SAHAI)<\/p>\n<p>\tWe<br \/>\n\thave heard Mr. Om Prakash Khurana, learned counsel for the<br \/>\n\tpetitioner and Mr. Ravi Karnavat, learned counsel for the respondent<br \/>\n\tNo.2.\n<\/p>\n<p id=\"p_1\">\tThis<br \/>\n\twrit petition has been filed challenging the order dated 17.09.2001<br \/>\n\tpassed by the Central Administrative Tribunal in O.A. No.275 of 2000<br \/>\n\twith M.A. No.224 of 2000 and also the order dated 13.03.2002 passed<br \/>\n\tby the Central Administrative Tribunal in R.A. No.10 of 2002 in O.A.<br \/>\n\tNo.275 of 2000.\n<\/p>\n<p id=\"p_2\">\tThe<br \/>\n\tpetitioner was working as Class IV employee.  He was removed from<br \/>\n\tservice by the respondent No.2 by order dated 28.06.1993.<br \/>\n\tThereafter, the petitioner filed departmental appeal  which was also<br \/>\n\tdismissed on 30.09.1993.\n<\/p>\n<p id=\"p_3\">\tThereafter,<br \/>\n\tthe petitioner kept quiet.  According to the petitioner, the order<br \/>\n\tof Appellate Authority dated 30.09.1993 was not communicated to the<br \/>\n\tpetitioner and the order was given to him only in the year 1996.<br \/>\n\tWhy the petitioner did not approach the Appellate Authority is not<br \/>\n\tclear from the writ petition.  Once, the petitioner had filed an<br \/>\n\tappeal, he was required to inquire from the Appellate Authority<br \/>\n\tabout the result of the appeal by writing letter.\n<\/p>\n<p id=\"p_4\">\tAgainst<br \/>\n\tthe order of the Appellate Authority, the petitioner filed O.A.<br \/>\n\tNo.275 of 2000.  Since there was delay, the petitioner also filed<br \/>\n\tM.A. No.224 of 2000.  The Central Administrative Tribunal vide order<br \/>\n\tdated 17.09.2001 dismissed the said application on the ground of<br \/>\n\tdelay.  The reason given by the Tribunal in paragraphs 3 to 7 is<br \/>\n\textracted below :-\n<\/p>\n<p id=\"p_5\">&#8220;3.\tExcept<br \/>\nthis contention that he was sick, the applicant has not produced any<br \/>\ndocumentary evidence that he had remained continuously sick till the<br \/>\ndate of filing of this OA.  It may be that he was not well in 1992-93<br \/>\nbut there is no explanation about the subsequent period.  So far as<br \/>\nthe illiteracy of the applicant is concerned, the same is not a<br \/>\nground for condoning delay of about seven years.  The applicant had<br \/>\npreferred an appeal against the order of the disciplinary authority<br \/>\nand hence it can easily be inferred that he had knowledge of seeking<br \/>\nfor the redressed in the Tribunal.\n<\/p>\n<p id=\"p_6\">4.\tWe also find<br \/>\nthat the applicant at the time of contesting the disciplinary<br \/>\nproceedings had accepted the charges leveled against him and had also<br \/>\nadmitted that he had not informed his SS about the treatment under<br \/>\nprivate doctor and hence the disciplinary authority had passed the<br \/>\norder of dismissal from the services.\n<\/p>\n<p id=\"p_7\">5.\tHowever, at<br \/>\nthis juncture, Mr. Khurana denies that he had admitted the charges<br \/>\nleveled against him by saying that the statement was recorded by the<br \/>\nSS and the same was in English and not in Hindi language.  The<br \/>\napplicant being a illiterate person, could not understand the text of<br \/>\nthe same nor he was explained the text of the same, but he was given<br \/>\nassurance by the AWM that the charges would be dropped without any<br \/>\nfurther action and hence the applicant had signed the statement.\n<\/p>\n<p id=\"p_8\">6.\tMr. Khurana<br \/>\nhas submitted that without applying his mind, the applicant had<br \/>\nadmitted the charges under duress, but there is nothing to support<br \/>\nthis version.  Even before the Appellate Authority, the applicant had<br \/>\nnot contested that he had admitted charges under duress.  It was the<br \/>\nfirst opportunity for the applicant to come out with his case but he<br \/>\nhad not done so.  Thereafter, the applicant had not represented<br \/>\nanywhere that he was made to admit the charge compulsion.  Under the<br \/>\ncircumstances, the argument advanced by Mr. Khurana cannot be<br \/>\naccepted.\n<\/p>\n<p id=\"p_9\">7.\tWe therefore<br \/>\nfind that there is no sufficient reason to condone the delay and<br \/>\ntherefore we reject the MA for condonation of delay.  Consequently,<br \/>\nthe OA also stands rejected as barred by limitation.&#8221;\n<\/p>\n<p id=\"p_10\">\tAgainst<br \/>\n\tthat order, the petitioner filed Review Application No.10 of 2002<br \/>\n\tbefore the Central Administrative Tribunal which came to be rejected<br \/>\n\tby order dated 13.03.2002.\n<\/p>\n<p id=\"p_11\">\tLearned<br \/>\n\tcounsel for the petitioner Mr. Om Prakash Khurana has vehemently<br \/>\n\turged that the impugned removal order was passed without affording<br \/>\n\tany opportunity of hearing to the petitioner.\n<\/p>\n<p id=\"p_12\">\tThe<br \/>\n\tpetitioner filed O.A. after unreasonable delay without annexing any<br \/>\n\tmaterial and without explaining the reason for delay in filing O.A.<br \/>\n\tEven he did not file any documentary evidence to show that he was<br \/>\n\tsick during the said period.  From the medical certificates on<br \/>\n\trecord, it appears that the petitioner was suffering from Chronic<br \/>\n\tInflamatory Bowel Disease, which is not a serious disease.\n<\/p>\n<p id=\"p_13\">However,<br \/>\n\twithout entering into the merits of the matter, we find that the<br \/>\n\tTribunal has not committed any illegality in dismissing the O.A. As<br \/>\n\tthe Tribunal found that there was no sufficient cause for condoning<br \/>\n\tthe delay.  We do not find any illegality in the impugned orders of<br \/>\n\tthe Tribunal.
