Justice R.BASANT\n\n Dated :26\/06\/2007\n\n O R D E R\n                                     R.BASANT, J\n\n                          ------------------------------------\n\n                               B.A.No.3717 of 2007\n\n                          -------------------------------------\n\n                      Dated this the 26th day of June, 2007\n\n\n                                         ORDER\n<\/pre>\n<p id=\"p_1\">       Application for anticipatory bail.   Petitioners are accused 3 and<\/p>\n<p>4   and   they   face   allegations   under   <a href=\"\/doc\/724142\/\" id=\"a_1\">Sections   324<\/a>   and   <a href=\"\/doc\/838469\/\" id=\"a_1\">452<\/a>   I.P.C.     The<\/p>\n<p>crux   of   the   allegations   against   the   petitioners   is   that   on   account   of<\/p>\n<p>animosity   arising   out   of   a   property   dispute   between   the   1st  accused<\/p>\n<p>and the defacto complainant, the 1st  accused along with mercenaries<\/p>\n<p>allegedly attacked the defacto complainant trespassing into the house<\/p>\n<p>of   the   defacto   complainant   and   attacked   with   dangerous   weapons<\/p>\n<p>resulting in serious injuries to the victim.  Damage was caused to the<\/p>\n<p>household   articles   also.     The   alleged   incident   took   place   on<\/p>\n<p>19.04.2007.    Investigation is in progress.   The petitioners apprehend<\/p>\n<p>imminent   arrest.     They   along   with   the   2nd  accused   had   applied   for<\/p>\n<p>anticipatory   bail   and   the   learned   Sessions   Judge   had   granted<\/p>\n<p>anticipatory  bail  to  the  2nd  accused  only.    The  petitioners&#8217;  prayer  for<\/p>\n<p>anticipatory bail was rejected.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.      The   learned   counsel   for   the   petitioners   submits   that   the<\/p>\n<p>petitioners   are   absolutely   innocent   and   are   entitled   for   anticipatory<\/p>\n<p>bail.     The   learned   counsel   for   the   petitioners   points   out   that   the   2nd<\/p>\n<p>accused   having   been   granted   anticipatory   bail   on   the   ground   that<\/p>\n<p>there is uncertainity and dissatisfaction about his alleged presence at<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.3717 of 2007                           2<\/span><\/p>\n<p>the   scene   of   the   crime,   the   petitioners   should   not   have   been   denied<\/p>\n<p>the benefit or advantage arising from that circumstance.<\/p>\n<p id=\"p_3\">         3.    The   learned   Public   Prosecutor     opposes   the   application.<\/p>\n<p>The   allegations   are   serious.     The   wound   certificate   reveals   very<\/p>\n<p>serious injuries suffered by the victim.   In these circumstances, there<\/p>\n<p>is   no   circumstance   to   justify   the   prayer   for   anticipatory   bail.<\/p>\n<p>Recovery   of   the   weapons   will   have   to   be   effected.     In   these<\/p>\n<p>circumstances,   this   application   may   be   dismissed,   prays   the   learned<\/p>\n<p>Public Prosecutor .\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">         4.    I   find   merit   in   the   opposition   by   the   learned   Public<\/p>\n<p>Prosecutor   .     This,   I   am   satisfied,   is   a   fit   case   where   the   petitioner<\/p>\n<p>must appear before the learned Magistrate having jurisdiction or the<\/p>\n<p>Investigating   Officer   and   then   seek   bail   in   the   regular   and   ordinary<\/p>\n<p>course.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">         5.    This application is, in these circumstances, dismissed, but<\/p>\n<p>I  may  hasten to  observe that if the petitioner   surrenders before the<\/p>\n<p>learned   Magistrate   or   the   Investigating   Officer   and   applies   for   bail<\/p>\n<p>after  giving sufficient  prior notice to the  Prosecutor in charge of the<\/p>\n<p>case, the learned Magistrate must proceed to pass appropriate orders<\/p>\n<p>on merits and expeditiously-on the date of surrender itself.<\/p>\n<p id=\"p_8\">                                                                      (R.BASANT, JUDGE)<\/p>\n<p>rtr\/-\n<\/p>\n<p id=\"p_9\">\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sudhilal vs State Of Kerala on 26 June, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 3717 of 2007() 1.
