Justice ANTONY DOMINIC\n\n Dated :12\/03\/2008\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n                         ===============\n\n                    W.P.(C) NO. 33241 OF 2007 G\n\n                    ====================\n\n\n              Dated this the 12th day of March, 2008\n\n\n                               J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The   challenge   in   this   writ   petition   is   against   the<\/p>\n<p>Securitisation proceedings initiated by the Bank.<\/p>\n<p id=\"p_1\">      2.     It   is   stated   that   benefit   of   One   Time   Settlement<\/p>\n<p>Scheme was applied for by the petitioners and that was granted,<\/p>\n<p>but however, as the petitioners did not make payment of the full<\/p>\n<p>amount   in   terms   of   the   scheme,   the   benefit   was   recalled.<\/p>\n<p>Thereupon   the   Bank   proceeded   with   the   Securitisation<\/p>\n<p>proceedings and possession of the mortgaged property was also<\/p>\n<p>taken  over.    It   is  at   that   stage  this   writ  petition  has   been  filed<\/p>\n<p>mainly contending that in the matter of extending the benefit of<\/p>\n<p>One Time Settlement Scheme, the Bank has violated the terms of<\/p>\n<p>Ext.P13 guidelines on OTS scheme issued by the Reserve Bank of<\/p>\n<p>India.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">      3.     This   contention   of   the   petitioners   is   answered  by   the<\/p>\n<p>WPC 33241\/07<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       :2 :<\/span><\/p>\n<p>respondent   stating   that   the   benefit   that   was   extended   to   the<\/p>\n<p>petitioners   is   not   in   terms   of   Ext.P13.   The   correctness   of   the<\/p>\n<p>contention   so   raised   by   the   Bank   is   evident   from   the   terms   of<\/p>\n<p>Ext.P13 itself.   A reading of Ext.P13 shows that the last date for<\/p>\n<p>receipt of application in terms of Ext.P13 was specified as 31st of<\/p>\n<p>March, 2006.  Admittedly, in this case the benefit applied for and<\/p>\n<p>granted was in 2007.   If that be so, the benefit that is extended<\/p>\n<p>is   not   the   one   that   is   provided   for   in   Ext.P13   and   that   the<\/p>\n<p>conditions   of   the   OTS   that   were   extended.     Therefore,   there   is<\/p>\n<p>nothing wrong with the action of the Bank in fixing the terms of<\/p>\n<p>the OTS.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">      4.     Though   there   is   nothing   on   the   merits   of   the<\/p>\n<p>contentions   raised,   it   is   now   pointed   out   that   since   coercive<\/p>\n<p>action has been initiated against the property mortgaged by the<\/p>\n<p>petitioners,   if   the   petitioners   are   desirous   of   liquidating   the<\/p>\n<p>liability by paying the instalments, the petitioners may do so.  In<\/p>\n<p>order  to  enable  the petitioners  to  clear  the amount  as  above,  I<\/p>\n<p>feel the petitioners should be granted an instalment facility.<\/p>\n<p id=\"p_6\">      5.     Accordingly, I direct that the petitioners shall clear the<\/p>\n<p>WPC 33241\/07<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       :3 :<\/span><\/p>\n<p>amount that is due to the Bank in five equal monthly instalments,<\/p>\n<p>first of which will be payable in the first week of April, 2008 and<\/p>\n<p>the   subsequent   instalments   will   be   payable   in   the   first   week   of<\/p>\n<p>every succeeding month.
