No.34233 of 2008\n          ------------------------------------------------\n         Dated this the 20th day of November, 2008\n\n                        JUDGMENT\n<\/pre>\n<p id=\"p_1\">     Heard the counsel for the petitioner.<\/p>\n<p id=\"p_1\">    2. The grievance of the petitioner is<\/p>\n<p>that he filed O.S.6\/06 before the District<\/p>\n<p>Court,   Kavarathi            for          declaration       that<\/p>\n<p>scheduled property belongs to him and the<\/p>\n<p>second respondent jointly and to restrain the<\/p>\n<p>first respondent and his men from trespassing<\/p>\n<p>into the scheduled property and taking the<\/p>\n<p>usufructs and also sought for an order of<\/p>\n<p>temporary prohibitory injunction filing Ext.P2<\/p>\n<p>I.A. in the said suit; that no orders had been<\/p>\n<p>passed thereon and the said I.A is pending;<\/p>\n<p>that while so, the first respondent along with<\/p>\n<p>his men forcibly plucked coconuts from the<\/p>\n<p>scheduled   property              and          therefore,    she<\/p>\n<p>approached the Deputy Collector, Agathi island<\/p>\n<p>and obtained Ext.P3 order with a view to have<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W. P. C. No.34233 of 2008           -2-<\/span><\/p>\n<p>      status quo maintained at least thereafter till<\/p>\n<p>      orders are obtained on Ext.P2 application for<\/p>\n<p>      temporary injunction, but that as no District<\/p>\n<p>      Judge is posted at Kavarathi, the petitioner<\/p>\n<p>      is unable to obtain orders and that therefore,<\/p>\n<p>      the      District      Judge  or  Additional District<\/p>\n<p>      Judge, Kozhikode who holds charge of District<\/p>\n<p>      Judge,           Kavarathi  be    directed  to   pass<\/p>\n<p>      appropriate orders on Ext.P2 at the earliest.<\/p>\n<p id=\"p_2\">              3.       Having  heard   the  submissions of<\/p>\n<p>      counsel for the petitioner, I am of the view<\/p>\n<p>      that appropriate directions are to be issued<\/p>\n<p>      in the matter.\n<\/p>\n<p id=\"p_3\">              4. In the result, I direct the District<\/p>\n<p>      Judge\/Additional District Judge of Kozhikode<\/p>\n<p>      who holds charge of District Judge, Kavarathi<\/p>\n<p>      to       pass       appropriate   orders  on   Ext.P2<\/p>\n<p>      injunction petition in O.S.6\/06 on the file of<\/p>\n<p>      the District Court, Kavarathi as expeditiously<\/p>\n<p>      as      possible      hearing   the counsel  for  the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W. P. C. No.34233 of 2008      -3-<\/span><\/p>\n<p>      respondent as well and in the event of counsel<\/p>\n<p>      for the respondent not turning up to pass<\/p>\n<p>      appropriate interim orders so as to protect<\/p>\n<p>      the scheduled property in the suit.<\/p>\n<p id=\"p_4\">              5.
