Justice M.SASIDHARAN NAMBIAR\n\n Dated :07\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n            CRL.M.C.No.2985       OF 2009\n            ===========================\n\n      Dated this the 7th day of October,2009\n\n                        ORDER\n<\/pre>\n<p id=\"p_1\">    This petition is filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">section 482<\/a> of Code<\/p>\n<p>of Criminal Procedure to quash Annexure 2 order passed<\/p>\n<p>by the Sessions Court, Kozhikode in Crl.R.P.41\/2008<\/p>\n<p>dismissing the revision confirming Annexure 1 order<\/p>\n<p>passed  by  the  Judicial  First  Class  Magistrate-IV,<\/p>\n<p>Kozhikode  dismissing   the  petition  filed   by   the<\/p>\n<p>petitioner to condone the delay of 30 days in filing<\/p>\n<p>the complaint alleging offence under <a href=\"\/doc\/1823824\/\" id=\"a_1\">section 138<\/a> of<\/p>\n<p>Negotiable Instruments Act.\n<\/p>\n<p id=\"p_1\">    2.   Learned counsel appearing for the petitioner<\/p>\n<p>was heard.\n<\/p>\n<p id=\"p_2\">    3.   The argument of the learned counsel appearing<\/p>\n<p>for the petitioner    is   that the delay was only 30<\/p>\n<p>days and the    courts    below     should not    have<\/p>\n<p>taken     a     technical     ground     to     dismiss<\/p>\n<p>the petition when petitioner has specifically stated<\/p>\n<p>that the delay was not wilful and in such circumstance,<\/p>\n<p>considering the fact that the delay is only 30 days, it<\/p>\n<p>is to be condoned.\n<\/p>\n<p id=\"p_3\"><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.2985\/2009               2<\/span><\/p>\n<p id=\"p_4\">      4.      On  hearing  the  learned  counsel, I   find  no<\/p>\n<p>illegality or irregularity in the order passed by the<\/p>\n<p>learned Magistrate or the learned Sessions Judge.          The<\/p>\n<p>question is not whether the delay was caused         wilfully.<\/p>\n<p>Instead the      question is whether there is sufficient cause<\/p>\n<p>for   condoning    the  delay,  as  the  complaint    alleging<\/p>\n<p>commission of an     offence under <a href=\"\/doc\/1823824\/\" id=\"a_2\">section 138<\/a> of N.I. Act was<\/p>\n<p>not filed within the time.      On facts courts below rightly<\/p>\n<p>found that petitioner is not entitled to get the delay<\/p>\n<p>condoned.       As per the medical certificate petitioner had<\/p>\n<p>gone to see the doctor only on 6.10.2006. From the date of<\/p>\n<p>failure to pay the amount within fifteen days of receipt of<\/p>\n<p>notice sent under <a href=\"\/doc\/1240817\/\" id=\"a_3\">section 138(b)<\/a> of Negotiable Instruments<\/p>\n<p>Act, the complaint should have been filed on 3.10.2006.<\/p>\n<p>Even after reaching      back from the hospital on 12.10.2006,<\/p>\n<p>complaint was filed only on 17.10.2006.      When there is no<\/p>\n<p>explanation for the said delay, the petition can only be<\/p>\n<p>dismissed.
