      In this appeal under section 173<\/a> of the Motor<\/p>\n
Vehicles Act claimant in O.P.(MV) No.2139 of 1995 of the<\/p>\n
Motor Accidents Claims Tribunal, Pala         challenges the<\/p>\n
judgment and award of the Tribunal dated September 26,<\/p>\n
2001 awarding a compensation of Rs.56,250\/- for the loss<\/p>\n
caused to the claimant, on account of the injuries sustained<\/p>\n
by him in a motor accident.\n<\/p>\n
      2. The facts leading to this appeal, in brief, are these:-<\/p>\n
The claimant was aged 45 at the time of the accident and<\/p>\n
used to earn Rs.2,000\/- per month as a Rubber Tapper. On<\/p>\n
December 5, 1993 at about 12 O’ Clock in the noon the<\/p>\n
claimant was traveling in a bus bearing registration No.KEK<\/p>\n
2435 along K.K. Road. At that time another bus bearing<\/p>\n
registration No. KRO 8393 came at a high speed from the<\/p>\n
opposite side and collided head on with the bus in which the<\/p>\n

claimant was traveling. The claimant and other passengers<\/p>\n
sustained injuries in the accident. According to him,<\/p>\n
respondents 1 to 6 as the owners, drivers and insurers of<\/p>\n
the both the buses are jointly and severally liable to pay<\/p>\n
compensation to the claimants, as the accident occurred<\/p>\n
due to negligence on the part of the drivers of both the<\/p>\n
buses. Subsequently, New India Assurance Company Ltd.<\/p>\n
was impleaded as addl. 7th respondent in the O.P.<\/p>\n
      3. Respondents 1, 2 and 7 are the owner, driver and<\/p>\n
insurer of the bus bearing registration No.KRO 8393.<\/p>\n
Respondents 4, 5 and 6 are the owner, driver and insurer of<\/p>\n
the bus bearing registration No.KEK 2435.<\/p>\n
      4. Before the Tribunal respondents 1, 2 and 5<\/p>\n
remained absent and were set ex parte by the Tribunal. The<\/p>\n
third respondent filed written statement, contending that<\/p>\n
the vehicle bearing registration No.KRO 8393 was insured<\/p>\n
with the New India Assurance Company, which was later<\/p>\n
impleaded as addl. 7th respondent. Respondents 4 and 6 did<\/p>\n
not file any written statement.   The seventh respondent<\/p>\n

filed written statement, admitting the policy.<\/p>\n
      5. This O.P. was jointly tried along with other Original<\/p>\n
Petitions filed by the injured persons and a common award<\/p>\n
was passed.\n<\/p>\n
      6. PWs.1 to 4 were examined and Exts. A1 to A23<\/p>\n
were marked on the side of the claimant. No evidence was<\/p>\n
adduced on the side of the contesting respondents. The<\/p>\n
Tribunal, on an appreciation of the evidence, found that the<\/p>\n
accident occurred due to the negligence of the driver of bus<\/p>\n
bearing registration No. KRO 8393 and awarded a<\/p>\n
compensation of Rs.56,250\/- with interest at the rate of 9%<\/p>\n
p.a. from the date of petition till realization against the<\/p>\n
seventh respondent. The claimant has now come up in<\/p>\n
appeal, challenging the quantum of compensation awarded<\/p>\n
by the Tribunal.\n<\/p>\n
      7. Heard the learned counsel for the appellant and<\/p>\n
learned counsel for respondent Nos.3, 6 and 7.<\/p>\n
      8. The accident is not disputed. The finding of the<\/p>\n
Tribunal that the accident occurred due to the negligence<\/p>\n

on the part of the first respondent, driver of bus bearing<\/p>\n
registration No.KRO 8393 is not challenged in this appeal.<\/p>\n
Therefore, the only question which arises for consideration<\/p>\n
is whether the claimant is entitled to any enhanced<\/p>\n
compensation.\n<\/p>\n
      9. The claimant sustained the following injuries as<\/p>\n
revealed from Ext.A7 copy of the wound certificate, Ext.A8<\/p>\n
discharge card and Ext.A9 disability certificate:-<\/p>\n
      1) Lacerated wound on the dorsum of right
\n           hand 3 x 1 c.m.\n<\/p><\/blockquote>\n
      2)     Lacerated wound on the right index
\n           finger 3 x 1 cm.\n<\/p><\/blockquote>\n
      3) Lacerated wound on the right middle
\n           finger 3 x 1 c.m.\n<\/p><\/blockquote>\n
      4)    Lacerated wound root of right ring
\n           finger 3 x 1 c.m.\n<\/p><\/blockquote>\n
He was admitted on December 5, 1993 and was discharged<\/p>\n
on December 24, 1993. Ext.A9 certificate of disability shows<\/p>\n
that the claimant has now the following disabilities:-<\/p>\n
      1)    Horizontal scar with fibrosis on the dorsum
\n           of right palm in relation to 2nd, 3rd, 4th and 5th
\n           fingers right.\n<\/p><\/blockquote>\n

