Special Civil Application No.7262<br \/>\nof 2011 is filed by the workman, whereas Special Civil Application<br \/>\nNo.10055 of 2011 is filed by the Management.\n<\/p>\n<p id=\"p_1\">2.\tThe<br \/>\nlearned Judge was pleased to partly allow the Reference and held the<br \/>\nretrenchment of the workman as illegal and was pleased to order<br \/>\npayment of Rs.1,50,000\/- in lieu of reinstatement and backwages.\n<\/p>\n<p id=\"p_2\">3.\tThe<br \/>\nworkman has challenged this award on the ground that the amount<br \/>\nawarded is less, whereas the Management has challenged this award on<br \/>\nthe ground that though there was suppression of the material fact,<br \/>\nthe learned Judge has not taken into consideration the same and has<br \/>\nallowed the award in the aforesaid terms.\n<\/p>\n<p id=\"p_3\">4.\tTaking<br \/>\ninto consideration the rival submissions, the Court finds  that no<br \/>\ncase is made out by either party to interfere with the  award and<br \/>\norder dated 17.5.2011 passed by the learned Judge of Labour Court<br \/>\nNo.1, Bharuch in Reference (LCB) No.367 of 1997.\n<\/p>\n<p id=\"p_4\">5.\tIn<br \/>\nthe result, both these petitions fail and the same are dismissed.\n<\/p>\n<p id=\"p_5\">\t\t\t\t\t\t(RAVI<br \/>\nR.
