Learned<br \/>\nadvocate submitted that in one decision of this Court in Special<br \/>\nCivil Application No.2112 of 2011 dated 14th July, 2011<br \/>\n[Annexure-E, Page-38] wherein this Court has observed that in<br \/>\nGovernment Resolution dated 29th March, 2007 there is no<br \/>\ncriteria or ceiling income has been made specifically which has not<br \/>\nbeen considered by respondent authority while examining application<br \/>\nmade by the petitioner for compassionate appointment. Therefore,<br \/>\nrelevant paras: 2 to 4.1 of order which has been passed by this Court<br \/>\ndated 14th July, 2011 in SCA No. 2112 of 2011 are quoted<br \/>\nas under:\n<\/p>\n<p id=\"p_3\">&#8221; 2.0\tThe<br \/>\nrequest \/ application made by petitioner for compassionate<br \/>\nappointment has been rejected by respondents by communications dated<br \/>\n19th June 2010 and 6th July 2010, Annexure &#8216;E&#8217;<br \/>\ncollectively, page 26 and 27 only on the ground that family of the<br \/>\npetitioner receives family pension of Rs.8,866\/- and other retiral<br \/>\nbenefits of Rs.9,27,957\/- have been received by the family of the<br \/>\npetitioner after the death of concerned employee on 12th<br \/>\nNovember 2008.  Therefore, respondents &#8211; authorities have<br \/>\nconsidered subsequent Government Resolution dated 29th<br \/>\nMarch 2007 and came to conclusion that family of the petitioner is<br \/>\nnot in a pitiable condition and therefore, the request made by<br \/>\npetitioner was rejected.\n<\/p>\n<p id=\"p_4\">3.0\tLearned<br \/>\nadvocate Mr. Pandit, appearing on behalf of petitioner submitted that<br \/>\nin Annexure &#8216;G&#8217;, page 41 to 44, wherein, information as regards<br \/>\napplication under the provisions of Right to <a href=\"\/doc\/1965344\/\" id=\"a_1\">Information Act<\/a> has been<br \/>\nprovided, wherein, on  page 44 it is specifically made clear that, in<br \/>\nGovernment Resolution dated 29th March 2007, no income<br \/>\nceiling has been specified for considering application for<br \/>\ncompassionate appointment, either by GAD or by Panchayat Department.<br \/>\nTherefore, learned advocate Mr. Pandit submitted that, case of<br \/>\npetitioner, which has been rejected by respondents considering<br \/>\nGovernment Resolution dated 29th March 2007, keeping in<br \/>\nmind amount of retiral benefits, which has been received by family of<br \/>\npetitioner and family pension being received by family of petitioner,<br \/>\nis not applicable to petitioner, as no such criteria have been set<br \/>\nout in the said Government Resolution and therefore, the same cannot<br \/>\nbe considered for denying appointment on compassionate ground.<br \/>\nMoreover, in earlier cases, at page 41, in all, 12 persons have been<br \/>\nconsidered and ultimately, offer has been made for compassionate<br \/>\nappointment, without even considering income criteria.\n<\/p>\n<p id=\"p_5\">4.0\tIn<br \/>\nview of aforesaid background, respondents are directed to examine and<br \/>\nreconsider case of petitioner for compassionate appointment according<br \/>\nto Government Resolution dated<br \/>\n29th March 2007,<br \/>\nwherein, income ceiling or criteria is not made applicable and<br \/>\nwithout taking into account such income or amount, which has been<br \/>\nreceived by family of petitioner, decide the case of petitioner in<br \/>\naccordance with aforesaid Government Resolution dated 29th<br \/>\nMarch 2007 within three months from the date of receiving copy of<br \/>\nthis order and communicate the decision thereof, to the petitioner<br \/>\nimmediately.\n<\/p>\n<p id=\"p_6\">4.1\tIt<br \/>\nis made clear that, if there is no income criteria is specified in<br \/>\nGovernment Resolution dated 29th March 2007, then,<br \/>\nquestion of considering income or amount, which has been received by<br \/>\nfamily of petitioner does not arise.&#8221;\n<\/p>\n<p id=\"p_7\">4.0\tThe<br \/>\nrespondent has examined application made by petitioner and rejected<br \/>\nin by order dated 20th August, 2009 wherein respondent has<br \/>\nconsidered both policy dated 10th March, 2000 and 29th<br \/>\nMarch, 2007 and also considered the income criteria as well as<br \/>\nceiling income while rejecting such application. The respondent has<br \/>\nalso considered that family of present petitioner is not in pitiable<br \/>\ncondition, however, the respondent authorities have not considered<br \/>\nother relevant aspects. Therefore, it is directed to respondent to<br \/>\nreconsider aforesaid decision dated 20th August, 2009<br \/>\n[Annexure C, Page 30] and examine the issue whether in Circular dated<br \/>\n29th March, 2007 any income criteria or ceiling has been<br \/>\nspecified or whether it has been specified to consider the financial<br \/>\nstatus of the family of the petitioner for deciding application or<br \/>\nwhether family of the petitioner is in pitiable condition or not. Let<br \/>\nthese aspects may be reexamined as per policy which was prevailing at<br \/>\nthe relevant time when the father of the petitioner expired, within a<br \/>\nperiod of three months from the date of receiving copy of the present<br \/>\norder and take appropriate decision and communicate it immediately to<br \/>\nthe petitioner.\n<\/p>\n<p id=\"p_8\">5.0\tIn<br \/>\nview of the above observations and directions, present petition is<br \/>\ndisposed of by this Court without expressing any opinion on merits.<br \/>\nHowever, in the case if ultimate decision is adverse to the<br \/>\npetitioner, it is open for the petitioner to challenge the same<br \/>\nbefore appropriate forum in accordance with law.
