Justice K.HEMA\n\n Dated :\/  \/\n\n O R D E R\n                            K.HEMA, J.\n                    ------------------------------\n                      B.A. No.5624 OF 2008\n                    ------------------------------\n             Dated this the 5th day of September, 2008\n\n\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">     This petition is for bail.\n<\/p>\n<p id=\"p_1\">     2.    The alleged offence is under Section 8(2) of the Abkari<\/p>\n<p>Act. According to the prosecution, the petitioner was found in<\/p>\n<p>possession of 5 litres of arrack on 18.11.2007.<\/p>\n<p id=\"p_2\">     3.    Petitioner was arrested on 13.08.2008 in connection<\/p>\n<p>with crime No.439 of 2008 of Ezhukone police station and the<\/p>\n<p>arrest in this case was recorded on 30.08.2008.<\/p>\n<p id=\"p_3\">     4.    Learned Public Prosecutor submitted that he has no<\/p>\n<p>objection in granting bail to the petitioner, but conditions may be<\/p>\n<p>imposed.\n<\/p>\n<p id=\"p_4\">     Hence, the petitioner is granted bail on the following terms<\/p>\n<p>and conditions:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>       (i)    The petitioner shall execute a bond for Rs.25,000\/-<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>              with two solvent sureties each for like sum to the<\/p>\n<p>              satisfaction of the Magistrate court concerned.<\/p>\n<p>B.A.5624\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 2<\/span><\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_2\"><p>       (ii)  The petitioner shall report before the Investigating<\/p>\n<p>             Officer on every Monday, Wednesday and Saturday<\/p>\n<p>             between 10 a.m. and 1 p.m. until further orders.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>       (iii) The petitioner shall not commit any offence while on<\/p>\n<p>             bail and in case of breach of this condition, bail is<\/p>\n<p>             liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>      The petition is allowed.<\/p><\/blockquote>\n<p id=\"p_5\">\n<p id=\"p_6\">                            K.HEMA, JUDGE<\/p>\n<p>pac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Anil Kumar vs State Of Kerala Represented By The IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5624 of 2008() 1.
