Akhtar, SC (Mines)\n                                        ---\n9.11.04.2011<\/pre>\n<p id=\"p_1\">         Mr. Jagannath Mahato, learned counsel appearing for the<br \/>\n        petitioners in all the cases, submitted that the petitioners have not<br \/>\n        been given all the benefits under rehabilitation scheme fully.\n<\/p>\n<p id=\"p_1\">        2.         On the other hand, counsel for the State, submitted that in<br \/>\n        the absence of counter-affidavit, they are not in a position to either<br \/>\n      accept or controvert the statements made in the writ petition. They<br \/>\n     further submitted that it is not known whether petitioners&#8217; claim are<br \/>\n     genuine or not and that, in some cases, some amount has been paid.<br \/>\n     They also submitted that if there is any objection, the objectors are to<br \/>\n     be given opportunity of hearing.\n<\/p>\n<p id=\"p_2\">     3.          In the circumstances, petitioners are given liberty to file<br \/>\n     fresh representation individually before the concerned authority. If the<br \/>\n     claims \/ part of it are found genuine on due verification and after<br \/>\n     hearing the concerned parties, if any, the same should be provided to<br \/>\n     them. If the claims \/ part of it are not found genuine, the same should<br \/>\n     be rejected and the reasons thereof should be communicated to the<br \/>\n     petitioners. It goes without saying that if any further amount is found<br \/>\n     payable in any case, the amount already paid, if any, will be adjusted.<br \/>\n     This exercise should be completed as early as possible and preferably<br \/>\n     within three months from the date of receipt of such representations.\n<\/p>\n<p id=\"p_3\">                 It is made clear that this court has not gone into the<br \/>\n     merits of the claims of the petitioners.\n<\/p>\n<p id=\"p_4\">                 With   these   observations    and   directions,   these   writ<br \/>\n     petitions stand disposed of.\n<\/p>\n<p id=\"p_5\">                 As prayed, let a copy of this order be given to the counsel<br \/>\n     for the State.\n<\/p>\n<p id=\"p_6\">                                                         (R.K.
