No. 616  of  2007\n\n                     - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                       Dated this the 25th  day of July, 2007\n\n\n\n\n                                         JUDGMENT\n<\/pre>\n<p id=\"p_1\">         When   an   application   for   early   hearing   of   the     appeal   came   up   for<\/p>\n<p>orders, this Court heard the appeal itself and disposed of the same.<\/p>\n<p id=\"p_1\">         2.   By   the   impugned   order   the   2nd  respondent   was   acquitted   by  the<\/p>\n<p>trial   court   under   <a href=\"\/doc\/1988204\/\" id=\"a_1\">section   256(1)<\/a>   Code   of   Criminal   Procedure.   The   learned<\/p>\n<p>counsel for the appellant submits that the trial court had not complied with<\/p>\n<p>the  provisions<a href=\"\/doc\/445276\/\" id=\"a_1\">  of Code<\/a> of Criminal Procedure while passing  the impugned<\/p>\n<p>order.       The   learned   counsel   for   the   appellant   also   submits   that   the   order<\/p>\n<p>under challenge is not  in accordance with the principles  laid  down  by this<\/p>\n<p>Court in decisions reported in  <a href=\"\/doc\/408134\/\" id=\"a_2\">Don Bosco V. Partech Computers Ltd<\/a>. (2005<\/p>\n<p>(2) KLT 1003), <a href=\"\/doc\/1024152\/\" id=\"a_3\">G.F.S. Chits &amp; Loans (P) Ltd. V. Rajesh<\/a> (2006(3) KLT 825)<\/p>\n<p>and a decision of the Apex Court reported  in  Associated Cements Co. Ltd.<\/p>\n<p>V. Keshwanand (1998(1) KLT 179 (S.C.).\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">         3.   A reading of the impugned order would show that the trial court<\/p>\n<p>acquitted   the   2nd   respondent   for   the   reason     that   in   spite   of   specific<\/p>\n<p>direction,   the   appellant   absent.   As   per   the   principles   laid   down   in      Don<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.A 616\/2007                                 2<\/span><\/p>\n<p>Bosco   V.   Partech   Computers   Ltd.   (Supra),    when   the   presence   of   the<\/p>\n<p>complainant was quite unnecessary and the Magistrate could proceed  with<\/p>\n<p>the case by adjourning the   same even if there was no representation from<\/p>\n<p>the     counsel,   the   Magistrate   should   have   adjourned   the   case,   particularly<\/p>\n<p>when steps under <a href=\"\/doc\/1598801\/\" id=\"a_4\">section 82<\/a> and <a href=\"\/doc\/886456\/\" id=\"a_5\">83<\/a> of the Cr.P.C. were pending against the<\/p>\n<p>accused.  In G.F.S.Chits &amp; Loans (P) Ltd. V. Rajesh (Supra) this Court held<\/p>\n<p>that   the   courts     should   also   bear-in-mind   that   unmerited,   thoughtless<\/p>\n<p>disposal gives wrong signal to the society, staking even public confidence<\/p>\n<p>in the system of administration of justice. In paragraph 17 of 1998(1) KLT<\/p>\n<p>179 (Supra) the Apex Court held as follows:-\n<\/p>\n<p id=\"p_4\">\n<blockquote id=\"blockquote_1\"><p>         &#8220;17.   Reading   the   section   in   its   entirety     would   reveal<\/p>\n<p>         that   two   constraints   are   imposed   on   the   court   for<\/p>\n<p>         exercising  the power under the Section. First  is, if the<\/p>\n<p>         court thinks that in a situation it is proper to adjourn the<\/p>\n<p>         hearing then the magistrate shall not acquit the accused.<\/p>\n<p>         Second is, when the magistrate considers that personal<\/p>\n<p>         attendance  of the complainant  is not necessary on that<\/p>\n<p>         day the  magistrate  has  the  power  to  dispense  with  his<\/p>\n<p>         attendance  and  proceed with the  case. When the  court<\/p>\n<p>         notices   that   complainant   is   absent   on   a   particular   day<\/p>\n<p>         the court must consider whether personal attendance of<\/p>\n<p>         the complainant is essential on that day for the progress<\/p>\n<p>         of   the   case   and   also   whether   the   situation   does   not<\/p>\n<p>         justify the case being adjourned to another date due to<\/p>\n<p>         any   other   reason.   If   the   situation   does   not   justify   the<\/p>\n<p>         case   being   adjourned   the   court   is   free   to   dismiss   the<\/p>\n<p>         complaint and acquit the accused. But if the presence of<\/p>\n<p>         the complainant on that day was quite unnecessary then<\/p>\n<p>         resorting  to the step of axing down the complaint may<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.A 616\/2007                              3<\/span><\/p>\n<p>        not be a proper exercise of the power envisaged in the<\/p>\n<p>        section.   The   discretion   must   therefore,   be   exercised<\/p>\n<p>        judicially   and   fairly   without   impairing   the   cause   of<\/p>\n<p>        administration of criminal justice.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\">\n<\/blockquote>\n<p id=\"p_5\">A   reading   of   the   impugned   order   would   not   show   that   the   personal<\/p>\n<p>attendance of the appellant  is essential on that day.<\/p>\n<p id=\"p_6\">      4. In the above circumstances, this Court is of the view that the order<\/p>\n<p>under challenge is liable to be set aside and the matter has to be remitted to<\/p>\n<p>the trial court for fresh consideration.  Ordered accordingly.  The trial court<\/p>\n<p>is directed to consider the matter afresh   from the stage at which the order<\/p>\n<p>impugned order has been passed.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">        The appeal is allowed as above.\n<\/p>\n<p id=\"p_9\">\n        The parties shall appear before the court  below on 7-9-2007<\/p>\n<p>        The   records   of   the   case   shall   be   forwarded   to   the   trial   court<\/p>\n<p>forthwith.\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">                                                                  K. Hence, it is only proper for this Court<\/p>\n<p>to allow a reasonable costs to the 1st respondent.  Therefore, the appellant is<\/p>\n<p>directed  to  deposit  before the court below   an amount of Rs.2,000\/- on or<\/p>\n<p>before   the   date   of   posting   of   the   case.
