 claims to be aged about 59 years at<\/p>\n
 the ‘time_v’ofV’faccident and was working as ‘Technical<\/p>\n
lViangagei’\u00b0-;’:’ getting salary of ?141\u00bb,OlO\/– per month and<\/p>\n
  -deductions, net salary of a sum of ?10,500\/– per<\/p>\n
it  Inonth as per Ex.P9 salary voucher. He was hale and<\/p>\n
%W<\/p>\n
healthy prior to the date of accident. He \ufb01led a claim<\/p>\n
petition under Section 166 of the Motor Vehicles “-Act,<\/p>\n
contending that at about 9:30 A.M., on 13.01.2003,<\/p>\n
while he was riding his Kinetic I-Ionda   <\/p>\n
No.KA–03 \/E1-1-491, to go to his :;f;{\u00a3it\u00a2:r3; <\/p>\n
Road ESI hospital 3’unction,,the dmker of <\/p>\n
No.CTA 7836 drove the  a rash. “and negiigent
\nmanner and dashed  rrehicie, due<\/p>\n
to which he sustained,._  immediately<\/p>\n
shifted to  aid treatment ‘<\/p>\n
was gi\u00a7fenVd’an.d.   tod\ufb01osmat Hospital, where
\nfracture. was —  he underwent major
\nsurgeries.\n<\/p>\n
 it is the caseof the claimant that he has taken<\/p>\n
 period of two and a half months and<\/p>\n
during this iperiod, he has undergone lot of untold pain<\/p>\n
 Vdand agony and spent considerable arnount towards<\/p>\n
_’  medical expenses, conveyance, nourishing food and<\/p>\n
  “attendant charges apar from other incidental expenses.<\/p>\n

The doctor has assessed the disability at 7 5% in respect<\/p>\n
of left lower limb. 10% towards shoulder and in <\/p>\n
towards whole body. Further, it is his case  _<\/p>\n
of the injuries sustained in the accident,_–‘he” not ”<\/p>\n
attend the Office for about four  <\/p>\n
he has to be compensated reas,o11ab13rh 2 .<\/p>\n
5. On account  the’;ii–n\u00a3iuries._’sustained,fin the
\naccident, claimant fileldfthe’ before the
\nTribunal, under   V   ‘Vehicles Act.\n<\/p>\n
seeking    iakhs against
\nthe   owner of the offending
\nvehicl\\~’*~-,_   petition had come up for<\/p>\n
consicpi.-Ciratioln before fthe””f[‘ribunal on 9%” August 2005.<\/p>\n
‘Tlr\u00e91e”‘r*-T” rilziunal, aftefconsidering the relevant material<\/p>\n
 after appreciation of the oral and<\/p>\n
 docu.ment’ary evidence, allowed the claim petition in<\/p>\n
 awarding a sum of 13,12,000\/~ under different<\/p>\n
 -_he’ads’l, with interest at 6% per annum from the date of<\/p>\n
if  ‘petition till the date of deposit. Being aggrieved by the<\/p>\n
AM<\/p>\n
I<\/p>\n
quantum of compensation awarded by Tribunal, the<\/p>\n
Insurance Company has presented this appeal, seelririg<\/p>\n
reduction of compensation on the ground  _<\/p>\n
compensation awarded is excessive, pexorbitanitv a’nd’–_is <\/p>\n
on the higher side.\n<\/p>\n
6. We have heard leailnedzgcounsel.  ford<\/p>\n
claimant and learned Counse1_…app_e’aringhlforlnsfurance
\nCompany for considerable’   _V<\/p>\n
7. Afterjcritical  records
\navailable     perusal of the
\njudgment”and’:awaf3d–  can be seen that the
\noccurrence’  of   the resultant injuries<\/p>\n
sustained the clairnlant are not in dispute. It is also<\/p>\n
‘xdnot dispute that””the claimant was aged about 59<\/p>\n
3rea.;s;euzo;k:ng  Technical Manager in a Private firm,<\/p>\n
  getting  of ?l4,010\/– per month and net<\/p>\n
R.””‘~..VVV’salary.oft?10.5O0\/- as per Ex.P9, salary voucher. The<\/p>\n
 g.rol_aimant has taken treatment for a period of two and a<\/p>\n
  half months and underwent four surgeries. The Doctor<\/p>\n
L<\/p>\n
has assessed the disability towards left lower limb at<\/p>\n
75%, 10% towards the shoulder, and whole <\/p>\n
disability at 27%. But, the Tribunal, after  _<\/p>\n
the oral and documentary evidencehhgas reeasvsessed the  it  it<\/p>\n
whole body disability at 10% for  lord:-:fs..,,y0’f:;_Al<\/p>\n
future income. The claimanthas to u’n.dergol.:thi.s~.ord.ea1<\/p>\n
throughout his life and this _in.._theway._gof_his day
\nto day activities. He has treatment and
\nbed rest for abc)u1\u00bb:_  have spent
\nsome amount.   nourishing food and
\n regard to all these
\naspectsifwe  ?f7.5,000\/- towards pain and<\/p>\n
sufferings as _”aga:1.nsts$55,000\/–, $40,000\/– towards<\/p>\n
.”con”v-eya.n’ce’;– by nourishing food and attendant charges,<\/p>\n
towa_1:ds loss of amenities, discomforts, and<\/p>\n
unla-appvj..:1ess it on account of disability as against<\/p>\n
 and a sum of $42,000\/– towards loss of<\/p>\n
  income during treatment period at the rate of ?10,500\/–<\/p>\n
per month for a period of four months as against<\/p>\n
?\u00b024,000\/ — awarded by Tribunal.<\/p>\n
8. Further, so far as the compensation _<\/p>\n
towards loss of future income is _conce1’n.ed,”‘as_j .right1y  <\/p>\n
pointed out by learned counsel  <\/p>\n
the claimant is not entitled forany cornpensatior_i””under<\/p>\n
the said head. Admittedly,_.the.”L_e1ainianlt” ‘wa.s_:l1ready

of the case, as stated above, the appeals <\/p>\n
