Mr.K.Srinivasan\n\t\n\n:JUDGMENT\n<\/pre>\n<p id=\"p_1\">\tThis appeal is focussed as against the Judgement and Decree dated<br \/>\n31.07.2006 passed in M.C.O.P.No.366 of 2003 by the learned Motor Accidents<br \/>\nClaims Tribunal-cum-the Additional District Judge, Fast Track Court No.IV,<br \/>\nPeriyakulam.\n<\/p>\n<p id=\"p_1\">\t2. Heard both sides.\n<\/p>\n<p id=\"p_2\">\t3. The Tribunal vide Judgement dated 31.07.2006  awarded compensation to a<br \/>\ntune of Rs.2,71,800\/- (Rupees two lakhs seventy one thousand and eight hundred<br \/>\nonly) under the following sub-heads:\n<\/p>\n<p id=\"p_3\">\tFor loss of income\t-Rs.1,84,800\/-\n<\/p>\n<p id=\"p_4\">\tFor transportation\t-Rs.   1,000\/-\n<\/p>\n<pre id=\"pre_1\">\tFor extra nourishment\t-Rs.     500\/-\n\tFor damage to dress\t-Rs.     500\/-\n\tFor funeral expenses\t-Rs.   5,000\/-\n\tFor loss of consortium\t-Rs.  50,000\/-\n\tFor loss of love and\n\t\taffection\t-Rs.  30,000\/-\t\n\t\t\t\t--------------\n\t\t\tTotal\t-Rs.2,71,800\/-\t\t\t\t\t\t\n\t\t\t\t--------------\n\n<\/pre>\n<p id=\"p_5\">\t4. The challenge in this appeal is relating to the quantum.  The gist and<br \/>\nkernel of the grounds of appeal as stood exposited from the memorandum of appeal<br \/>\ncould be portrayed thus:\n<\/p>\n<p id=\"p_6\">\tThe Tribunal awarded excessive compensation, even though the deceased died<br \/>\nat the age of 55 as a coolie.\n<\/p>\n<p id=\"p_7\">\t5. The point for consideration is as to whether the Tribunal awarded &#8216;just<br \/>\ncompensation&#8217;?\n<\/p>\n<p id=\"p_8\">6. On point:\n<\/p>\n<p id=\"p_9\">\tThe learned counsel for the appellant\/Insurance Corporation by placing<br \/>\nreliance on the grounds of appeal would develop his arguments to the effect that<br \/>\nthe Tribunal awarded a sum of Rs.50,000\/- (Rupees fifty thousand only) towards<br \/>\nloss of consortium and a sum of Rs.30,000\/- (Rupees thirty thousand only)<br \/>\ntowards loss of love and affection, which are obviously on the higher side and<br \/>\nthere are no basis for awarding such compensation under those sub heads, whereas<br \/>\nthe learned counsel for the respondent Nos.1 and 2\/claimants would submit that<br \/>\nthe claimants are the wife and the son of the deceased and in such a case the<br \/>\ncompensation awarded is very moderate and that may be confirmed.\n<\/p>\n<p id=\"p_10\">\t7. The Tribunal simply took up the monthly income of the deceased in a sum<br \/>\nof Rs.2,100\/- (Rupees two thousand and hundred only) at the rate of Rs.70\/-<br \/>\n(Rupees seventy only) per day as his wages.  I am of the considered opinion that<br \/>\nthe accident occurred during the year 2003 and as such taking into consideration<br \/>\nthe prevailing rate of wages and the capacity of the deceased, his monthly<br \/>\nincome could rightly be fixed at Rs.2500\/- (Rupees two thousand five hundred<br \/>\nonly) and that would meet the ends of justice.\n<\/p>\n<p id=\"p_11\">\t8. It is a trite proposition of law that 1\/3 of the income should be<br \/>\ndeducted towards the expenditure which the deceased would have incurred for<br \/>\nmaintaining himself had he been alive irrespective of the fact whether the<br \/>\ndeceased lead the life of a Bohemian or that of a Spartan.