Therefore,<br \/>\nit required to be corrected by authority because petitioner required<br \/>\npassport from Passport Officer.\n<\/p>\n<p id=\"p_2\">3.\tIn light of these facts, the petitioner has to approach the authority as per decision of this Court reported in 2008 (1) GLH 683. Recently, the  Division Bench of this Court  in the  case of Regional Passport Officer v. Kokilaben w\/o Jashwantlal Panchal and others, reported in 2009 (2) GLR 1246, has also considered similar question.  Relevant Para.9 to 12 are quoted as under :\n<\/p>\n<p id=\"p_3\"> 9.\tWe<br \/>\nmay indicate that Registration of Births and <a href=\"\/doc\/1636244\/\" id=\"a_1\">Deaths Act<\/a>, 1969 was<br \/>\nenacted to provide for births and deaths and matters connected<br \/>\ntherewith, which came into force with effect from 1.4.1970.  Chapter<br \/>\n3 of the Act provides for registration of births and deaths and<br \/>\n<a href=\"\/doc\/874632\/\" id=\"a_1\">Section 13<\/a> is pertaining to delayed registration of births and<br \/>\ndeaths.  Sub-section (3) of <a href=\"\/doc\/874632\/\" id=\"a_2\">Section 13<\/a> empowers a Magistrate of the<br \/>\nFirst Class to pass an order in case if birth or death is not<br \/>\nregistered within one year by its occurrence.  Initial registration<br \/>\nof births and deaths within a period of one year remain with the<br \/>\nauthority as provided under sub-section (1) and sub-section (2) of<br \/>\n<a href=\"\/doc\/874632\/\" id=\"a_3\">Section 13<\/a> of the Act.  <a href=\"\/doc\/626597\/\" id=\"a_4\">Section 15<\/a> of the Act deals with correction<br \/>\nor cancellation of entries in the register of Births and Deaths.<br \/>\n<a href=\"\/doc\/626597\/\" id=\"a_5\">Section 15<\/a> of the Act, read with Rule 11 of the Gujarat Registration<br \/>\nof Births and Deaths Rules, 2004 provides for detailed procedure to<br \/>\nbe followed.  It says where it is proved to the satisfaction of the<br \/>\nregistrar that any entry of a birth or death in any register kept by<br \/>\nhim under this Act is erroneous in form or substance, or has been<br \/>\nfraudulently or improperly made, he may, subject to such rules as may<br \/>\nbe made by the State Government with respect to the conditions on<br \/>\nwhich and the circumstances in which such entries may be or cancel<br \/>\nthe entry by suitable entry in original entry, and shall sign the<br \/>\nmarginal entry and add thereto the date of the correction or<br \/>\ncancellation.  Thus, it is clear that if it is proved to the<br \/>\nsatisfaction of the Registrar that entry being erroneous in the<br \/>\nregister of births and deaths, and it has been fraudulently or<br \/>\nimproperly made, he can make a report giving necessary details to the<br \/>\nofficer authorised by the Chief Registrar by general or special order<br \/>\nin this behalf under <a href=\"\/doc\/67232\/\" id=\"a_6\">Section 25<\/a> of the Act and on hearing from him,<br \/>\ntake necessary action in the matter.  Learned Single Judge of this<br \/>\nCourt in Nitaben Nareshbhai Patel Vs. State of Gujarat   2008 (1)<br \/>\nG.L.R 884 elaborately considered the scope of above mentioned<br \/>\nprovisions, and the learned Single Judge also examined at length the<br \/>\nprovisions of Gujarat Secondary Education Act, 1972 and Gujarat<br \/>\nSecondary Education Regulation, 1974.  With regard to the change of<br \/>\ndate of birth entered in the school record, referring to Regulation<br \/>\n12(A), it was stated that if the student has actually left the<br \/>\nschool, no change can be effected in the record of the school.  For<br \/>\nmaking a change in the name, as provided under Regulation 12(5)(1),<br \/>\nan application in prescribed proforma with certain documents as<br \/>\nnarrated in Regulation 5(1)(A) to (D) are required to be submitted.<br \/>\nRegulation 12(6) deals with correction of date of birth, which is<br \/>\npermissible only when student is studying in the school, and<br \/>\nthereafter it can be corrected by the concerned Magistrate of First<br \/>\nClass, upon proof of correct birth date.