NARAYANAN\n\nDATE OF JUDGMENT:\t14\/12\/1999\n\nBENCH:\nB.N.Kirpal, R.P.Sethi\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">DER<br \/>\n      There  &#8220;is  more\tthan one reason\t for  allowing\tthis<br \/>\nappeal.\t  It appears that the appellant had sent money\tfrom<br \/>\nabroad to the respondent to enable him to purchase immovable<br \/>\nproperty  in  the  name of the\tappellant.   The  respondent<br \/>\npurchased properties in his own name and in the names of his<br \/>\nother  brothers in India.  The appellant on 20th July,\t1983<br \/>\nfi1ed.O.S,  No.\t 349\/83 for possession of the suit  property<br \/>\nor its market value.  The case of the appellant was that the<br \/>\nmoney  which was sent was wrongly utilised in purchasing the<br \/>\nproperties  in\tthe name of the respondent and the  brothers<br \/>\ninstead of purchasing the same in the name of the appellant.\n<\/p>\n<p id=\"p_1\">      On  31st\tJuly, 1985, suit for possession was  decreed<br \/>\nwith  costs  and  mesne\t profits were to  be  determined  in<br \/>\nexecution  proceedings.\t  The respondent filed an appeal  to<br \/>\nthe  High  Court  which dismissed the same on  27th  August,<br \/>\n1987, inter alia, holding as follows:\n<\/p>\n<p id=\"p_2\">      &#8220;There  is no evidence in this case to show that\t&#8216;the<br \/>\nplaintiff  wanted to benefit the defendants when he provided<br \/>\nfunds for purchase of landed properties.  On the other hand,<br \/>\nthe avidence is overwhelming in this case to the effect that<br \/>\nmoney was sent by the plaintiff to the defendant in OS.\t No.<br \/>\n345  of\t 1983 for the specific purpose of purchasing  landed<br \/>\nproperties  in\tthe name of the plaintiff, but, instead,  he<br \/>\npurchased  the\tproperties  in the name of himself  and\t his<br \/>\nother  brothers with the fund so provided by the  plaintiff.<br \/>\nTherefore  it  has  to &#8216;be held that the  plaintiff  is\t the<br \/>\nbeneficial owner and he is entitled to recover possession of<br \/>\nthe  plaint schedule properties from the defendants in these<br \/>\nsuits.\t In our view this is a case where S.82 of the Indian<br \/>\nTrusts Act squarely applies,&#8221;\n<\/p>\n<p id=\"p_3\">      A\t special leave petition filed by the respondent\t was<br \/>\ndismissed by this Court on 7th April, 1988.\n<\/p>\n<p id=\"p_4\">      The  appellant  then- filed an  execution\t application<br \/>\nbeing E.P.  .No.  30\/88 before the trial &#8216;court.  Before the<br \/>\nsaid  apoli  cation was disposed of, on 19th May,  1988\t the<br \/>\nBenami\tTransactions  (Prohibition of the Right\t to  Recover<br \/>\nProperty)  Ordinance.  1986 was promulgated.  Basing on this<br \/>\nOrdinance,  objections\twere filed by the respondent to\t the<br \/>\neffect\tthat the decree could not be executed inview of\t the<br \/>\nprovisions  of\tthe  said Ordinance.   The  executing  court<br \/>\ndisallowed  the\t objections  and thereafter  the  respondent<br \/>\nfiled  a  revision  petition  before  the  High\t Court.\t  By<br \/>\njudgment  dated\t 2nd August, 1988, the petition was  allowed<br \/>\nand  in the impugned judgment it was observed that the\tsaid<br \/>\nOrdinance  of 1988 prohibited the recovery of possession  of<br \/>\nthe suit, property which was being held by the respondent as<br \/>\na  benami  of the appellant herein.  