Tripathi\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p id=\"p_1\">Hon&#8217;ble Rajesh Chandra,J.\n<\/p>\n<p id=\"p_1\">Heard learned counsel for the petitioner, learned counsel who<br \/>\nappears for the Bank and learned Standing Counsel.<br \/>\nChallenge in this petition is recovery proceeding by which a<br \/>\nparticular amount is sought to be recovered from the petitioner.\n<\/p>\n<p id=\"p_2\">Counsel for the petitioner has made statement at the bar that this<br \/>\nis the first writ petition against the recovery proceeding and this<br \/>\nfact has also been stated in the writ petition. Submission is that if<br \/>\nreasonable time is allowed to pay the amount sought to be<br \/>\nrecovered, petitioner may be able to pay the same and<br \/>\nirreparable injury on account of arrest and auction of property<br \/>\nmay be avoided.\n<\/p>\n<p id=\"p_3\">To the aforesaid, learned counsel appearing for Bank submits<br \/>\nthat intention of the respondent bank has been never to cause<br \/>\nany irreparable injury to the loanee rather the loan amount was<br \/>\nadvanced with the purpose to improve the petitioner&#8217;s future<br \/>\nprospects and thus if for justifiable reason the amount in terms of<br \/>\nthe agreement has not been paid and now petitioner has<br \/>\nbonafide intention to pay the amount within a reasonable time<br \/>\nthen if that liberty is given, it will serve the interest of both sides<br \/>\ni.e. petitioner may be saved from the riggers of coercive process<br \/>\ni.e. arrest, auction of the properties and at the same time<br \/>\nrespondent bank will get its full amount with interest. Thus for<br \/>\ngrant of reasonable time, if that is to advance justice,<br \/>\nrespondents may not have any objection.\n<\/p>\n<p id=\"p_4\">In view of aforesaid, this Court feels in the ends of justice that<br \/>\namount sought to be recovered be permitted to be deposited.\n<\/p>\n<p id=\"p_5\">Accordingly, this petition is disposed of with the following<br \/>\ndirections- :\n<\/p>\n<p id=\"p_6\">i)Petitioner is to deposit an amount of Rs. 75,000\/- directly in the<br \/>\nconcerned bank within a period of one month from today to show<br \/>\nbonafide on his part.\n<\/p>\n<p id=\"p_7\">ii) If petitioner deposits the above amount within the time so<br \/>\n allowed then he is permitted to deposit the remaining amount<br \/>\ndirectly in concerned Bank in four equal instalments In<br \/>\ncalculating the arrears the amount (if any) already paid will be<br \/>\nadjusted.\n<\/p>\n<p id=\"p_8\">ii) The first instalment may be deposited by 31st October, 2010,<br \/>\nsecond instalment by 31st January,2011, third by 30th April, 2011<br \/>\nand fourth by 31st July, 2011. These deposits may be made<br \/>\nbefore the branch of the Bank from where the loan was taken. In<br \/>\ncase instalments are deposited in the Bank then only half of the<br \/>\nrecovery charges will be recovered from the petitioner.\n<\/p>\n<p id=\"p_9\">iii) During period of deposit the recovery proceedings will be kept<br \/>\nin abeyance. In case petitioner defaults in depositing any of the<br \/>\ninstalments within the above stipulated time, it will be open to the<br \/>\nrespondents to start recovery proceedings again by taking<br \/>\ncoercive process at once.\n<\/p>\n<p id=\"p_10\">iv) Petitioner may file an application for supply of statement of<br \/>\naccount along with duly stamped self addressed envelope. In<br \/>\ncase any such application is filed, the concerned branch of the<br \/>\nBank will give the same to the petitioner after deposit of first<br \/>\ninstalment within fifteen days.\n<\/p>\n<p id=\"p_11\">v) This order will not affect any auction if it has already taken<br \/>\nplace. In that event the petitioner may take appropriate legal<br \/>\nproceedings to set aside the auction under U.P.Z.A. &amp; L.R. Act<br \/>\nand Rules ,1952 or file a suit in accordance with law.\n<\/p>\n<p id=\"p_12\">vi) It is clarified that this order will not be operative and will not<br \/>\ncome in way of recovery process in any manner, if any other writ<br \/>\npetition has been filed before this Court against the recovery<br \/>\nproceeding for the loan amount.\n<\/p>\n<p id=\"p_13\">vii) If any fact given from the side of the petitioner is found to be<br \/>\nincorrect by the bank authorities, it will be open for them to move<br \/>\nan application for modification\/recall of the order.\n<\/p>\n<p id=\"p_14\">With the aforesaid writ petition stands disposed of.\n<\/p>\n<p id=\"p_15\">Order Date :- 16.7.2010<br \/>\nM.A.A.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court M\/S New Chep Cloth House vs State Of U.P.
