OF LILABEN PATUBHA - Petitioner\n \n\nVersus\n \n\nMAHENDRASINH\nRATANSINH SANGOI &amp; 3 - Respondents\n \n\n=========================================================\nAppearance : \nMR\nCB UPADHYAYA for\nPetitioner \nNone for Respondents : 1 -\n4. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/10\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">This matter was called out twice.\n<\/p>\n<p id=\"p_1\">\tOn both the occasions, none had remained present for the petitioner.\n<\/p>\n<p id=\"p_2\">The petitioner has filed this<br \/>\n\tpetition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India for the<br \/>\n\tfollowing prayers :\n<\/p>\n<p id=\"p_3\">&#8220;(A)\tBe<br \/>\npleased to admit and allow the petition;\n<\/p>\n<p id=\"p_4\">(B)<br \/>\nBe pleased to quashed and set aside the order dated 06\/04\/2011 passed<br \/>\nby Special Secretary in the appeal being no MVV\/Kutch\/Inam\/01\/2010<br \/>\nvide an order dated 06\/04\/2011 as well as order dated 18\/01\/2011<br \/>\npassed by Mamlatdar (Inam Abolition) Bhuj-Katch.\n<\/p>\n<p id=\"p_5\">May<br \/>\n\tbe pleased to declare that the respondent No. 1 is not a tenant and<br \/>\n\tdoes not acquire any tenancy rights in accordance with Section 3<br \/>\n\t(14) of Bombay Land Revenue Code as well as entry No. 122.\n<\/p>\n<p id=\"p_6\">(D)<br \/>\n\tBe pleased to call for the record and proceedings in connection with<br \/>\n\tthe case being No. 203\/2009 before the Special Mamlatdar (Innam<br \/>\n\tAbolition), Bhuj.\n<\/p>\n<p id=\"p_7\">(E)<br \/>\n\tBe pleased to pass any such or further order\/s as it may deemed fit<br \/>\n\tby the Hon&#8217;ble Court.&#8221;\n<\/p>\n<p id=\"p_8\">\tThus,<br \/>\nthe petition is essentially against the order dated 6.4.2011 passed<br \/>\nby respondent no. 4 vacating the earlier stay order granted in the<br \/>\nRevision Application filed by petitioner being Revision Application<br \/>\nNo. Kutch\/Inam\/1\/ 2010.\n<\/p>\n<p id=\"p_9\">The facts, as could be culled out<br \/>\n\tfrom the memo of petition deserve to be set out as under:\n<\/p>\n<p id=\"p_10\">    It appears that the petitioner is<br \/>\n\ta legal heir of the widow of Late Shri Jadeja Pathubha Hakaji. The<br \/>\n\tland bearing Survey No. 422 situated at village : Deshalpar (Kanthi)<br \/>\n\twas under the possession of the ancestral of the petitioner since<br \/>\n\tvery long and name of mother of petitioner was displayed in the<br \/>\n\trevenue record.  Vide Entry No. 122 made in Hakk Patra, Form No.6,<br \/>\n\tname of Late Shri Dhanji Jesang came to be entered by way of Giro<br \/>\n\tRights vested by Lilaba in the aforesaid land bearing Survey No. 422<br \/>\n\tsituated at Mauje Deshalpar (Kanthi), Taluka: Mundra, Dist.: Kutch.<br \/>\n\tThe application came to be made by respondent no. 1 for cancellation<br \/>\n\tof the entry made under the provisions of Innam Ordinance and said<br \/>\n\tApplication came to be decided in favour of the applicant i.e.<br \/>\n\trespondent no. 1 by an order dated 18.10.2010 without giving any<br \/>\n\topportunity to the petitioner. The petitioner preferred an Appeal<br \/>\n\tagainst the said order before the Special Secretary seeking<br \/>\n\tquashment and setting aside the judgment and order dated 18.10.2010.<br \/>\n\tOn presentation of the application, the stay was granted vide order<br \/>\n\tdated 2.11.2010 and it was continued till further hearing took place<br \/>\n\tand ultimately on 2.11.2010 it was not extended vide impugned order.<br \/>\n\tHence, present petition.\n<\/p>\n<p id=\"p_11\">The order impugned in this<br \/>\n\tpetition contained specific reasons, which did not be delve into at<br \/>\n\tthis stage, as it would affect the adjudication in the main matter.<br \/>\n\tHowever, as the petition is filed, prima-facie there appears to be<br \/>\n\tjustification in not continuing the interim relief in the matter.<br \/>\n\tThe authority while recording the submissions made on behalf of<br \/>\n\topponent, has mentioned in the order that the very application is<br \/>\n\tnot maintainable as the authority does not have prima-facie<br \/>\n\tjurisdiction to entertain the application. No title or document for<br \/>\n\ttitle are produced. The entry No. 122 is of the promulgation of 1960<br \/>\n\tand is in possession of the opponent. The applicant is not residing<br \/>\n\tat Kutch. He is trading in Bhavnagar. Delay and latches are there.<br \/>\n\tIt is also mentioned in the order that the applicant of the<br \/>\n\tapplication had applied under Section 2(10) and 7(6) for ending the<br \/>\n\tmortgage and vide order dated 29.6.2010 there is an order of<br \/>\n\tstatus-quo and nothing is clear after passing of period of 30 years.\n<\/p>\n<p id=\"p_12\">All these issues in my view, need<br \/>\n\tnot be adjudicated at this stage under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the<br \/>\n\tConstitution of India, though, petition is styled to be filed under<br \/>\n\t<a href=\"\/doc\/1712542\/\" id=\"a_2\">Article 226<\/a> of the Constitution of India. The matter being bereft of<br \/>\n\tmerits, deserves rejection and is rejected accordingly. The<br \/>\n\tobservations made in this order is entirely for considering as to<br \/>\n\twhether the extra ordinary jurisdiction is invoked and it shall not<br \/>\n\thave any bearing in final disposal of main application.
