Petitioner was enrolled in NAVY as sailor on<br \/>\n8.8.1994 and put on training. After 20 days or so he<br \/>\nwas discharged by order dated 29.8.1994 under Navy<br \/>\nRegulations 278. He challenges this on the ground that<br \/>\nthe order was founded on his misconduct, was penal in<br \/>\nnature, cast stigma on him and was violative of<br \/>\nprinciples of natural justice as now show cause notice<br \/>\nwas issued to him. He also claims that he was not<br \/>\ndischarged by the Captain of Training establishment and<br \/>\nrelies upon several Supreme Court judgments to suggest<br \/>\nthat he was entitled to show cause notice and prays for<br \/>\nquashing of this order.\n<\/p>\n<p id=\"p_2\">2. Respondents stand is that he was found<br \/>\nunsuitable by the Captain of the training<br \/>\nestablishment, INS Chilka during his training after he<br \/>\nhad failed to qualify the entry behavior test in which<br \/>\nhe had obtained only 34% marks against the prescribed<br \/>\nrequisite standard of 50% marks. The discharge order<br \/>\nwas based on his weakness in academics and poor<br \/>\nperformance in basic training course and not on his<br \/>\nmisconduct or illness. It is explained he and 13 other<br \/>\ntrainees were found untrainable for Naval Service and<br \/>\nwere interviewed by the Commanding Officer who had<br \/>\nfound them unable to cope with the pace of training.<br \/>\nOn this, petitioner&#8217;s discharge order was approved by<br \/>\nthe Captain, Training establishment.\n<\/p>\n<p id=\"p_3\">3. All that falls for consideration is whether<br \/>\npetitioner was required to be given any show cause<br \/>\nnotice before passing of order of discharge. The<br \/>\nrelevant provision of Regulation 278 reads thus:-\n<\/p>\n<p id=\"p_4\"> &#8221; REGULATION 278  <\/p>\n<p> (4) Any Boy, Artificer Apprentice or Men, during<br \/>\nprobationary service, shall be liable to be discharged<br \/>\nas &#8220;Unsuitable&#8221; under orders of the authorities herein<br \/>\nstated, if his progress or conduct is unsatisfactory.&#8221;\n<\/p>\n<p id=\"p_5\">(c) Direct Entry Sailors&#8211;by the Captain of the<br \/>\nTraining Establishment concerned during the period of<br \/>\ntraining and thereafter by the Captain Naval Barracks.\n<\/p>\n<p id=\"p_6\">4. The Regulation authorises the Captain of<br \/>\nTraining establishment to discharge a trainee sailor as<br \/>\nunsuitable if his progress or conduct is found<br \/>\nunsatisfactory. Given regard to the stand of<br \/>\nrespondents that petitioner had failed to make grade in<br \/>\nthe entry behaviors test and was found week in<br \/>\nacademics and training progress and was interviewed by<br \/>\nthe Commanding Officer for this, his order of discharge<br \/>\ncannot be said to have been passed on misconduct. On<br \/>\nthe contrary, it was apparently passed on his<br \/>\nunsatisfactory progress in the training.\n<\/p>\n<p id=\"p_7\">5. It would be over-stretching the principles of<br \/>\nnatural justice to hold that petitioner was entitled to<br \/>\nany show cause notice before his discharge. The<br \/>\nrelevant regulation empowers the Captain to assess his<br \/>\nperformance in the training and if he is found wanting<br \/>\nor untrainable for the Navy, he cannot insist on his<br \/>\ncontinuation despite his bad or poor performance. Nor<br \/>\ndoes it fall within the domain of the court to<br \/>\ninterfere in such assessment and evaluation. The<br \/>\nrequirements of Navy areal together different from any<br \/>\nother service and if a trainee Sailor fails to meet<br \/>\nthese, he cannot seek retention on the specious plea of<br \/>\nviolation of principle of natural justice, any analogy<br \/>\ndrawn from same rule position in civil service. We<br \/>\nhave gone through the judgments cited by L\/C for<br \/>\npetitioner but we do not find any one of these relevant<br \/>\non the point. As a matter of fact petitioner seems to<br \/>\nbe misdirecting his case by assuming that he was<br \/>\ndischarged on some misconduct ignoring that he had<br \/>\nfailed to come up to the mark in the training.\n<\/p>\n<p id=\"p_8\">This petition accordingly fails and is dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Delhi High Court Ex\/Mer Kamal Singh vs Union Of India (Uoi) And Ors. on 13 September, 2002 Author: Khan Bench: B Khan, J Kapoor JUDGMENT Khan, J. 1.
