PATTANAIK (J)\n\nCITATION:\n 1996 SCC  (7) 389\t  JT 1996 (1)\t658\n 1996 SCALE  (1)SP36\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     Having perused the judgment of the High Court in Second<br \/>\nAppeal No.542\/75  passed on  13.2.1979, we  are of  the view<br \/>\nthat  the   High  Court\t has  rightly  interfered  with\t the<br \/>\nconcurrent finding  of fact  recorded by  the trial Court as<br \/>\nwell as by the appellate Court and decreed the suit.\n<\/p>\n<p id=\"p_1\">     The trial Court had wrongly proceeded on the premise of<br \/>\nburden of  proof on the plaintiff which was corrected by the<br \/>\nappellate Court.  However,  the\t appellate  Court  committed<br \/>\nanother error of not considering the documentary evidence in<br \/>\nproper perspective  of the respective claims of the parties.<br \/>\nAdmittedly, the\t plaintiffs  and  the  first  defendant\t are<br \/>\nchildren of  Ahmad Malmi  through his first and second wives<br \/>\nrespectively. The  only claim  was with\t regard to one item,<br \/>\nnamely, Konchukakkada  property. It is seen that the case of<br \/>\nthe plaintiffs\twas that it was left undivided to the extent<br \/>\nof their  3\/4th share  therein of  their  father  and  that,<br \/>\ntherefore, they\t are  entitled\tto  partition  and  separate<br \/>\nshare. Ex.A-3  is a  crucial document  in  establishing\t the<br \/>\ntitle of  the plaintiffs  in the property. In those judicial<br \/>\nproceedings it was declared that the defendants in that suit<br \/>\nhad no\ttitle to  the tress.  It would\tappear that  in\t the<br \/>\nisland, the  title to the trees is relatable to the title to<br \/>\nthe land.  Under those\tcircumstances, the  High  Court\t has<br \/>\nproceeded on the basis that it was relatable to the title to<br \/>\nthe property.  That finding  gets corroboration\t from  other<br \/>\njudicial proceedings  under Ex.\t A-4, A-8  and A-9. It would<br \/>\nthus be\t clear that  the title\tof the property which is the<br \/>\nsubject matter\tof the\tpartition  suit\t in  favour  of\t the<br \/>\nrespondents, stands established. The appellate Court had not<br \/>\nconsidered these  documents in\tproper perspective  and\t the<br \/>\neffect of  those documents  on the  rights of  the  parties.<br \/>\nAccordingly, the  learned Judge reluctantly had reconsidered<br \/>\nthe evidence and, in our view, quite rightly since it is not<br \/>\na mere\tappreciation of evidence but drawing inferences from<br \/>\nthe admitted  documents. Since\tproper construction  of\t the<br \/>\ndocuments and  inferences have not legally been drawn by the<br \/>\nappellate Court,  the High  Court has  gone  in\t detail\t and<br \/>\nrecorded the finding thus :\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;It is  with extreme  reluctance that  I<br \/>\n     interfere with the concurrent finding on<br \/>\n     questions of  facts. But  the finding is<br \/>\n     totally   without\t evidence   and\t  is,<br \/>\n     therefore,\t perverse.   The  finding  is<br \/>\n     based on  total misconceptions as to the<br \/>\n     nature of the documents relied upon. The<br \/>\n     finding is\t not reasonably\t supported by<br \/>\n     any evidence whatever. On the other hand<br \/>\n     the  evidence   to\t the   contrary\t  was<br \/>\n     ignored. Exts. A1 to A3 as well as Exts.<br \/>\n     A4,  A6,\tA8  and\t A9,  whatever\ttheir<br \/>\n     evidentiary value, were a pointer in the<br \/>\n     opposite  direction.   Exts.  A1  to  A3<br \/>\n     showed that  the  suit  properties\t were<br \/>\n     gifted in\tfavour of the plaintiff. Ext.<br \/>\n     A4 showed that the authorities competent<br \/>\n     to decided\t on title  to  coconut\ttrees<br \/>\n     considered that  the trees\t standing  in<br \/>\n     the  suit\t property  belonged   to  the<br \/>\n     plaintiffs. It  would appear,  as stated<br \/>\n     by the  lower appellate  court, that  in<br \/>\n     the  Island   at  the   relevant\ttime,<br \/>\n     disputes as to title to properties arose<br \/>\n     only  in  the  form  of  disputes\tabout<br \/>\n     trees. The\t dispute  in  regard  to  the<br \/>\n     trees in  Ex. A4  proceedings was thus a<br \/>\n     dispute in\t regard to  the ownership  of<br \/>\n     the property  in which  the trees stood.