ANAND, J.\n<\/pre>\n<p id=\"p_1\">            Respondent no.1 (Ram Sarup) is father-in-law of his<\/p>\n<p>estranged daughter-in-law (Sushma).\n<\/p>\n<p id=\"p_1\">            Initially, when the relationship between Sushma and her<\/p>\n<p>husband went uneasy, the former (Sushma) lodged a FIR on 9.10.2003<\/p>\n<p>(Annexure P-1) with the police of Police Station Civil Lines. In the course<\/p>\n<p>thereof, she made a grievance of having been subjected to dowry related<\/p>\n<p>torture at the hands of her husband and other members of her in-laws<\/p>\n<p>family including respondent No.1 (Ram Sarup) her father-in-law. Charge<\/p>\n<p>had been framed against the accused including respondent No.1 (Ram<\/p>\n<p>Sarup)   in that case on 15.3.2005 (Annexure P-2).         Thereafter, Mst.<\/p>\n<p>Sushma filed a divorce petition in the District Court, Kurukshetra on<\/p>\n<p>12.8.2005 (Annexure P-3). That case was transferred by this court from<\/p>\n<p>the Court at Kurukshetra to the Court at Karnal. In that case, dowry articles<\/p>\n<p>were ordered to be released on &#8216;superdari&#8217; on 20.11.2005 which were<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No. 45755 of 2007                               -2-<\/span><\/p>\n<p>                                      ****<\/p>\n<p>released on &#8216;superdari&#8217; to Sushma on 20.11.2005.         As against it, the<\/p>\n<p>present complaint under <a href=\"\/doc\/1436241\/\" id=\"a_1\">Sections 420<\/a>, <a href=\"\/doc\/988620\/\" id=\"a_1\">406<\/a>,<a href=\"\/doc\/180217\/\" id=\"a_2\">506<\/a>, <a href=\"\/doc\/570574\/\" id=\"a_3\">166<\/a>, <a href=\"\/doc\/1815602\/\" id=\"a_4\">167<\/a>, <a href=\"\/doc\/329571\/\" id=\"a_5\">392<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_6\">467<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_7\">471<\/a><\/p>\n<p>and <a href=\"\/doc\/37788\/\" id=\"a_8\">34<\/a> IPC was fled by respondent No.1 (Ram Sarup) on 9.1.2006 in<\/p>\n<p>respect of an occurrence which had allegedly taken place on 14.10.2003.<\/p>\n<p id=\"p_2\">            I have heard Shri J.S.Virk, learned counsel for the petitioner<\/p>\n<p>and Shri S.S.Mor, learned Senior Deputy Advocate General, Haryana for<\/p>\n<p>the respondent-State.\n<\/p>\n<p id=\"p_3\">            None turned up today to address arguments on             behalf of<\/p>\n<p>respondent No.1 (Ram Sarup) inspite of repeated calls during the day.<\/p>\n<p id=\"p_4\">            For the reasons noticed above, it is apparent that present<\/p>\n<p>(private) complaint is an act of reprisal on the part of respondent No.1<\/p>\n<p>(Ram Sarup) against the petitioners. It is particularly so when I find that<\/p>\n<p>dowry articles recovered from the accused had already been released on<\/p>\n<p>superdari on 20.11.2005.\n<\/p>\n<p id=\"p_5\">            The present is, thus, apparently a case in which respondent<\/p>\n<p>No.1 (Ram Sarup) is endeavouring an act of reprisal against the members<\/p>\n<p>of parental family of his estranged daughter-in-law Sushma.      If that were<\/p>\n<p>not so, there is no understandable reason why respondent No.1 (Ram<\/p>\n<p>Sarup) would have lodged the impugned prosecution on 9.1.2006 inspite of<\/p>\n<p>the fact that the impugned occurrence had taken place on 14.10.2003. It is<\/p>\n<p>beyond the pale of controversy that the present complaint came to be filed<\/p>\n<p>only with a view to pressurise       Mst. Sushma daughter-in-law of the<\/p>\n<p>respondent No.1 (Ram Sarup).\n<\/p>\n<p id=\"p_6\">            In the light of the fore-going discussion, I am of the considered<\/p>\n<p>opinion that the present is a case of abuse of process of Court which<\/p>\n<p>cannot be continence       by law.   The adoption of such like attitude of<\/p>\n<p>respondent No.1 (Ram Sarup) cannot be validated in law. The complaint<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No. 45755 of 2007                             -3-<\/span><\/p>\n<p>                                       ****<\/p>\n<p>Annexure P-5 and also all the orders passed in the course thereof including<\/p>\n<p>summoning order shall stand quashed.\n<\/p>\n<p id=\"p_7\">            The petition is allowed.\n<\/p>\n<p id=\"p_8\">\n<pre id=\"pre_1\">October 23, 2008                                    (S.D.