\n<\/p>\n<p id=\"p_4\">10.\tReference<br \/>\nmay also be made to the order passed by the Division Bench of this<br \/>\nCourt in Letters Patent Appeal No. 699 of 2003 in Special Civil<br \/>\nApplication No. 8122 of 2003, decided on 11.8.2003 (unreported). In<br \/>\nMinor Jagdishbhai Prabhatbhai Gohil Vs. State of Gujarat and others,<br \/>\nreferring to Gujarat Secondary Education Regulation, this Court took<br \/>\nthe view that the only remedy available to the party with regard to<br \/>\ncorrection of date of birth\/place of birth is to approach the<br \/>\nauthority for redressal of his grievance as provided under <a href=\"\/doc\/874632\/\" id=\"a_7\">Section 13<\/a><br \/>\nof the Act.\n<\/p>\n<p id=\"p_5\">11.\tThe<br \/>\nabove discussion would amply show that for carrying out correction of<br \/>\ndate of birth or place of birth or name, powers have been conferred<br \/>\nunder the Act on the Registrar as well as the Judicial Magistrate, as<br \/>\nthe case may be, and also Magistrate First Class when the correction<br \/>\nis sought to be made in school record, which is governed by Gujarat<br \/>\nSecondary Education Act, 1972 and Regulation framed thereunder.\n<\/p>\n<p id=\"p_6\">12.\tWe<br \/>\nare therefore, clearly of the view that Passport Authorities are not<br \/>\nexpected to make their own independent enquiry when there is a<br \/>\ndispute or difference with regard to the date of birth, place of<br \/>\nbirth or name entered in the Passport, especially when entries were<br \/>\nonce made on the basis of records produced by  the Passport holder.<br \/>\nIf there is any mistake on the records already produced, based on<br \/>\nwhich entries were already made, then it is for the party who seeks<br \/>\ncorrection to produce documents after carrying out necessary<br \/>\ncorrection by the concerned statutory authorities, Judicial<br \/>\nMagistrate or the Civil Court, as the case may be.  Passport<br \/>\nAuthorities are always competent to direct the parties to produce<br \/>\nrelevant documents either from the authorities functioning under the<br \/>\nBirths and Deaths Register or from the Judicial Magistrate or from<br \/>\nthe Civil Court, as the case may be. On production of corrected<br \/>\ndocuments, Passport Authorities will immediately carry out necessary<br \/>\ncorrection in the Passport.\n<\/p>\n<p id=\"p_7\">4.\tIn<br \/>\nview of above observations made by the Division Bench of this Court<br \/>\nas well as the decision of coordinate Bench of this Court, as<br \/>\nreferred above, let the petitioner may filed appropriate application<br \/>\nbefore  concerned Magistrate \/ Civil Court \/ authority under the<br \/>\nprovisions of the Gujarat Secondary Education Act for correcting<br \/>\ndate of birth which has been wrongly recorded in school leaving<br \/>\ncertificate as  29.7.1959  to  30.7.1959 .\n<\/p>\n<p id=\"p_8\">5.\tAs<br \/>\nand when concerned Magistrate \/ Civil Court \/ concerned authority<br \/>\nreceives such application from petitioner, it is directed to<br \/>\nconcerned Magistrate \/ Civil Court \/ concerned authority to examine<br \/>\nthe application made by petitioner and also to find out whether date<br \/>\nof birth recorded in birth register is found to be correct or not and<br \/>\nalso to consider other relevant and genuine documents which required<br \/>\nto be taken into account for correcting date of birth in school<br \/>\nleaving certificate and thereafter, to pass appropriate reasoned<br \/>\norder in accordance with law, within a period of three months from<br \/>\ndate of receiving such application from petitioner and communicate<br \/>\nthe decision to the petitioner.\n<\/p>\n<p id=\"p_9\">6.\tIn<br \/>\nview of aforesaid observations and directions, present petition is<br \/>\ndisposed of without expressing any opinion on merits.
