Respondent   is   the<\/p>\n<p>decree   holder.   For   realisation   of   decree   debt<\/p>\n<p>mortgaged property was sought to be sold. As per order<\/p>\n<p>in   E.A.209\/2003   dated   9\/1\/2004,   an     extent   of   25<\/p>\n<p>cents,   where   residential   building   of   petitioner   is<\/p>\n<p>situated,   was   excluded.   As   per   order   in   E.A.200\/05<\/p>\n<p>dated   20\/9\/2006        executing   court   permitted   decree<\/p>\n<p>holder   to  sell  57  cents  of  item  No.1  of  the  mortgaged<\/p>\n<p>property     excluding   4   feet   width   way.   Under   Ext.P4<\/p>\n<p>decree holder sought amendment of the sale paper which<\/p>\n<p>was   allowed   by   the   executing   court.   As   per   order   in<\/p>\n<p>Ext.P4     decree   holder   produced   draft   sale   papers   for<\/p>\n<p>57 cents  of property to be sold. When judgment debtor<\/p>\n<p>contended   that   property   cannot   be   identified,   as<\/p>\n<p>identification of the property is not correct,   Ext.P3<\/p>\n<p>application   was   filed   to   amend     draft   sale   papers.   It<\/p>\n<p>was   allowed   by   executing   court   as   per   order   dated<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       2<\/span><\/p>\n<p>4\/12\/2006. Property was thereafter directed to be sold.\n<\/p>\n<p id=\"p_1\">It   is   challenged   in   this   petition   filed   under   <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article<\/p>\n<p>227<\/a> of Constitution of India.\n<\/p>\n<p id=\"p_2\">      2.     Learned   counsel   appearing   for   petitioner   was<\/p>\n<p>heard.   Argument   of   learned   counsel   appearing   for<\/p>\n<p>petitioner is that if property as shown in the amended<\/p>\n<p>sale   paper   is   sold,   it   will   not   be   the   property   which<\/p>\n<p>is allowed to be sold as per order of the court, as the<\/p>\n<p>property is not properly described.\n<\/p>\n<p id=\"p_3\">      3.     On   going   through   amended   sale   paper   and<\/p>\n<p>hearing learned counsel appearing for petitioner, I do<\/p>\n<p>not   find   any   reason   for   such   apprehension.   Draft   sale<\/p>\n<p>paper makes it absolutely clear that property sought to<\/p>\n<p>be   sold   is   the   remaining   property   excluding   25   cents<\/p>\n<p>which was excluded as per order in E.A.209\/03. Argument<\/p>\n<p>of   learned   counsel   appearing   for   petitioner   is   that<\/p>\n<p>boundaries   are   not   properly   shown   in   Ext.P2.   Eastern<\/p>\n<p>property   shown   is   25   cents   in   the   possession   of<\/p>\n<p>petitioner,   which has been excluded. So also northern<\/p>\n<p>property is shown as residential house with 25 cents in<\/p>\n<p>the possession of judgment debtor Ext.P2 also establish<\/p>\n<p>that   4   feet   path   way     which   has   been   directed   to   be<\/p>\n<p>excluded   was   not   included   in   the   property   to   be   sold.\n<\/p>\n<p id=\"p_4\">In   such   circumstances,   I   do   not   find   any   reason   to<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                     3<\/span><\/p>\n<p>interfere   with   the   direction   to   sell   the   property,   in<\/p>\n<p>exercise   of   the   extra   ordinary   jurisdiction   of     this<\/p>\n<p>court under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of Constitution of India.\n<\/p>\n<p id=\"p_5\">       Writ petition is dismissed.\n<\/p>\n<p id=\"p_6\">                                          M.SASIDHARAN NAMBIAR,<\/p>\n<p>                                                        JUDGE.\n<\/p>\n<p id=\"p_7\">uj.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.J.
