No.3184 of 2011\n     DAVESH CHANDRA SAXENA s\/o Late Saryu Prasad Saxena, R\/o Mohalla- Postal Park,\n     Road, No.1, Near Postal Part, Post Office, P.S.- Kankarbagh, District- Patna.\n                                                                                   ...Petitioner\n\n                                          Versus\n\n          THE STATE OF BIHAR THROUGH VIGILANCE                                        ...OP\n                                 -----------\n<\/pre>\n<p id=\"p_1\">3\/    14.02.2011                    Heard the parties.\n<\/p>\n<p id=\"p_1\">                                    The petitioner has sought quashing of the entire<\/p>\n<p>                        proceeding in Special Case No. 30 of 1988 pending before the<\/p>\n<p>                        Special Judge II, Vigilance, Patna, on the ground that no sanction<\/p>\n<p>                        under <a href=\"\/doc\/12704\/\" id=\"a_1\">section 197<\/a> Cr. P. C. and <a href=\"\/doc\/97670\/\" id=\"a_1\">section 19<\/a> of the Prevention of<\/p>\n<p>                        Corruption Act, 1988, has been obtained. However, during<\/p>\n<p>                        argument, the petitioner confined his prayer to seeking quashing<\/p>\n<p>                        only on the ground that no sanction had been obtained under <a href=\"\/doc\/12704\/\" id=\"a_2\">section<\/p>\n<p>                        197<\/a> Cr. P. C.\n<\/p>\n<p id=\"p_2\">                                    The prosecution case is that the petitioner by his lapse in<\/p>\n<p>                        official duty had caused loss of Rs.4900\/- to the government<\/p>\n<p>                        exchequer. The case was instituted on 22.8.1988, whereafter charge-<\/p>\n<p>                        sheet was submitted on 30.06.1992 and the police papers were<\/p>\n<p>                        supplied in the year 2007, whereas, charges were framed on<\/p>\n<p>                        10.12.2008. After examination of the witnesses, case of the<\/p>\n<p>                        prosecution was closed on 06.08.2010 and the statement of the<\/p>\n<p>                        accused was recorded under <a href=\"\/doc\/767287\/\" id=\"a_3\">section 313<\/a> Cr. P. C. on 09.08.2010,<\/p>\n<p>                        whereas, the defence was closed on 2.10.2010. This application has<\/p>\n<p>                        been filed on 24.01.2011 seeking quashing on the question of<\/p>\n<p>                        sanction.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p id=\"p_3\">\n<p>                   Considering that the petitioner has been charged also<\/p>\n<p>       under the various offences punishable under the provision of<\/p>\n<p>       <a href=\"\/doc\/1331755\/\" id=\"a_4\">Prevention of Corruption Act<\/a> as also that the trial is at the fag ended<\/p>\n<p>       I am not inclined to interfere in the matter.<\/p>\n<p id=\"p_4\">                   However, it will be open to the petitioner to raise this<\/p>\n<p>       point at the stage of argument since in the facts of this case such an<\/p>\n<p>       issue can be determined only at that stage.\n<\/p>\n<p id=\"p_5\">                   With this observation, the application is disposed of.<\/p>\n<pre id=\"pre_1\">JA\/-                                            (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Davesh Chandra Saxena vs The State Of Bihar Through Vig on 14 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