\n<\/p>\n<p id=\"p_12\">\t9. The multiplier 11 chosen by the Tribunal is correct as the Second<br \/>\nSchedule appended to the <a href=\"\/doc\/785258\/\" id=\"a_1\">Motor Vehicles Act<\/a> would contemplate it. I am fully<br \/>\naware of the fact that in all cases the multiplier as found suggested in the<br \/>\nSecond Schedule appended to the <a href=\"\/doc\/785258\/\" id=\"a_2\">Motor Vehicles Act<\/a> cannot be taken as<br \/>\nconclusive.  However, in this case, the wife and the son of the deceased are the<br \/>\nclaimants and in such a case unless multiplier 11 is chosen, significant amount<br \/>\ncould not be arrived at, which would be of support to them. Hence, I do not<br \/>\nincline to vary the multiplier 11.   Hence, the compensation  under the head<br \/>\n&#8216;loss of income&#8217; shall be re-fixed at Rs.2,20,000\/- (2500 x 12 x 16 x 2\/3 =<br \/>\n2,20,000\/-) (Rupees two lakhs and twenty thousand only).\n<\/p>\n<p id=\"p_13\">\t10. Towards loss of consortium for the first respondent\/first claimant,<br \/>\nthe wife, the Tribunal awarded a sum of Rs.50,000\/- (Rupees fifty thousand only)<br \/>\nand that could be reduced to Rs.15,000\/- (Rupees fifteen thousand only).\n<\/p>\n<p id=\"p_14\">\t11. Towards loss of love and affection for the second respondent\/second<br \/>\nclaimant, the son, the Tribunal awarded a sum of Rs.30,000\/- (Rupees thirty<br \/>\nthousand only) and that could be reduced to Rs.15,000\/- (Rupees fifteen thousand<br \/>\nonly).\n<\/p>\n<p id=\"p_15\">\t12. It is a fact that four days after the accident alone, while the<br \/>\ndeceased was taking treatment in the hospital, he succumbed to the injuries and<br \/>\nduring that period the dependant might have incurred expenses for medical<br \/>\ntreatment and attendant charges and that could be quantified in a sum of<br \/>\nRs.15,000\/- (Rupees fifteen thousand only).\n<\/p>\n<p id=\"p_16\">\t13. Towards transport charges a sum of Rs.2000\/- (Rupees two thousand<br \/>\nonly) and towards funeral expenses a sum of Rs.3000\/- (Rupees three thousand<br \/>\nonly) could also be awarded.\n<\/p>\n<p id=\"p_17\">\t14. Towards extra nourishment and damage to dress appropriate amounts have<br \/>\nbeen awarded, which require no interference.  Accordingly, the compensation is<br \/>\nmodified as under:\n<\/p>\n<p id=\"p_18\">\tFor loss of income\t-Rs.2,20,000\/-\n<\/p>\n<p id=\"p_19\">\tFor transportation\t-Rs.   2,000\/-\n<\/p>\n<pre id=\"pre_2\">\tFor extra nourishment\t-Rs.     500\/-\n\tFor damage to dress\t-Rs.     500\/-\n\tFor funeral expenses\t-Rs.   3,000\/-\n\tFor loss of consortium\t-Rs.  15,000\/-\n\tFor loss of love and\n\t\taffection\t-Rs.  15,000\/-\n\tFor medical expenses\n\tand attendant charges\t-Rs.  15,000\/-\t\n\t\t\t\t--------------\t\t\t\t\t\n\t\t\tTotal\t-Rs.2,71,000\/-\t\t\t\n\t\t\t\t--------------\n\n<\/pre>\n<p id=\"p_20\">\t15. As such the total compensation arrived at is in pari materia with the<br \/>\ncompensation awarded by the Tribunal and as such no interference with the award<br \/>\nof the Tribunal is warranted.\n<\/p>\n<p id=\"p_21\">\t16. I, therefore do not find any merit in this Appeal and accordingly it<br \/>\nis dismissed. The award of the Tribunal is confirmed. No costs.
