DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/05\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\t\tHeard<br \/>\nthe learned Advocate for the petitioner.\n<\/p>\n<p id=\"p_1\">\t\tThe<br \/>\nprayer in this petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of<br \/>\nIndia  to direct the learned Magistrate to exercise powers under<br \/>\nsection 156 (3) of the Code of Criminal Procedure, 1973 cannot be<br \/>\nentertained in the factum of the case that the learned  Magistrate<br \/>\nhas passed order under <a href=\"\/doc\/1149595\/\" id=\"a_1\">section 202<\/a> of the Code of Criminal Procedure<br \/>\ncalling for police report.\n<\/p>\n<p id=\"p_2\">2.\t\tNo<br \/>\ncase is made out.
