Respondent<\/pre>\n<pre id=\"pre_1\">Coram:          Hon'ble Mr. Justice Rajesh Bindal\n\n\nPresent:        Mr. Adarsh Jain, Advocate, for the appellants.\n\n\nRajesh Bindal J.\n\n<\/pre>\n<p id=\"p_1\">                The plaintiffs are in appeal before this court against the<br \/>\nconcurrent finding of fact by both the courts below whereby suit filed by<br \/>\nthem for declaration to the effect that they are owner in possession of the<br \/>\nland measuring 5 bighas 18 biswas was dismissed. Further challenge in the<br \/>\nsuit was to the judgment and decree of the civil court dated 10.10.1995<br \/>\nsuffered by the parties to the present appeal on the basis of oral exchange.\n<\/p>\n<p id=\"p_1\">                Briefly the facts as noticed by the lower appellate court are as<br \/>\nunder:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                      &#8220;Plaintiffs Pal Mohinder Singh and Jaswinder Singh<br \/>\n                      have filed the suit before the learned trial court for<br \/>\n                      declaration as well as for permanent injunction, inter<br \/>\n                      alia, alleging that they were owners in possession of land<br \/>\n                      measuring 5 Bighas 18 Biswas, fully detailed and<br \/>\n                      described in the head note of the plaint, situated in the<br \/>\n                      area of Patti Jhutti, Bathinda. The parties to the suit are<br \/>\n                      related to each other and defendant, being an education<br \/>\n                      person, having remained in government service, has<br \/>\n                      influence upon the plaintiffs and the plaintiffs too were<br \/>\n                      having faith in him. It has been alleged that in the month<br \/>\n                      of March 1995, the defendants approached the plaintiffs<br \/>\n                      and requested them that since he was facing some<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> R. S. A. No. 1083 of 2006                                                   2<\/span><\/p>\n<p>                      enquiries   initiated   by   the   Vigilance   Department<br \/>\n                      regarding his assets, therefore, in order to reduce his<br \/>\n                      holdings located at Mandi Dabwali, the plaintiffs may<br \/>\n                      exchange their land located at Bathinda, with the land of<br \/>\n                      the defendants located at Dabwali and the defendant<br \/>\n                      agreed to pay a sum of Rs. 5 lacs along with his 20\/3779<br \/>\n                      share in land measuring 198 kanals 19 marlas comprised<br \/>\n                      in khewat no. 1475 khatauni no. 2326, situated within<br \/>\n                      the area of Nai Dabwali, Distt. Sirsa to the plaintiffs and<br \/>\n                      in view of that, he would receive 5 Bighas 18 Biswas of<br \/>\n                      land located at Bathinda. The said communication took<br \/>\n                      place in the presence of Ganda Singh (since deceased),<br \/>\n                      common relative of the parties and believing the said<br \/>\n                      representation made by the defendant, the plaintiffs<br \/>\n                      acceded to the request and they signed the papers as<br \/>\n                      desired by the defendant but they never put in their<br \/>\n                      appearance in the court at Dabwali nor they made any<br \/>\n                      statement in the said suit before the court because Baljit<br \/>\n                      Singh himself appeared in the court, filed his alleged<br \/>\n                      written statement dated 29.7.1995 admitting the claim of<br \/>\n                      the plaintiffs by getting his statement recorded on<br \/>\n                      29.7.1995 and the plaintiffs were never informed about<br \/>\n                      the passing of the aforesaid decree dated 10.10.1995.<br \/>\n                      According to the plaintiffs, in fact, no exchange ever<br \/>\n                      took place between the parties nor actual possession of<br \/>\n                      the lands were delivered nor amount of Rs. 5 lacs as<br \/>\n                      agreed was paid by the defendant to the plaintiffs and<br \/>\n                      therefore, the impugned decree is liable to be set aside<br \/>\n                      being bad in law, null and void and not binding on the<br \/>\n                      rights of the plaintiffs as the defendant has played a big<br \/>\n                      fraud with the plaintiffs and got mutation no. 34745<br \/>\n                      sanctioned in his favour regarding the suit land as there<br \/>\n                      was no reason or logic in giving 5 Bighas 18 Biswas of<br \/>\n                      land located at Bathinda by receiving only 20\/3779<br \/>\n                      shares in land measuring 188 kanals 19 marlas which<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> R. S. A. No. 1083 of 2006                                                     3<\/span><\/p>\n<p>                      comes to only one kanal. The suit land is more valuable<br \/>\n                      than the land located at Dabwali. The possession of the<br \/>\n                      respective properties were not exchanged and thus, the<br \/>\n                      decree has not been implemented and that the defendant<br \/>\n                      has not made the payment of Rs. 5 lacs as agreed to by<br \/>\n                      him and as such, according to the plaintiffs, the<br \/>\n                      impugned judgment and decree is null and void, against<br \/>\n                      law and facts and the same is liable to be set aside. As a<br \/>\n                      consequential    relief,     the   plaintiffs   have   sought<br \/>\n                      permanent injunction to restrain the defendant from<br \/>\n                      alienating the suit land.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">                Though the impugned decree was passed in a suit between the<br \/>\nparties on 10.10.1995. The present suit was filed on 12.10.1998, more than<br \/>\nthree years thereafter. Primary ground raised for challenging the decree was<br \/>\nthat there was no comparison in the exchange of land between the parties<br \/>\nand accordingly a fraud was committed. The value of lands exchanged by<br \/>\nthe parties was not comparable. Both the courts below found the ground to<br \/>\nbe untenable and dismissed the suit filed by the appellants.\n<\/p>\n<p id=\"p_3\">                Even before this court, learned counsel for the appellants<br \/>\nreferred to documents Ex. P-4 and P-5 in support of his argument that the<br \/>\nvalue of the land was not similar and the exchange was not possible and<br \/>\nfurther that as promised a sum of Rs. 5 lacs were not paid by the<br \/>\nrespondent\/defendant to complete the transaction of exchange. However,<br \/>\nthe contention raised by the learned counsel for the appellants is totally<br \/>\nmisconceived. It is a case where filing of earlier suit filed by the<br \/>\nappellants\/plaintiffs is admitted. It was further admitted by the<br \/>\nappellants\/plaintiffs that they had engaged a counsel and filed the suit and<br \/>\nalso got their statements recorded in that regard on the basis of which the<br \/>\nsuit was ultimately decreed. The claim set up in the earlier suit was<br \/>\nregarding exchange of property as per understanding between the parties.<br \/>\nEven from document Ex. D-3, it was found that respective possessions of<br \/>\nthe properties had also exchanged hands. Once these facts are admitted by<br \/>\nthe appellants\/plaintiffs, no question of challenge to the decree will arise<br \/>\nmore than three years thereafter after the possession thereof had also been<br \/>\nexchanged by the parties at the relevant time.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\"> R.
