Vidya Bhaladhare vs The State Of Madhya Pradesh on 30 June, 2010<\/div>\n<pre id=\"pre_1\">30.06.2010.\n         Shri Sushil Mishra for the petitioners.\n         Shri Rajesh Tiwari, Government Advocate, for the\nrespondents.<\/pre>\n<p id=\"p_1\">         Petitioners are working in the respondents&#8217; establishment as<br \/>\nANM. Claiming regularization in service, this petition has been<br \/>\nfiled.\n<\/p>\n<p id=\"p_1\">         Similar petitions, Writ Petition Nos. 12507\/09 and 13013\/09<br \/>\nand more than ten other cases, have been decided by a common<br \/>\norder dated 23.12.2009, by a Bench of this Court. In W.P.No.<br \/>\n12601\/09 (Smt. Kalpana Dubey and others Vs. State of MP and<br \/>\nothers), in the light of the law laid down by the Supreme Court in<br \/>\nthe case of Secretary, State of Karnataka and others Vs.<br \/>\nUmadevi (3) and others, (2006) 4 SCC 1, and after considering<br \/>\nthe arguments advanced by learned Advocate General, the<br \/>\npetitions were disposed of with the following directions:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         &#8221;     In view of the aforesaid, all the petitions are disposed<br \/>\n         of finally with following directions:-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>         1.    That the petitioner may submit a detailed representation<br \/>\n               for his regularization as per the policy dated 16.5.2007,<br \/>\n               subsequent clarifications and instructions issued in<br \/>\n               continuation to the policy dated 16.5.2007 for<br \/>\n               consideration of his case for regularization.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>         2.    In the representation, the petitioner shall disclose his\/her<br \/>\n               eligibility for regularization, qualification, date of his<br \/>\n               engagement in the daily wages.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>         3.    Apart from this, the petitioner may also state his<br \/>\n               grievance that some junior(s) to the petitioner has been<br \/>\n               regularized in compliance of the policy dated 16.5.2007<br \/>\n               ignoring his seniority. In this regard, petitioner shall<br \/>\n               specifically furnish the particulars of such an employee<br \/>\n               who has been regularized ignoring the seniority of the<br \/>\n               petitioner. He may also agitate his case in case any<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                    2<\/span><\/p>\n<p>      similarly situated employee in the department has been<br \/>\n      regularized ignoring the case of the petitioner, by raising<br \/>\n      this issue with particulars.\n<\/p><\/blockquote>\n<p id=\"p_2\">4.    If such representation is made by the petitioner within a<br \/>\n      period of 60 days from today supported by necessary<br \/>\n      documents, if any, the competent authority of the State<br \/>\n      shall examine each and every case as per the policy<br \/>\n      dated 16.5.2009 and pass a reasoned order in this regard<br \/>\n      and shall communicated its decision to the petitioner<br \/>\n      forthwith.\n<\/p>\n<p id=\"p_3\">5.    If the petitioner is found entitled for regularization as per<br \/>\n      the policy dated 16.5.2007, the petitioner shall be<br \/>\n      regularized as per the policy with all monitory benefits.\n<\/p>\n<p id=\"p_4\">6.    In case, the case of the petitioner has already been<br \/>\n      examine by the respondents in compliance of the policy<br \/>\n      dated     16.5.2007,     then    the     respondents     shall<br \/>\n      communicate about such consideration and rejection of<br \/>\n      the case to the petitioner forthwith within a period of 30<br \/>\n      days from the date of receipt of such representation.\n<\/p>\n<p id=\"p_5\">7.    The respondents shall complete the exercise within a<br \/>\n      period of 90 days from the date of receipt of the<br \/>\n      representation and shall communicate their decisions<br \/>\n      within a period of 15 days from the date of decision by<br \/>\n      registered A.D. mode to the petitioner.\n<\/p>\n<p id=\"p_6\">8.    It is made clear that in case the petitioner had<br \/>\n      approached to this Court earlier at any point of time for<br \/>\n      the same relief and any order has been passed in the<br \/>\n      matter, petitioner shall enclose copy of that order<br \/>\n      alongwith his representation for the information of the<br \/>\n      respondents in this regard.\n<\/p>\n<p id=\"p_7\">9.    The representation shall be sent by the petitioner<br \/>\n      through proper channel supported by necessary<br \/>\n      documents and copy of this petition, for ready reference<br \/>\n      of the concerned authority. One advance copy of the<br \/>\n      representation shall be sent by the petitioner by<br \/>\n      registered A.D. mode to the Head of the Department<br \/>\n      alongwith the aforesaid papers for information and<br \/>\n      necessary action.\n<\/p>\n<p id=\"p_8\">10.   While considering the case of the petitioner, the<br \/>\n      respondents shall also take into consideration the policy<br \/>\n      dated 6.9.2008 by which the daily rated employees who<br \/>\n      have completed 10-20 years of service have been found<br \/>\n      entitled for special allowance at the rate of Rs.500\/- and<br \/>\n      Rs.1000\/- respectively w.e.f. 1.1.2008 and shall pass an<br \/>\n      appropriate order in this regard.&#8221;\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                       3<\/span><\/p>\n<p id=\"p_9\">        As the petitioners are working in the same capacity and their<br \/>\ncase is also identical, this petition is also disposed of in identical<br \/>\nterms as indicated hereinabove. Case of all the petitioners be also<br \/>\nconsidered in the light of the directions already issued in the case of<br \/>\nSmt.
