  V in  the reasons at Paragraphs 5 and 6<\/p>\n

     ‘vexplanation is not a tenable<\/p>\n
 the long delay of filing this Appeal<\/p>\n
  vieiw\ufb02oi’  that damn’ g the pendency of the writ<\/p>\n
\u00ab d.i.i’_;’~..petition, respondents 3 to 5 \ufb01led LR application to bring<\/p>\n
 of deceased origh a} tenant who was first<\/p>\n
V. V’  in the writ petition. That application came to<\/p>\n
  allowed vide onzier dated 7.8.2003. The appellants<\/p>\n
  have brought on record and they were served in the writ<\/p>\n
\\.\\_\/<\/p>\n
4<\/span><\/p>\n
petition but remained unrepresented. Therefore, they<\/p>\n
are required to explain the delay of 1076 days in \ufb01ling<\/p>\n
this appeal. By reading the explanation offered in <\/p>\n
affidavit at paragaphs 5 and 6 in  4′  ~<\/p>\n
application cannot be accepted as t_h6}’,_\u00a7lI’6 hot’   <\/p>\n
in law and therefore, on this   *3<\/p>\n
liable to be dismissed.\n<\/p>\n
3. Apart from the above  iire.haveV3alse
\nexamined the \ufb01ndings  T  by the<\/p>\n
learned Single Judge on    also after<\/p>\n
considexixzefgll ”  vv_contentions. The learned
\nSingle Jt1d.gVe.__Wi_t11′ ”t5 the claim’ made in the<\/p>\n
writ  ofrespeiidems 3 to 5 has examined the<\/p>\n
  a  of fact stating that the Land<\/p>\n
 -~  respondent herein has ganted<\/p>\n
kVV’eecupa’n.cy  in favour of the appellants herein in<\/p>\n
l uoflthe land bearing Sy.Nos.92 and 95 of Yellare<\/p>\n
  Tq though there is no claim in respect<\/p>\n
it  these lands in Form No.7. Hence the learned Single<\/p>\n
lllliidge is perfectly justified in quashjng the order of the<\/p>\n
\\\\N\/<\/p>\n
Land Tribunal gantjng occupancy rights in respect of<\/p>\n
aforesaid two lands in favour of the tenants.<\/p>\n
4. We am in respectful ageement with   <<\/p>\n
taken by the learned Single Judge  'n1attc,:1f.for– <\/p>\n
reason that the Tribunal should  V'<\/p>\n
occupancy rights in respect of  \u00a351:
\nreason that it had no  fii\u00e9
\nand want the occupancy   'tenants for
\nthe reason that     of the above
\ntwo Sy. Nos.  \ufb01e'. Vappeal is devoid
