No.28176 of 2011\n                           Lalan Prasad Singh son of late Kusheshwar Singh\n                                                  Versus\n                                          The State Of Bihar\n                                                -----------\n<\/pre>\n<p id=\"p_1\">2.   29.8.2011                Heard learned Counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p id=\"p_1\">                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under <a href=\"\/doc\/988620\/\" id=\"a_1\">Sections 406<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_1\">420<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_2\">120B<\/a> of the Indian Penal<\/p>\n<p>                 Code.\n<\/p>\n<p id=\"p_2\">                             Considering that the petitioner is in custody since<\/p>\n<p>                 6.7.2011 and the entire case is based on documentary<\/p>\n<p>                 evidence, which has already been collected, let the petitioner<\/p>\n<p>                 above named, be released on bail on furnishing bail bond of<\/p>\n<p>                 Rs. 5,000\/-(Five thousand) with two sureties of the like<\/p>\n<p>                 amount each or any other surety to be fixed by the court<\/p>\n<p>                 concerned to the satisfaction of learned Chief Judicial<\/p>\n<p>                 Magistrate, Vaishali at Hajipur in connection with Sarai P.S.<\/p>\n<p>                 Case No.99 of 2011, subject to the conditions (i) That one of<\/p>\n<p>                 the bailor shall be Parash Nath Singh, elder brother of the<\/p>\n<p>                 petitioner and the other bailor will be a close relative of the<\/p>\n<p>                 petitioner who will give an affidavit giving genealogy as to how<\/p>\n<p>                 he is related with the petitioner. The bailor will undertake to<\/p>\n<p>                 furnish information to the Court about any change in address<\/p>\n<p>                 of the petitioner. (ii) That the affidavit shall clearly state that<\/p>\n<p>                 the petitioner is not an accused in any other case and if he is<\/p>\n<p>                 he shall not be released on bail, (iii) That the bailor shall also<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    -2-<\/span><\/p>\n<p>            state on affidavit that he will inform the court concerned if the<\/p>\n<p>            petitioner is implicated in any other case of similar nature after<\/p>\n<p>            his release in the present case and thereafter the court below<\/p>\n<p>            will be at liberty to initiate the proceeding for cancellation of<\/p>\n<p>            bail on ground of misuse, (iv) That the petitioner will give an<\/p>\n<p>            undertaking that he will receive the police papers on the given<\/p>\n<p>            date and be present on date fixed for charge and if he fails to<\/p>\n<p>            do so on two given dates and delays the trial in any manner,<\/p>\n<p>            his bail will be liable to be cancelled for reasons of misuse, (v)<\/p>\n<p>            That the petitioner will be well represented on each date if he<\/p>\n<p>            fails to do so on two consecutive dates, his bail will be liable to<\/p>\n<p>            be cancelled.\n<\/p>\n<p id=\"p_3\">\n<pre id=\"pre_1\">Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Lalan Prasad Singh vs The State Of Bihar on 29 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
