Circular dated 04.07.2008 is<br \/>\npatently bad and illegal and that it cannot be retrospectively<br \/>\napplied to the case of the petitioner and it may be declared as<br \/>\nultra-vires and further, it may be declared that the petitioner&#8217;s<br \/>\ncase cannot be decided on the basis of such a Notification and that<br \/>\nthe valuation of the land in question of the petitioner is required<br \/>\nto be fixed as on the date of the application;\n<\/p>\n<p id=\"p_5\">(B)\t\tYOUR LORDSHIPS may be<br \/>\npleased to issue a writ of mandamus and \/ or any other appropriate<br \/>\nwrit, order or direction directing the respondents not to apply the<br \/>\nGovt. Circular dated 04.07.2008 in the case of the petitioner and<br \/>\ndirect the Collector to decide the case of the petitioner as on the<br \/>\nbasis of the valuation as on the date of the application;\n<\/p>\n<p id=\"p_6\">(C)\t\t YOUR LORDSHIPS may be<br \/>\npleased to declare that Government Resolution dated 04.07.2008 giving<br \/>\nretrospective effect and also demanding premium at 80 % of the Jantri<br \/>\nValuation is bad, illegal, ultravires and violative of Articles 14,<br \/>\n21 and 300-A of the Constitution of India and the respondents be<br \/>\nrestrained by the writ of Mandamus or any other appropriate writ,<br \/>\norder or direction prohibiting the respondents from operating and<br \/>\napplying the same.\n<\/p>\n<p id=\"p_7\">(D)\t\tYOUR LORDSHIPS may be<br \/>\npleased to grant such other and further reliefs as the Hon&#8217;ble Court<br \/>\nmay deem fit in the facts and circumstances of the case.&#8221;\n<\/p>\n<p id=\"p_8\">4.\t\tIn<br \/>\nSpecial Civil Application No.3665 of 2009 the petitioner has sought<br \/>\nfollowing reliefs.\n<\/p>\n<p id=\"p_9\">&#8220;(a)\t\tYOUR LORDSHIPS may<br \/>\nbe pleased to declare that the valuation made by the District Land<br \/>\nValuation Committee &#8211; respondent No.4 in its report dated<br \/>\n31\/08\/2007 is patently bad and illegal, arbitrary, totally<br \/>\nexaggerated and that on the basis of the said valuation report, the<br \/>\npetitioner cannot be made to pay the premium amount and the said<br \/>\nreport may be quashed and set aside and the valuation be fixed by<br \/>\nthis Hon&#8217;ble Court on the basis of the Jantri and the documents<br \/>\nproduced by the petitioner in the petition independently of the said<br \/>\nreport and by applying the principles analogous to which are applied<br \/>\nunder the <a href=\"\/doc\/7832\/\" id=\"a_1\">Land Acquisition Act<\/a> for fixing the valuation.\n<\/p>\n<p id=\"p_10\">(b)\t\tYOUR LORDSHIPS may be<br \/>\npleased to issue a writ of mandamus and \/ or any other appropriate<br \/>\nwrit, order or direction directing the respondent authorities to<br \/>\ntreat the applications filed by the petitioner as one under Section<br \/>\n65 of the Bombay Land Revenue Code and YOUR LORDSHIPS may be further<br \/>\npleased to direct the respondents to consider and process the said<br \/>\napplications in accordance with the provisions of the Bombay Land<br \/>\nRevenue Code, 1897;\n<\/p>\n<p id=\"p_11\">(c)\t\tIn the alternative, YOUR<br \/>\nLORDSHIPS may be pleased to fix the market value and the premium, if<br \/>\nany, payable by adopting the principle analogy to the <a href=\"\/doc\/7832\/\" id=\"a_1\">Land<br \/>\nAcquisition Act<\/a> in fixing the market value and with reference to<br \/>\nJantri produced and the evidence of various instances produced by the<br \/>\npetitioner in this matter and grant N.A. Permission on the said<br \/>\nposts.\n<\/p>\n<p id=\"p_12\">(d)\t\tPending admission and<br \/>\nfinal hearing of this petition, YOUR LORDSHIPS may be pleased to<br \/>\ndirect the respondent authorities to forthwith grant N.A. Permission<br \/>\non such conditions as though fit by this Hon&#8217;ble Court;\n<\/p>\n<p id=\"p_13\">(e)\t\tYOUR LORDSHIPS may be<br \/>\npleased to grant such other and further reliefs as the Hon&#8217;ble Court<br \/>\nmay deem fit in the facts and circumstances of the case.&#8221;\n<\/p>\n<p id=\"p_14\">5.\t\tHaving<br \/>\nheard the learned Advocates appearing for the respective parties and<br \/>\non the peculiar facts and circumstances of the case, following order<br \/>\nis passed.\n<\/p>\n<p id=\"p_15\">5.1\t\tThe<br \/>\npetitioners will approach the Collector, Surat within a period of<br \/>\nfour weeks from today with an application stating that the<br \/>\npetitioners are ready to pay the amount of premium on the basis of<br \/>\nGovernment Notification dated 04\/07\/2008.\n<\/p>\n<p id=\"p_16\">5.2\t\tIf<br \/>\nsuch an application is received by the Collector, Surat the Collector<br \/>\nwill decide the said application within a period of four weeks from<br \/>\nthe date of receipt of the application and the outcome thereof will<br \/>\nbe communicated to the petitioners in respect of NA permission<br \/>\npursuant to the Government Notification dated 04\/07\/2008.\n<\/p>\n<p id=\"p_17\">5.3\t\tIf<br \/>\nall conditions which are referred to in the Government Notification<br \/>\ndated 04\/07\/2008 are fulfilled and the payment is made by the<br \/>\npetitioners, the Collector will pass an order granting N.A. use<br \/>\npermission immediately on receipt of the premium.\n<\/p>\n<p id=\"p_18\">5.4\t\tThe<br \/>\npetitioner will make an application for N.A.<br \/>\nuse permission on the basis of final plot allotted to petitioners<br \/>\nunder the Town Planning Act.  It is further clarified that the<br \/>\nCollector will also inform the Town Planner that FSI should be<br \/>\ncalculated on the basis of final plot and as and when the application<br \/>\ncomes for further FSI, the Town Planner  shall forward the matter to<br \/>\nthe Collector for NA use for which FSI to be decided. The petitioner<br \/>\nwill request the Collector to calculate the FSI only on the basis of<br \/>\nfinal plot and the application will be forwarded to the Town Planning<br \/>\nOfficer.\n<\/p>\n<p id=\"p_19\">6.\t\tWith<br \/>\nthe aforesaid directions, present petitions stand disposed of.
