Justice K.HEMA\n\n Dated :23\/10\/2008\n\n O R D E R\n                              K.HEMA, J.\n                 -------------------------------------------------\n                          B.A.No.6434 of 2008\n                 -------------------------------------------------\n             Dated this the 23rd day of October, 2008\n\n\n\n                                 O R D E R\n<\/pre>\n<p id=\"p_1\">      This petition is for bail.\n<\/p>\n<p id=\"p_1\">      2.   The alleged offence is under <a href=\"\/doc\/653797\/\" id=\"a_1\">Section 304B<\/a> IPC.<\/p>\n<p>According to prosecution, the wife of the petitioner committed<\/p>\n<p>suicide on 22.9.2008 and he was arrested on 23.9.2008 on the<\/p>\n<p>allegation that there was ill treatment on demanding dowry.<\/p>\n<p>That was the cause for the suicide etc.<\/p>\n<p id=\"p_2\">      3.   Learned counsel for the petitioner submitted that the<\/p>\n<p>petitioner is a teacher in an aided school. A female child was<\/p>\n<p>born in the wedlock, who is aged only three years now, and he<\/p>\n<p>has to look after the child. The petitioner has been in custody for<\/p>\n<p>the past 30 days. He is prepared to abide by any condition, it is<\/p>\n<p>submitted.\n<\/p>\n<p id=\"p_3\">      4.   Learned public prosecutor submitted that he has no<\/p>\n<p>objection in granting bail, but, stringent conditions may be<\/p>\n<p>imposed.\n<\/p>\n<p id=\"p_4\">      Hence, bail is granted to the petitioner on the following<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">BA No.6434\/08                     2<\/span><\/p>\n<p>terms and conditions:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>    (i)    Petitioner shall execute bond for Rs.25,000\/- with two<\/p>\n<p>           solvent sureties each for the like sum to the<\/p>\n<p>           satisfaction of the Magistrate Court concerned.<\/p>\n<\/blockquote>\n<p id=\"p_5\">   (ii)    Petitioner shall report before the Investigating Officer<\/p>\n<p>           on every Monday, Wednesday and Saturday between<\/p>\n<p>           5 p.m. to 8 p.m. until further orders.<\/p>\n<p id=\"p_6\">   (iii)   Petitioner shall not influence or intimidate any<\/p>\n<p>           witness or tamper with evidence or commit any<\/p>\n<p>           offence while on bail and in case of breach of this<\/p>\n<p>           condition, bail is liable to be cancelled.<\/p>\n<p>    The petition is allowed.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                                  K.HEMA, JUDGE<\/p>\n<p>csl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Padmakumar Alias Rethan Kumar vs State Of Kerala on 23 October, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6434 of 2008() 1.