It is now well  settled<br \/>\nthat  the  executing  court cannot go behind the  decree  of<br \/>\nacourt of competent jurisdiction or without Jurisdictiol.\n<\/p>\n<p id=\"p_5\">      except  when  the\t decree is void ab  1nitio\/  In\t the<br \/>\npresent\t case,\tthe High Court on 27th August, 1387,  as  is<br \/>\nevident\t from  the passage quoted hereinabove, had  given  a<br \/>\ncategorical finding to the effect that the respondent herein<br \/>\nwas  only a trustee and the case was governed by <a href=\"\/doc\/55962814\/\" id=\"a_1\">Section  82<\/a><br \/>\nof  the\t Indian\t Trusts Act.  <a href=\"\/doc\/1447420\/\" id=\"a_1\">Section 4<\/a> which  contains\t the<br \/>\nprohibition  to recover the property held benami expressly .<br \/>\nprovides  in  sub-section  (3),\t clause (b)  that  the\tsaid<br \/>\nSection\t is not to;  apply, inter alia.\t in a case where the<br \/>\nproperty  is held in the name of a trustee.  In view of\t the<br \/>\nfinding\t of  the Migh Court in its judgment of 27th  August,<br \/>\n1987  that the .  property was being held in the name of the<br \/>\nrespondent  as a &#8230;trustee, the questici of t.he respondent<br \/>\ninvoking the provisions of the Benami Transactions Ordinance<br \/>\nor the Act did not arise.  The provisions of the Act did not<br \/>\nprohibit  a  suit  being  filed against a  trustee  for\t the<br \/>\nrecovery of the trust property.\n<\/p>\n<p id=\"p_6\">      That  aparti this Court in R.  Rajagopal Reddy  (Dead)<br \/>\nby  LRs\t and Others vs.\t Padmini Chandrasekharan (Dead)\t by.<br \/>\nLRs,  1995  (2) SCC 630, has held that the said Act and\t the<br \/>\nOrdinance  were\t not retrospective in operation and the\t Act<br \/>\ndid not apply<\/p>\n<p>      to  pending  suits  which had already been  filed\t and<br \/>\nentertained  prior to the coming into force of <a href=\"\/doc\/1447420\/\" id=\"a_2\">Section 4<\/a>  of<br \/>\nthe Act..  This being so, the High Court in the present case<br \/>\nfell in error in setting aside the decision of the executing<br \/>\ncourt  and  in\tholding that the right.of the  appellant  to<br \/>\nrecover\t possession  had.  come to an end fay virtue of\t the<br \/>\nsaid Act.\n<\/p>\n<p id=\"p_7\">      For  the aforesaid reasons, the appeal is allowed\t and<br \/>\nthe  judgment  of  the\tHigh Court under  appear  dated\t 2nd<br \/>\nAugust, 1988 is set aside, with costs throughout.\n<\/p>\n<p id=\"p_8\">      .\t By order dated 16th September, 1391, the respondent<br \/>\nherein\twas  directed to deposit Rs.10,000\/~&#8217; in  the  trial<br \/>\ncourt  towards annual mesns profits.  When this deposit\t was<br \/>\nnot  made,  an\tapplication was filed by the  appellant\t for<br \/>\nappointment  of a Receiver in respect of the suit  property.<br \/>\nBy  order  dated 3th February, 1993, the appellant him\tself<br \/>\nwas  appointed as a Receiver and was&#8217; put in possession\t but<br \/>\nhe was required to deposit Rs.10,000\/- per year in the trial<br \/>\ncourt.\t Inview\t of  the  fact that the\t appe&#8221;1ant  has\t now<br \/>\nsucceeded  in  this  appeal, he is entitled  to\t retain\t the<br \/>\npossession  of the property as an absolute owner thereof and<br \/>\nwill be entitled to withdraw from the trial court the amount<br \/>\ndeposited  by  him pursuant to the aforesaid order  of\tthis<br \/>\nCourt.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India C.Gangacharan vs C.
