3 of the Kerala Land Acquisition Act, 1961,<br \/>\nequivalent to s.4(l) of the <a href=\"\/doc\/110162683\/\" id=\"a_1\">Central Act<\/a> was published on September 10,<br \/>\n1974. The possession of the land was taken on March 20, 1977, obviously<br \/>\nafter making the award. On reference, the Subordinate Judge enhanced the<br \/>\ncompensation by his award and decree dated March 21, 1980. While dismissing<br \/>\nthe appeal of the State, the High Court by its judgment and decree dated<br \/>\nJanuary 14, 1988 applied the <a href=\"\/doc\/1210757\/\" id=\"a_1\">Amendment Act<\/a> 68 of 1984 and granted that<br \/>\nstatutory benefits under s,23(l-A), 23(2) and 28 of the <a href=\"\/doc\/7832\/\" id=\"a_2\">Land Acquisition<br \/>\nAct<\/a>, 1894 as amended in Act 68 of 1984. Thus this appeal by special leave<br \/>\nconfining to the question of applicability of the statutory benefits under<br \/>\nAct 68 of 1984.\n<\/p>\n<p id=\"p_2\">It would be seen that the court under s.23(1) while enhancing the<br \/>\ncompensation has been gives power under s.23(1-A) or 23(2), on an<br \/>\napplication, to award the statutory benefits, in addition to the enhanced<br \/>\ncompensation. So, on the application made by the claimant, the court would<br \/>\nnot get jurisdiction to apply the amended Act 68\/1984 except when it has<br \/>\nenhanced the compensation. Even otherwise, it would apply only if<br \/>\nproceedings were pending either before the Land Acquisition Officer or<br \/>\nbefore the civil court before the date when the Bill was introduced on<br \/>\n30.4.82 or the Act came into force, i.e. 24.9.84. Then only the statutory<br \/>\nbenefits would be given on the enhanced compensation and not otherwise.\n<\/p>\n<p id=\"p_3\">Sri. G. Vishvanath Iyer, learned senior counsel for the claimants relied<br \/>\nupon sub-s. (3) of s.30 of the Act and contended that since the amount was<br \/>\nnot paid before possession was taken, the claimants are entitled to the<br \/>\npayment of interest under clause (a) of sub-s (3) of s.30 reads thus :\n<\/p>\n<p id=\"p_4\">&#8220;(a) every case in which possession of any land acquired under the<br \/>\nprincipal Act had been taken before the 30th day of April, 1982 [the date<br \/>\nof Introduction of the Land Acquisition (Amendment) Bill, 1982, in the<br \/>\nHouse of the People], and the amount of com-pensation for such acquisition<br \/>\nhad not been paid or deposited under <a href=\"\/doc\/109957938\/\" id=\"a_3\">Section 31<\/a> of the principal Act until<br \/>\nsuch date, with effect on and from that date;&#8221;\n<\/p>\n<p id=\"p_5\">It would, therefore, clearly indicate that if possession of the land has<br \/>\nbeen taken before 30th April, 1982, i.e. before the introduction of the<br \/>\nLand Acquisition (Amendment) Bill 1982, and the amount of compensation for<br \/>\nsuch acquisition has not been paid or deposited under s.31, the claimant<br \/>\nwould be entitled to the payment of interest as contemplated under s.34 of<br \/>\nthe Principal Act, Since the Land Acquisition Act 1. of 1984 was not<br \/>\napplicable to the State of Kerala, this <a href=\"\/doc\/1596533\/\" id=\"a_4\">Amending Act<\/a> would be applicable<br \/>\nonly from the date on which the <a href=\"\/doc\/1596533\/\" id=\"a_5\">Amending Act<\/a> has come into force, namely,<br \/>\nSeptember 24, 1984, Therefore, the claimants are not entitled to the<br \/>\nbenefits either under s.34 or s.28 as amended under Act 68 of 1984. The<br \/>\nappeal are accordingly allowed. The statutory benefits granted by the High<br \/>\nCourt are set aside.
