Dabhi, learned APP wavies service of notice of Rule on behalf<br \/>\nof the respondent-State.\n<\/p>\n<p id=\"p_2\">\tThe<br \/>\napplicant prays for regular bail in connection with the offences<br \/>\nregistered with Palsana Police Station, District: Surat vide<br \/>\nC.R.No.I-33 of 2011 for the offences punishable under Sections 379,<br \/>\n467, 468, 471, 120(B) read with 114<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Indian Penal Code<\/a> and<br \/>\n<a href=\"\/doc\/480302\/\" id=\"a_1\">Sections 26(1)(f)<\/a>, <a href=\"\/doc\/931043\/\" id=\"a_2\">41(1)(b)<\/a>, <a href=\"\/doc\/81271\/\" id=\"a_3\">52(1)<\/a> and <a href=\"\/doc\/516547\/\" id=\"a_4\">61(a)(1)<\/a> of the Indian Forest<br \/>\nAct.\n<\/p>\n<p id=\"p_3\">\tI<br \/>\nhave heard learned advocate Mr. H.B. Champavat for the applicant and<br \/>\nMr.L.B. Dabhi, learned APP for the respondent-State.\n<\/p>\n<p id=\"p_4\">\tIn<br \/>\nthe facts and circumstances of the case, I am persuaded to exercise<br \/>\nmy discretion in favour of the accused -applicant taking into<br \/>\nconsideration the following aspects:-\n<\/p>\n<p id=\"p_5\">\t(i)\tAll<br \/>\noffences are triable by the Magistrate<\/p>\n<p id=\"p_6\">\t(ii)\tInvestigation<br \/>\nis practically over<\/p>\n<p id=\"p_7\">\t(iii)\tThe<br \/>\nconsignment of the wooden logs as well as vehicle has \t\tbeen seized<br \/>\nand has been in the custody of the concerned \t\tPolice Station  <\/p>\n<p id=\"p_8\">\t(iv)\tThere<br \/>\nare no past antecedents  or criminal history of the<br \/>\n\t\taccused-applicant <\/p>\n<p>\tTaking<br \/>\ninto consideration the aforesaid prima facie aspects, I order release<br \/>\nof the accused &#8211; applicant on regular bail in connection with<br \/>\noffence registered with Palsana Police Station, District: Surat being<br \/>\nC.R.No.I-33 of 2011 on his executing a bond in the sum of Rs.20,000\/-<br \/>\n(Rupees twenty thousand only) with one solvent surety of the like<br \/>\namount to the satisfaction of the Lower Court and subject to the<br \/>\nconditions that he shall,<\/p>\n<p id=\"p_9\">\t(a)\tnot<br \/>\ntake undue advantage of or misuse liberty;\n<\/p>\n<p id=\"p_10\">\t(b)\tmaintain<br \/>\nlaw and order and should co-operate with the  \t\tInvestigating<br \/>\nOfficer;\n<\/p>\n<p id=\"p_11\">(c)<br \/>\n \tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_12\">(d)\tsurrender<br \/>\nhis passport, if any, to the Lower Court within a week;\n<\/p>\n<p id=\"p_13\">(e)\tshall<br \/>\nmark his presence before the concerned Police Station twice in a<br \/>\nmonth of every 2nd<br \/>\nand 4th<br \/>\nSunday between 10:00 A.M. and 5:00 P.M. till the filing of<br \/>\nchargeshseet.\n<\/p>\n<p id=\"p_14\">(f)\tnot<br \/>\nleave the local limits of the State of Gujarat without prior<br \/>\npermission of the Sessions Judge concerned;\n<\/p>\n<p id=\"p_15\">(g)\tfurnish<br \/>\nthe address of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt.\n<\/p>\n<p id=\"p_16\">(h)\tnot<br \/>\nenter the Surat City till the filing of chargesheet.\n<\/p>\n<p id=\"p_17\">\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_18\">\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_19\">\tBail<br \/>\nbond to be executed before the Lower Court having jurisdiction to try<br \/>\nthe case. This application is allowed.\n<\/p>\n<p id=\"p_20\">\tRule<br \/>\nis made absolute.
