Nanakpura\n\n\nFacts<\/pre>\n<p id=\"p_1\">:\n<\/p>\n<p id=\"p_1\">      By an application of 23.1.07 Shri Beer Singh of Vikas Enclave, Distt.<br \/>\nMeerut applied to the Jt. Commissioner of Police, CAW Cell Nanakpura, New<br \/>\nDelhi seeking the following information:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         &#8220;Copies of complaints made by Smt. Roopa w\/o Late Shri Santosh<br \/>\n         Kumar r\/o Gali No. 63, Sixty Foots, 3rd road, Sadarpur Border, New<br \/>\n         Delhi, against the applicant (me).&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">     To this he received a response on 23.2.07 refusing the information sought<br \/>\nu\/s 8(1) (g). Aggrieved Shri Beer Singh moved his first appeal on 17.3.07, not<br \/>\nsubmitting any further plea contesting the refusal but simply stating that his<br \/>\nrequest &#8220;could not be accepted due to Sec. 8(1)&#8221;. Upon this, through an order of<br \/>\n20.4.07, First Appellate Authority Shri Tejinder Luthra decided as follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         &#8220;Smt. Roopa Rani had submitted a complaint of matrimonial discord<br \/>\n         in CAW Cell Nanakpura, New Delhi. The complaint has been<br \/>\n         closed temporarily on her request. Such information can be<br \/>\n         withheld in view of the exemptions from disclosure of information<br \/>\n         u\/s 8(1) (g) of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a> 2005.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>         In view of the discussion above, the copy of complaint cannot be<br \/>\n         supplied to the appellant as per the restrictions imposed u\/s 8(1) (g)<br \/>\n         of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>, 2005. Hence the appeal is hereby disallowed.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_3\">Appellant&#8217;s prayer before us in his second appeal is as below:\n<\/p>\n<blockquote id=\"blockquote_3\"><p>         &#8220;It is kindly prayed that the Authority may be directed to<br \/>\n         furnish the copy of the complaint made against, by Smt.<br \/>\n         Roopa and the official responsible for the harassment by way<br \/>\n         of not providing the requisite information may be penalized in<br \/>\n         accordance with the provisions of <a href=\"\/doc\/671631\/\" id=\"a_3\">RTI Act<\/a> 2005.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_1\">                                               1<\/span><\/p>\n<p id=\"p_4\">       The appeal was heard on 24.11.08. Although arrangements had been<br \/>\nmade for hearing the appeal through videoconference at Meerut, appellant has<br \/>\nopted not to be present. When contacted on telephone, he stated that he was<br \/>\npart of a wedding procession (baarat) and did not wish to appear before us.<br \/>\nRespondent Shri H.P.S. Virk, DCP, CAW Cell is present.\n<\/p>\n<p id=\"p_5\">                           DECISION NOTICE<\/p>\n<p>     This appears to be a case of marital discord now resolved resulting in<br \/>\nclosure of the case.    Given the history of gender relations in Delhi and its<br \/>\nperipheries of which the city of Meerut is a part, it is not unfair to assume that<br \/>\ndisclosure of information provided by a complainant in a case of marital discord<br \/>\ncould, after closure of such discord, even if temporary, become a reason for<br \/>\nendangering the life or physical safety of the person providing such information.<br \/>\nWe would, however, observe that CPIO has erred in refusing the information<br \/>\noutright without giving details why such exemption is justified u\/s 8(1) (g). This<br \/>\ndefect has, however, been remedied by the order of the First Appellate Authority.<br \/>\nThe appeal, therefore, is hereby dismissed.\n<\/p>\n<p id=\"p_6\">      Announced in the hearing.
