Of Delhi (Hospital Admn.)\n\n\n           Facts<\/pre>\n<p id=\"p_1\">:\n<\/p>\n<p id=\"p_1\">         By an application of 20.12.06, assigned ID No. 215, Shri Krishna<br \/>\nKumar Sachan of Shastri Nagar, Delhi applied to the PIO Director<br \/>\n(Hospital Admn) MCD seeking the following information:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>      1. &#8220;Sanction u\/s 197 Cr. PC for filing a Criminal complaint case between<br \/>\n         8.1.1997 to 28.10.1998 by DR. R. V. Ahirwal who was employed as<br \/>\n         Resident Medical Supdt of Hudson Line maternity Hospital, Kingsway<br \/>\n         Camp, Delhi.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      2. Dr. R. V. Ahirwal had filed a Criminal complaint against his Pharmacist K.<br \/>\n         K. Sachan u\/s 166\/186\/323\/353\/511 <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a> and Sec 3 (1) (X) of SC\/ST Act<br \/>\n         (POA Act) 1989, which is pending trial in the Court of Shri Rajnish Kumar<br \/>\n         Gupta, ASF Delhi and is now fixed for 13.2.2007.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>           Kindly intimate us, it any prior sanction was obtained from the Department<br \/>\n           for initiating criminal prosecution by a public servant i.e. Dr. R. V. Ahirwal<br \/>\n           against another public servant Shri K. K. Sachan, between 8.1.1997 to<br \/>\n           28.10.1998. If, yes, then kindly supply the copy of the sanction.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">         To this he received a response of 15.1.07 from Director (Hospital Admn) attaching<br \/>\na copy of a point wise response from Addl. MHO (M) as follows:\n<\/p>\n<blockquote id=\"blockquote_3\"><p>      1. &#8220;As per report from RMS\/ Hudson Line Mty. Home dated 29.12.2006, no<br \/>\n         record whatsoever w.r.t. the case against Shri R. K. Sachan, Pharmacist,<br \/>\n         U\/S 166\/ 186\/ 189\/ 323\/ 511 <a href=\"\/doc\/1569253\/\" id=\"a_2\">IPC<\/a> and <a href=\"\/doc\/1869099\/\" id=\"a_3\">Section 3<\/a> (1) (K) of SC\/<a href=\"\/doc\/53524\/\" id=\"a_4\">ST Act<\/a><br \/>\n         (POA) 1989. Which is pending trial in the court of Hon&#8217;ble Shri Rajnish<br \/>\n         Kumar Gupta, ASJ, Delhi; no record whatsoever, w.r.t. the case is<br \/>\n         available at Hudson Line Mty. Home.1<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_4\"><p>      2. As per report from Dr. R. V. Ahirwal, who had filed criminal complaint<br \/>\n         regarding sanction U\/S 197 C for filing a criminal case, it is informed.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>         a)     Incidence was reported to ADHS (GD) on 9.1.1997 Diary No.<br \/>\n                5851\/ADHS (GD) for necessary action against K. K. Sachan etc.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">1<\/span><br \/>\n    Highlighted by us<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                 1<\/span>\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>        b)      Matter was again reported to Commissioner MCD on 20.1.1997 or<br \/>\n               20.2.1997.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>       c)      Written complaint for necessary action\/ permission who handed<br \/>\n               over to Commissioner Mr. V. K. Duggal Personally on 5.3.1997.<br \/>\n               Commissioner ordered inquiry. But enquiry was never was never<br \/>\n               conducted.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>       d)      When no action was taken against Shri K. K. Sachan,<br \/>\n               Pharmacists who has abused and assaulted RMS a suit was filed<br \/>\n               in Tis Hazari Court in April 1997.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>       e)      Advocate advised that suit of common complaint\/ grievances<br \/>\n               should be bifurcated to two separate cases. One against MCD<br \/>\n               and other a criminal case against the pharmacist Shri K. K.<br \/>\n               Sachan etc. So this suit was withdrawn.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>       f)      In Oct 1998 a criminal case was filed against Shri K. K. Sachan<br \/>\n               U\/S, SC\/ST Atrocity Act and other <a href=\"\/doc\/1569253\/\" id=\"a_5\">IPC<\/a>s. Along with a legal notice<br \/>\n               was sent to Comm. MCD Shri V. K. Duggal by registered post.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">     Not satisfied with this response, however, Shri Sachan moved a first appeal on<br \/>\n23.1.07 praying that the matter may be reconsidered and &#8220;Appellant be provided with<br \/>\nthe requisite information as per ground no. A at earliest.&#8221;\n<\/p>\n<p id=\"p_4\">Ground No. A referred to above is as follows:\n<\/p>\n<blockquote id=\"blockquote_11\"><p>       &#8220;The main question is whether Dr. R. V. Ahirwal before filing a criminal<br \/>\n       complaint case against the appellant K. K. Sachan, as a Pharmacist<br \/>\n       regarding the incident dated 8.1.97, has obtained the sanction under<br \/>\n       <a href=\"\/doc\/12704\/\" id=\"a_6\">section 197<\/a> Cr. P. C. or not.