      2) Vertical scar with fibrosis on the extensor
\n           aspect of right index, middle and ring
\n           fingers.\n<\/p><\/blockquote>\n
      3)    Flexion deformity of 10 degree at terminal
\n           interphalangeal joint right index finger.\n<\/p><\/blockquote>\n
      4)    Restricted flexion about 10 degree at meta
\n           carpa phalangeal and inter phalangeal joints
\n           of 2nd, 3rd, 4th and 5th fingers right.\n<\/p><\/blockquote>\n
      5) Absence of grip to hold a thing firmly in the
\n           right palm due to restricted flexion at
\n           metacarpa        phalangeal,       interphalangeal
\n           joints of 2nd, 3rd, 4th and 5th fingers right.\n<\/p><\/blockquote>\n
The doctor assessed the percentage of disability as 10%.<\/p>\n
      10. The Tribunal awarded a total compensation of<\/p>\n
Rs.56,250\/-. Break up of the compensation awarded is as<\/p>\n
under:-\n<\/p>\n
      Loss of earnings                        :    Rs. 5,000\/-\n      Transport to hospital                   :    Rs. 2,000\/-\n      extra nourishment,\n      damage to clothing and articles.\n      Treatment and medicine                  :    Rs. 1,250\/-\n      and bystander's expenses.\n      Pain and suffering                      :    Rs.     8,000\/-\n      Loss of earning power                   :    Rs. 15,000\/-\n      and enjoyment of life.\n      Disability caused                       :    Rs. 25,000\/-\n                                                   ------------------\n           Total                              :    Rs. 56,250\/-\n\nMFA 417\/2002                  6<\/span>\n\n                                            =======\n\n<\/pre>\n
      11. The learned counsel for the appellant has mainly<\/p>\n
sought enhancement of compensation awarded under<\/p>\n
disability caused and loss of earning power. He has also<\/p>\n
pointed out that no compensation was awarded for the loss<\/p>\n
of amenities and enjoyment in life.\n<\/p>\n
      12. For the permanent disability caused, the Tribunal<\/p>\n
awarded a compensation of Rs.25,000\/-. The claimant being<\/p>\n
a Rubber Tapper, aged 45, we feel that the injury sustained<\/p>\n
by him must have caused serious disability. Therefore, we<\/p>\n
feel that a compensation of Rs.40,000\/- would be reasonable<\/p>\n
for the disability caused. Therefore, for the permanent<\/p>\n
disability caused the claimant is entitled to an additional<\/p>\n
compensation of Rs.15,000\/-. However, there is another<\/p>\n
aspect. The Tribunal again awarded a compensation of<\/p>\n
Rs.15,000\/- for loss of earning power, which the claimant is<\/p>\n
not entitled to.\n<\/p>\n
      13. No compensation was awarded by the Tribunal<\/p>\n
for the loss of amenities and enjoyment in life. taking into<\/p>\n

consideration the nature of the injuries sustained , we feel<\/p>\n
that a compensation of Rs.10,000\/- would be reasonable on<\/p>\n
this count. As regards the compensation awarded under<\/p>\n
other heads, we find the same to be reasonable and<\/p>\n
therefore, we are not disturbing the same.<\/p>\n
      14. In the result, the claimant is entitled to an<\/p>\n
additional compensation of Rs.10,000\/- . He is entitled to<\/p>\n
interest @ 9% from the date of petition till realization. The<\/p>\n
seventh respondent, being the insurer of the offending<\/p>\n
vehicle, shall deposit the amount within two months from<\/p>\n
the date of receipt of a copy of this judgment with notice to<\/p>\n
the claimant. The award of the Tribunal is modified to the<\/p>\n
above extent.\n<\/p>\n
      The appeal is disposed of as found above.<\/p>\n
