SAVANT, JJ.\n<\/pre>\n<p id=\"p_1\">                                 DATE : 11th OCTOBER, 2011.\n<\/p>\n<p id=\"p_1\">      ORAL JUDGMENT (PER SHRI R.M.SAVANT J.) :-\n<\/p>\n<p id=\"p_2\">      1          By the above Petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<\/p>\n<p>      Constitution of India, the Petitioners inter alia seek directions against<\/p>\n<p>      the Respondents to the effect that they be directed to implement the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 17:49:52 :::<\/span><br \/>\n                                            2                       wp-657-2001<\/p>\n<p>    Town Planning Scheme of Bombay City I (Mandvi &amp; Elphinstone<\/p>\n<p>    Estate) as finalized and sanctioned by the Government of Maharashtra<\/p>\n<p>    in regard to final plot No.136 of Town Planning Scheme of Bombay<\/p>\n<p>    City I (Mandvi &amp; Elphinstone Estate). The Petitioners further seek a<\/p>\n<p>    relief that the Respondents be directed to hand over to the Petitioners<\/p>\n<p>    vacant and peaceful possession of final plot No.136 admeasuring<\/p>\n<p>    about 134.7 sq.yards free from all            encumbrances and pay<\/p>\n<p>    compensation amount of Rs.45,122\/- together with interest @ 18% p.a.<\/p>\n<p>    from the date of the award till realization within a specified period. The<\/p>\n<p>    Petitioners by prayer clause (bb) have sought quashing and setting<\/p>\n<p>    aside of the property tax bills issued by the Respondents in respect of<\/p>\n<p>    the property bearing Ward No.B-1393(1) and situated at 37-45, Kazi<\/p>\n<p>    Sayed Street, Masjid Bunder Road, Mumbai since 1-11-1975 till date.\n<\/p>\n<p id=\"p_3\">    As the prayers adverted to above discloses the issue as regards<\/p>\n<p>    implementation of the Town Planning Scheme in respect of the area in<\/p>\n<p>    question.\n<\/p>\n<p id=\"p_4\">    2           The draft scheme was published on 11-12-1948 under the<\/p>\n<p>    then Town Planning Act, by virtue of the powers conferred by the<\/p>\n<p>    Section 29 of the said Act. The then Government of Bombay under<\/p>\n<p>    Section 29 of Bombay Town Planning Act appointed an Arbitrator. The<\/p>\n<p>    Arbitrator Mr. G.J.Desai declared his Award on 31-3-1954 and<\/p>\n<p>    forwarded the proposals to the president of the Tribunal for further<\/p>\n<p>    action. In terms of the Award of the Arbitrator original plot No.153<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                        ::: Downloaded on &#8211; 09\/06\/2013 17:49:52 :::<\/span><br \/>\n                                               3                     wp-657-2001<\/p>\n<p>    admeasuring 197 sq.yds. was earmarked for road widening and in lieu<\/p>\n<p>    thereof the Petitioners were allotted the final plot No.136 admeasuring<\/p>\n<p>    134.7 sq.yds The Petitioners were also directed to be paid an amount<\/p>\n<p>    of Rs.45,122 as compensation. On the Bombay Town Planning Act<\/p>\n<p>    1954 coming into force the said final scheme promulgated under the<\/p>\n<p>    Town Planning Act, 1915 was adopted. Thereafter, the Maharashtra<\/p>\n<p>    Regional and Town Planning Act, 1966 was promulgated, by virtue of<\/p>\n<p>    Section 165 of the said Act, the actions \/ decisions taken under the old<\/p>\n<p>    Town Planning Act, 1954 were saved. The Petitioners were in<\/p>\n<p>    possession of the original plot No.153 admeasuring 197 sq.yds.\n<\/p>\n<p id=\"p_5\">    Towards enforcing the said Town Planning Scheme the Respondents<\/p>\n<p>    took possession of the structure standing thereon without allotting the<\/p>\n<p>    Final Plot No.136 which was awarded to the Petitioners by the<\/p>\n<p>    Arbitrator in his Award as also compensation amount.               Thereafter<\/p>\n<p>    certain facts transpired which in our view, are not directly germane to<\/p>\n<p>    the issue raised in the above Petition.