JUSTICE RAJAN GUPTA\n\nPresent:    Mr. Rakesh Lamba, Advocate, for the petitioner.\n\n\nRajan Gupta, J.\n<\/pre>\n<p id=\"p_1\">            This is a revision petition against the order dated 1st April,<\/p>\n<p>2009, passed by Additional Sessions Judge, Faridabad, whereby he set-<\/p>\n<p>aside the order dated 13th June, 2008, passed by the Additional Chief<\/p>\n<p>Judicial Magistrate, Faridabad, discharging accused Raj Bahadur Tyagi<\/p>\n<p>and Shashi Bala and remitted the case to the court of Magistrate to<\/p>\n<p>proceed against the petitioner as per law.\n<\/p>\n<p id=\"p_1\">            Brief facts of the case are that a complaint was lodged by<\/p>\n<p>one Sat Narayan Sharma stating therein that he was induced by the<\/p>\n<p>accused to part with an amount of Rs.2,65,000\/- with a dishonest<\/p>\n<p>intention. Petitioner handed over the sale-deed of his house to the<\/p>\n<p>complainant as a mortgagee. However, the property which was subject<\/p>\n<p>matter of the mortgage, was already sold to one Beerpal Singh by a<\/p>\n<p>registered sale-deed dated 18th January, 2005. The complainant thus<\/p>\n<p>alleged that the accused in conspiracy with each other, had cheated him<br \/>\n<span class=\"hidden_text\" id=\"span_1\">  Crl. Revision No.1482 of 2009                          2<\/span><\/p>\n<p>of an amount of Rs.2,65,000\/-.\n<\/p>\n<p id=\"p_2\">             The Additional Chief Judicial Magistrate dismissed the<\/p>\n<p>complaint by observing that dispute was basically of civil nature and the<\/p>\n<p>complainant had the option of filing a civil suit.      The complainant<\/p>\n<p>preferred a revision petition before the court of Sessions. The revision<\/p>\n<p>was heard by Additional Sessions Judge, Faridabad, who set-aside the<\/p>\n<p>order passed by the Magistrate observing that the complainant could<\/p>\n<p>avail of both civil and criminal remedies.      He, thus, held that the<\/p>\n<p>petitioner is liable to be proceeded against. Other two accused were,<\/p>\n<p>however, discharged.\n<\/p>\n<p id=\"p_3\">             Learned counsel for the petitioner has argued that<\/p>\n<p>impugned order passed by Additional Sessions Judge, Faridabad was<\/p>\n<p>against law and not based on proper appreciation of the controversy.<\/p>\n<p>According to the counsel, dispute was clearly of civil nature.         No<\/p>\n<p>offence of cheating was made out. The order, therefore, deserves to be<\/p>\n<p>set-aside.\n<\/p>\n<p id=\"p_4\">             I have heard learned counsel for the petitioner and carefully<\/p>\n<p>perused the record annexed with the petition.<\/p>\n<p id=\"p_5\">             It is evident that in the complaint, clear cut allegations of<\/p>\n<p>cheating were made by the complainant. He alleged that he had been<\/p>\n<p>induced to part with an amount of Rs.2,65,000\/- by the petitioner.<\/p>\n<p>However, the property, which was mortgaged, had already been sold to<\/p>\n<p>one Beer Pal by a registered sale-deed.\n<\/p>\n<p id=\"p_6\">             In view of the allegations, it is not possible to hold at the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">   Crl. Revision No.1482 of 2009                        3<\/span><\/p>\n<p>very initial stage of entertaining the complaint that no offence is made<\/p>\n<p>out. The law is well settled that a person can pursue civil and criminal<\/p>\n<p>remedies simultaneously for one transaction. In my considered view,<\/p>\n<p>the complaint could not have been dismissed on the ground that the<\/p>\n<p>complainant could not continue the criminal case as civil remedy was<\/p>\n<p>available to him.\n<\/p>\n<p id=\"p_7\">             I thus find no merit in this petition.