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">     Upon this Shri K. D. Akolia, Addl. Commr. (Health &amp; Estt) has in his order of<br \/>\n22.2.07 come to the following curious conclusion:\n<\/p>\n<blockquote id=\"blockquote_12\"><p>       &#8220;It is gathered that Dr. R. V. Ahirwal and Shri Kishan Kumar Sachan both<br \/>\n       are employees of the MCD. Dr. R. V. Ahirwal had filed a criminal<br \/>\n       complaint       against his Pharmacist, Shri Kishan Kumar Sachan under<br \/>\n       <a href=\"\/doc\/570574\/\" id=\"a_7\">section 166<\/a>\/ <a href=\"\/doc\/488479\/\" id=\"a_8\">186<\/a>\/ <a href=\"\/doc\/454796\/\" id=\"a_9\">189<\/a>\/ <a href=\"\/doc\/1011035\/\" id=\"a_10\">323<\/a>\/ <a href=\"\/doc\/1208971\/\" id=\"a_11\">353<\/a>\/<a href=\"\/doc\/1185693\/\" id=\"a_12\">511<\/a> IPC and as per <a href=\"\/doc\/1869099\/\" id=\"a_13\">section 3<\/a> (1) (X) of<br \/>\n       SC\/ST Act (POA Act) 1989. The matter is subjudicated (sic). Keeping in<br \/>\n       view these facts, I am of the view that the PIO has rightly denied the<br \/>\n       required information under <a href=\"\/doc\/1525538\/\" id=\"a_14\">section 8<\/a> (1) (h) of the <a href=\"\/doc\/671631\/\" id=\"a_15\">RTI Act<\/a>. Therefore, the<br \/>\n       present appeal is rejected.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">     This is a curious decision because the case in question is between Dr. R.V.Ahirwal<br \/>\nand Shri K.K. Sachan and is not under any investigation, nor is there any prosecuting<br \/>\nagency that has taken such a plea, nor indeed is there any party classified as offender.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                             2<\/span><\/p>\n<p id=\"p_7\"> This is in fact a private litigation between two parties who are both government officials.<br \/>\nIn his prayer before us, Shri Sachan has pleaded as follows:\n<\/p>\n<blockquote id=\"blockquote_13\"><p>          &#8220;It is most humbly prayed that the Impugned Order No. 954\/ Addl.<br \/>\n          Cmr\/ H and Estt. \/2007 dated 27.2.2007 may please be set aside and<br \/>\n          the appellant be given the information in very clear terms whether<br \/>\n          DR. R. V. Ahirwal before instituting a private criminal complaint a<br \/>\n          case against the appellant on the basis of incident dated 8.1.1997<br \/>\n          has obtained prior sanction under section 197 Cr. PC.&#8221;<\/p><\/blockquote>\n<p id=\"p_8\">          In her response dated 17.7.08 to appeal notice PIO\/Director (Hospital Admn) has<br \/>\nsubmitted as follows:\n<\/p>\n<blockquote id=\"blockquote_14\"><p>          &#8220;The CMO (HQ) has obtained the reply from Dr. R. V. Ahirwal, which is<br \/>\n          enclosed herewith. On perusal of the reply submitted by Dr. R. V. Ahirwal<br \/>\n          and accompanying enclosures, it is evident that no such permission<br \/>\n          was obtained by him2. However, Dr. R. V. Ahirwal informed the<br \/>\n          incidence to the Commissioner, MCD and Addl. Dir. Health Services<br \/>\n          (GD), MCD on 9.1.1997.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_9\">The appeal was heard on 24.7.08. The following are present:\n<\/p>\n<blockquote id=\"blockquote_15\"><p>          APPELLANT<br \/>\n               Shri Krishan Kumar Sachan<\/p>\n<p>          RESPONDENTS<br \/>\n               Dr. S. Basu, CMO (HQ) MCD<br \/>\n               Dr. Madhu Jain, D.H.A.<\/p><\/blockquote>\n<p id=\"p_10\">               Dr. R. V. Ahirwal, NFSH HRH MCD<\/p>\n<p>        Appellant Shri Sachan submitted that he had not received a clear answer to his<br \/>\nquestion whether permission had been taken by Dr. Ahirwal. Dr. Ahirwal who appeared<br \/>\nafter the hearing submitted that although he had submitted a complaint to M.C.D. he had<br \/>\nnot sought permission for initiating any preliminary prosecution against Shri K. K.<br \/>\nSachan.\n<\/p>\n<p id=\"p_11\">                                DECISION NOTICE<\/p>\n<p>        It is clear that information sought by the appellant in his application of 20.12.06,<br \/>\nwas replied on 15.1.07, in the very initial response of the Director (Hospital Admn) by<br \/>\nconveying to him that there was &#8220;no record whatsoever w.r.t. the case is available at the<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">2<\/span><br \/>\n    Emphasis ours<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                              3<\/span><br \/>\n Hudson Line Maternity Home.&#8221;3 This decision has been confirmed in the response to the<br \/>\nappeal notice from PIO\/Director HA, as quoted above, with our emphasis. A copy of this<br \/>\nresponse is hereby provided to appellant Shri K. K. Sachan, in clarification. With this<br \/>\nthe appeal stands disposed of.\n<\/p>\n<p id=\"p_12\">Announced in the hearing.