\n<\/p>\n<p id=\"p_6\">               Suffice it to say, that the tenants of the structure on plot No.<\/p>\n<p>    153 had filed a suit against the Respondent Corporation. The said suit<\/p>\n<p>    came to be decreed in favour of the Respondent No.1 Corporation<\/p>\n<p>    thereby the status of the Respondent No.1 as owners of the property<\/p>\n<p>    came to be confirmed.\n<\/p>\n<p id=\"p_7\">    3          As indicated above, the main substantive relief sought in the<\/p>\n<p>    Petition as regards the allotment of final plot no.136 admeasuring 134.7<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 17:49:52 :::<\/span><br \/>\n                                            4                        wp-657-2001<\/p>\n<p>    sq.yds. which has been allotted to the Petitioners by virtue of the award<\/p>\n<p>    of the arbitrator in the course of implementing the Town Planning<\/p>\n<p>    Scheme in question, as also the payment of sum of Rs.45,122\/- as<\/p>\n<p>    compensation to the Petitioners. The allotment of the said final plot No.<\/p>\n<p>    136 has been inordinately delayed though the possession of plot No.<\/p>\n<p>    153 owned by the Petitioners has been taken by the Respondent No.1<\/p>\n<p>    as long back in the yar 1975. In so far as, the allotment of final plot No.<\/p>\n<p>    136 is concerned, the reasons why the same has yet not been allotted<\/p>\n<p>    to the Petitioners, has been mentioned in the Affidavit in reply filed on<\/p>\n<p>    behalf of the Respondent No.1 by Mr. Sanjay Sambare, Assistant<\/p>\n<p>    Engineer. The sum and substance of the reasons is that prior to the<\/p>\n<p>    allotment certain steps are required to be taken by the Respondent<\/p>\n<p>    No.1 Corporation which includes demarcation etc., This petition was<\/p>\n<p>    heard from time to time for final hearing. On an earlier occasion looking<\/p>\n<p>    to the delay in allotting final plot No.136 to the Petitioners we had<\/p>\n<p>    asked the Learned Senior Counsel appearing for the Respondent No.1<\/p>\n<p>    Corporation to fix a schedule or a time frame within which the final plot<\/p>\n<p>    No.136 could be allotted to the Petitioners. Pursuant to our directions,<\/p>\n<p>    the Learned Senior Counsel has tendered to us the letter dated<\/p>\n<p>    11-12-2011 of the Assistant Commissioner &#8216;B&#8217; Ward, in which letter, the<\/p>\n<p>    schedule \/ time frame within which the final plot No.136 could be<\/p>\n<p>    allotted to the Petitioners, has been mentioned. We reproduce the<\/p>\n<p>    schedule which has been mentioned in the said letter as under:\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 17:49:52 :::<\/span><\/p>\n<pre id=\"pre_1\">                                           5                       wp-657-2001\n\n                  \"(1)        Demarcation of plot affected viz\n<\/pre>\n<p id=\"p_8\">                  O.P.No.153 to 158 &amp; 229A F.P.No.136 to 138 for<\/p>\n<p>                  demarcation this office has already sent reminder<br \/>\n                  to City Survey office and further this office will<br \/>\n                  sought co-operation from Ex.Eng.(TP), Ex.Eng.\n<\/p>\n<p id=\"p_9\">                  (DP), Ex.Eng.(T &amp; C) etc.<br \/>\n                              Approximate time required for the<br \/>\n                  above work is 60 days.\n<\/p>\n<p id=\"p_10\">                  (2)         To issue necessary notices to the<\/p>\n<p>                  occupants of the buildings of the above plots and<br \/>\n                  to hear their grievances to scrutinize their<br \/>\n                  documents etc.<br \/>\n                              Approximate time required for the<br \/>\n                  above work is 90 days.\n<\/p>\n<p id=\"p_11\">                  (3)         To conduct the meeting with the 27<br \/>\n                  tenants of the affected buildings.