<br \/>\n     Again the\tdecision in  Exts. A8  and A9<br \/>\n     proceedings confirmed  the\t validity  of<br \/>\n     Ext. A3 and rejected the Ist defendant&#8217;s<br \/>\n     contentions   to\tthe   contrary.\t  The<br \/>\n     statement of  the 2nd  defendant in  his<br \/>\n     capacity as the power-of-attorney holder<br \/>\n     of the  ist defendant&#8217;s  contentions  to<br \/>\n     the contrary.  The statement  of the 2nd<br \/>\n     defendant in  his capacity as the power-<br \/>\n     of-attorney holder\t of the Ist defendant<br \/>\n     to the  effect that  Attath Mohammad had<br \/>\n     rights in the suit property is also very<br \/>\n     significant. The  Munsif as  well as the<br \/>\n     Judge felt\t that there  was a paucity of<br \/>\n     evidence and the pleadings were far from<br \/>\n     clear. As\tstated by them, the pleadings<br \/>\n     in the  Island at the relevant time were<br \/>\n     not drafted  by experts.  The  trial  in<br \/>\n     this case\twas not\t conducted  with  the<br \/>\n     assistance of  counsel, as\t the  parties<br \/>\n     were represented  by local Mikthiars who<br \/>\n     had  no  legal  training.\tOnly  at  the<br \/>\n     appellate stage  did counsel appear. But<br \/>\n     with all  this infirmity  and handicaps,<br \/>\n     it seems to me that one thing stands out<br \/>\n     clear, and\t that  is,  the\t property  in<br \/>\n     question belonged\tto Ahmmad  Malmi  and<br \/>\n     his nephew\t Abndul Rahman\tand they were<br \/>\n     self-acquisitions of  those persons.  It<br \/>\n     is\t also\tclear\tthat   Abdul   Rahman<br \/>\n     transferred his share in the property to<br \/>\n     Pathumma and  her children including the<br \/>\n     Ist    plaintiff.\t  Furthermore,\t  the<br \/>\n     plaintiffs\t are   the  heirs  of  Ahmmad<br \/>\n     Malmi.  The   only\t defendant   who  was<br \/>\n     personally connected  with Ahmmad\tMalmi<br \/>\n     was the  Ist defendant  who was  born to<br \/>\n     him  by   his   second   marriage.\t  The<br \/>\n     plaintiffs\t recognise   the  rights   of<br \/>\n     defendants 1,  2 and  5 to\t claim\ttheir<br \/>\n     share in the property in accordance with<br \/>\n     their personal  law.  The\tcase  of  the<br \/>\n     plaintiffs\t appears  to  be  reasonable,<br \/>\n     just and,\tin  the\t circumstances,\t well<br \/>\n     founded. In  my view,  they are entitled<br \/>\n     to a decree.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>\t  The Munsiff  after finding that the<br \/>\n     plaintiff did not discharge their burden<br \/>\n     to prove  that  the  suit\tproperty  was<br \/>\n     available for  partition, worked out the<br \/>\n     share to which the parties were entitled<br \/>\n     in the  event  of\this  finding  on  the<br \/>\n     question of  partition being reversed in<br \/>\n     appeal. The  allotment of\tshares by the<br \/>\n     Munsif has\t not been  challenged, and I,<br \/>\n     therefore, accept it as final.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">     Accordingly, a  preliminary decree\t was passed  by\t the<br \/>\nlearned Judge directing the parties to work out their rights<br \/>\nin furtherance thereof.\n<\/p>\n<p id=\"p_3\">     Having  considered\t  the  totality\t of  the  facts\t and<br \/>\ncircumstances, we  are\tof  the\t considered  view  that\t the<br \/>\nlearned Judge  had rightly  interfered with  the  concurrent<br \/>\nfinding of  fact recorded  by the  trial Court and appellate<br \/>\nCourt and  granted a preliminary decree for partition. We do<br \/>\nnot find  any error of law much less substantial question of<br \/>\nlaw, for interference.\n<\/p>\n<p id=\"p_4\">     The appeal is accordingly dismissed.
