No.44278 of 2010\n                                   INDRADEO THAKUR\n                                            Versus\n                                 THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p id=\"p_1\">2\/   18.04.2011              Heard learned counsel for the petitioner and learned<\/p>\n<p>                   counsel for the State.\n<\/p>\n<p id=\"p_1\">                             Privilege for helpless lady may not be allowed to be<\/p>\n<p>                   used as weapon to have share of her choice in ancestral property<\/p>\n<p>                   which appears, has been done in this case. Marriage is 25 years old<\/p>\n<p>                   and complainant&#8217;s younger son is 15 years old, while elder one is<\/p>\n<p>                   24 years. Torture is for demand of dowry also but husband has not<\/p>\n<p>                   been made party. Petitioner has been alleged for attempt to<\/p>\n<p>                   commit rape but cognizance has not been taken for the same.<\/p>\n<p>                   Earlier to this case, a complaint case is filed on behalf of the<\/p>\n<p>                   petitioner&#8217;s father against the complainant, her husband and son<\/p>\n<p>                   for assault and theft. Petitioner is with his father, so to create a<\/p>\n<p>                   defence this case is lodged. It appears that no mind is applied by<\/p>\n<p>                   Courts while cognizance is taken.\n<\/p>\n<p id=\"p_2\">                             Considering the facts and circumstances of the case,<\/p>\n<p>                   prayer of the petitioner for bail is allowed.\n<\/p>\n<p id=\"p_3\">                             In the event of arrest or surrender within one month<\/p>\n<p>                   from the date of receipt\/production of a copy of this order in<\/p>\n<p>                   connection with Complaint        Case No. 1304C of 2009 above<\/p>\n<p>                   named petitioner shall be released on bail on furnishing bail bond<\/p>\n<p>                   of Rs. 10,000\/- (ten thousand) with two sureties of the like amount<\/p>\n<p>                   each to the satisfaction of S.D.J.M., Jamui subject to the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            2<\/span><\/p>\n<p>        conditions as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_1\">Section 438(2)<\/a> of Cr.
