HEMA, J.\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n                      B.A. No. 471 of 2009\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n          Dated this the 20thday of February, 2009\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">       Petition for bail.\n<\/p>\n<p id=\"p_1\">       2. The alleged offences are under <a href=\"\/doc\/796352\/\" id=\"a_1\">sections 366<\/a>, <a href=\"\/doc\/1279834\/\" id=\"a_1\">376<\/a> and<\/p>\n<p><a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> IPC. According to prosecution, the victim in this crime is<\/p>\n<p>aged 13 years now. At the age of 11 years, she went to the 1st<\/p>\n<p>accused and she stayed with him for 2 = months, as sent by her<\/p>\n<p>parents. The girl became pregnant and she got aborted. Later<\/p>\n<p>she fell in love with petitioner. A complaint was given by her<\/p>\n<p>mother stating that she was missing and a crime was registered<\/p>\n<p>under the caption &#8220;woman missing&#8221;. Later, they came back and<\/p>\n<p>lived with the mother for some time. Again she left with the 2nd<\/p>\n<p>accused and in the meantime, she was raped by both the<\/p>\n<p>accused.\n<\/p>\n<p id=\"p_2\">        3. Petitioner was arrested on       10-1-2009. Learned<\/p>\n<p>counsel for petitioner submitted that even according to victim,<\/p>\n<p>she is aged 18 years, as revealed from the statement given to the<\/p>\n<p>police, which is produced as Annexure-II. Learned counsel for<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">BA 471\/2009                        -2-<\/span><\/p>\n<p>petitioner also submitted that the girl is now with another<\/p>\n<p>person.\n<\/p>\n<p id=\"p_3\">        4. Learned Public Prosecutor submitted that he has no<\/p>\n<p>objection in granting bail     but stringent conditions may be<\/p>\n<p>imposed.\n<\/p>\n<p id=\"p_4\">       5. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted to petitioner on conditions.<\/p>\n<p id=\"p_5\">       6. Hence, petitioner shall be released on bail on his<\/p>\n<p>executing a bond for Rs.50,000\/- with two solvent sureties each<\/p>\n<p>for the like amount to the satisfaction of the learned Magistrate,<\/p>\n<p>on the following conditions:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>             1)  Petitioner   shall    report   before    the<\/p>\n<p>                  Investigating Officer on every Monday,<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                  Wednesday and Saturday between          10<\/span><\/p>\n<p>                  a.m. and 1 p.m. until further orders.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             2)  Petitioner shall not enter the limits of the<\/p>\n<p>                 police station within which the crime is<\/p>\n<p>                 registered   except    for  compliance    of<\/p>\n<p>                 direction in condition (1)<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_2\"><p>             3)  Petitioner shall not intimidate or influence<\/p>\n<p>                 any witness or commit any offence while<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">BA 471\/2009                        -3-<\/span><\/p>\n<p>                 on bail and in case breach of this<\/p>\n<p>                 condition, bail is liable to be cancelled.<\/p>\n<p>      This petition is allowed.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\">\n<\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                                             K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<p id=\"p_6\">mn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Kalesh vs State Of Kerala-Represented By on 20 February, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 471 of 2009() 1.
