Esrail\n                                             Versus\n                                     The State Of Bihar\n                                           -----------\n<\/pre>\n<p id=\"p_1\">2.   24.08.2011                 Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p id=\"p_1\">                                The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under Sections 302, 376(2\/34)<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Indian Penal<\/p>\n<p>                  Code<\/a>.\n<\/p>\n<p id=\"p_2\">                                The petitioner was refused bail by an order dated<\/p>\n<p>                  25.10.2010 passed in Cr. Misc. 23833 of 2010.<\/p>\n<p id=\"p_3\">                                The petitioner has been renewed on the ground<\/p>\n<p>                  that the charges have been framed and other co-accused<\/p>\n<p>                  persons similarly placed has been released on bail and the<\/p>\n<p>                  petitioner has fair antecedents.\n<\/p>\n<p id=\"p_4\">                               Considering the same, let the petitioner above<\/p>\n<p>                  named, who is in custody since 7.2.2010, be released on bail<\/p>\n<p>                  on furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                  sureties of the like amount each or any other surety to be fixed<\/p>\n<p>                  by the court concerned to the satisfaction of Additional<\/p>\n<p>                  Sessions Judge II, Begusarai,        in connection with Cheria<\/p>\n<p>                  Bariarpur P.S. Case No. 7 of 2010 arising out of Sessions Trial<\/p>\n<p>                  No. 965 of 2010 subject to the following conditions: (i) That one<\/p>\n<p>                  of the bailors will be a close relative of the petitioner, who will<\/p>\n<p>                  give an affidavit giving genealogy as to how he is related with<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>        the petitioner. The bailor will undertake to furnish information to<\/p>\n<p>        the court about any change in the address of the petitioner. (ii)<\/p>\n<p>        That the affidavit shall clearly state that the petitioner is not an<\/p>\n<p>        accused in any other case and, if he is, he shall not be released<\/p>\n<p>        on bail. (iii) That the bailor shall also state on affidavit that he<\/p>\n<p>        will inform the court concerned if the petitioner is implicated in<\/p>\n<p>        any other case of similar nature after his release in the present<\/p>\n<p>        case and thereafter the court below will be at liberty to initiate<\/p>\n<p>        the proceeding for cancellation of bail on the ground of misuse.<\/p>\n<p id=\"p_5\">        (iv)That the petitioner will be well represented on each date and<\/p>\n<p>        if he fails to do so on two consecutive dates, his bail will be<\/p>\n<p>        liable to be cancelled.\n<\/p>\n<p id=\"p_6\">                       If the Trial Court finds that any of the accused<\/p>\n<p>        persons are      tampering    with   the   prosecution   evidence,<\/p>\n<p>        immediate step shall be taken for cancellation of their bail<\/p>\n<p>                                          ( Anjana Prakash, J.)<br \/>\nS.Ali\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