\n<\/p>\n<p id=\"p_12\">                              Approximate time required for the<br \/>\n                  above work is 60 days.\n<\/p>\n<p id=\"p_13\">                             Due to Diwali &amp; X-Mas vacation this<br \/>\n                  office may not able to contact the residents of<br \/>\n                  building. Hence the time required to complete this<br \/>\n                  task is about Eight months.&#8221;\n<\/p>\n<p id=\"p_14\">                The said letter is taken on record and marked &#8216;X&#8217; for<\/p>\n<p>    identification.\n<\/p>\n<p id=\"p_15\">    4           Upon perusing the said letter, copy of which was handed<\/p>\n<p>    over to the learned Counsel for the Petitioners, the Learned Counsel<\/p>\n<p>    for the Petitioners Shri Murti fairly states that though the period of 8<\/p>\n<p>    months has been mentioned in the said letter dated 11-10-2011, the<\/p>\n<p>    Petitioners would not have any objection if this Court grants further<\/p>\n<p>    time to the Respondent No.1 for handing over the said plot No.136. In<\/p>\n<p>    view of the said statement made by the Learned counsel for the<\/p>\n<p>    Petitioners, in our view, considering that the Petitioners have already<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                                       ::: Downloaded on &#8211; 09\/06\/2013 17:49:52 :::<\/span><br \/>\n                                            6                       wp-657-2001<\/p>\n<p>    waited for more than 25 years for allotment of the said final plot No.<\/p>\n<p id=\"p_16\">    136. It would be just and proper to extend the time mentioned in the<\/p>\n<p>    said letter dated 11-10-2011 from 8 months to one year for handing<\/p>\n<p>    over the said plot as also the compensation of Rs.45,122 with interest<\/p>\n<p>    as per the Award. Accepting the said schedule mentioned in the letter<\/p>\n<p>    dated 11-10-2011, we hope and trust that the final plot No.136 would<\/p>\n<p>    be handed over to the Petitioners. We direct the Respondent No.1<\/p>\n<p>    Corporation to hand over possession of the final plot No.136 latest by<\/p>\n<p>    31-10-2012 as also the payment of companesation.\n<\/p>\n<p id=\"p_17\">    6          In so far as, prayer clause (bb) of the Petition is concerned ,<\/p>\n<p>    it is not possible for us to go into the said aspect in this Petition. We,<\/p>\n<p>    therefore, deem it appropriate to direct the Petitioners to make a<\/p>\n<p>    representation to the Corporation for refund of the property tax that the<\/p>\n<p>    Petitioners have paid from the year 1975 to 2001 when the petition was<\/p>\n<p>    filed, annexing the relevant documents in support of the said claim<\/p>\n<p>    including the decree of the Civil Court as also the tax receipts. On such<\/p>\n<p>    representation being received, the Respondent No.1 Corporation to<\/p>\n<p>    consider the same and pass appropriate order in accordance with law<\/p>\n<p>    as regards the refund claimed by the Petitioners of the property tax<\/p>\n<p>    paid by them from 1975 to 2001. In the event, some amount is to be<\/p>\n<p>    refunded, the same may be done expeditiously by the Respondent<\/p>\n<p>    No.1.<\/p>\n<pre id=\"pre_2\">\n\n    7          In so far as the amount of Rs.3,67,516 is concerned, for the\n\n\n\n\n<span class=\"hidden_text\" id=\"span_5\">                                                        ::: Downloaded on - 09\/06\/2013 17:49:52 :::<\/span>\n                                             7                       wp-657-2001\n\n<\/pre>\n<p id=\"p_18\">    period April 2001 to March 2012, i.e. post filing of the above Petition, in<\/p>\n<p>    the light of the aforesaid facts, the Corporation may not take steps to<\/p>\n<p>    recover the said amount.\n<\/p>\n<p id=\"p_19\">    8          Rule is accordingly made absolute to the aforesaid extent<\/p>\n<p>    with parties to bear their respective costs.\n<\/p>\n<pre id=\"pre_3\">    (R.M.Savant, J.)
