No.2952 of 2011\n                                     SANJAY SINGH\n                                            Versus\n                                 THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p id=\"p_1\">2.   10.03.2011.             Heard       learned       counsels       for   the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p id=\"p_1\">                             The     petitioner         is     apprehending<\/p>\n<p>                   his   arrest     in    a     case    registered         under<\/p>\n<p>                   <a href=\"\/doc\/1868826\/\" id=\"a_1\">Sections 498(A)<\/a> and <a href=\"\/doc\/1560742\/\" id=\"a_1\">302<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> of the Indian<\/p>\n<p>                   Penal Code.\n<\/p>\n<p id=\"p_2\">                             The     accusation         was    of     assault.<\/p>\n<p>                   After investigation, the police submitted<\/p>\n<p>                   charge    sheet      under     <a href=\"\/doc\/92983\/\" id=\"a_3\">Section       306<\/a>    of    the<\/p>\n<p>                   I.P.C.\n<\/p>\n<p id=\"p_3\">                             It    is    submitted       by    the     learned<\/p>\n<p>                   counsel    for        the    petitioner          that    the<\/p>\n<p>                   marriage took place 20-22 years prior to<\/p>\n<p>                   the occurrence and when the husband found<\/p>\n<p>                   the victim in unconscious condition then<\/p>\n<p>                   she was being taken to hospital where she<\/p>\n<p>                   died then the inquest was prepared and<\/p>\n<p>                   the post mortem was also performed and<\/p>\n<p>                   the Viscera was preserved.\n<\/p>\n<p id=\"p_4\">                             Learned       counsel       for     the       State<\/p>\n<p>                   submits    that        the     petitioner          is    the<\/p>\n<p>                   husband    of     the       victim     and       there     is<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           2<\/span><\/p>\n<p>        allegation of assault against him.<\/p>\n<p id=\"p_5\">                    Considering      the     fact     that     the<\/p>\n<p>        victim died after twenty two years of the<\/p>\n<p>        marriage and considering the conduct of<\/p>\n<p>        the petitioner of giving the medical help<\/p>\n<p>        to    the     victim      and       the     fact      that<\/p>\n<p>        accusation      was    not        found     true     under<\/p>\n<p>        Sections 304\/34 of the I. P. C. during<\/p>\n<p>        investigation, let the petitioner, above<\/p>\n<p>        named, be released on bail in the event<\/p>\n<p>        of arrest or surrender before the learned<\/p>\n<p>        court   below    within      a     period    of    twelve<\/p>\n<p>        weeks   from     today       in     connection        with<\/p>\n<p>        Barauni (Chakiya)P.S. Case No. 72 of 2010<\/p>\n<p>        on furnishing bail bond of Rs. 10,000\/-<\/p>\n<p>        (Ten Thousand) with two sureties of the<\/p>\n<p>        like amount each to the satisfaction of<\/p>\n<p>        the   learned    C.J.M.Begusarai,           subject     to<\/p>\n<p>        the conditions as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_4\">Section<\/p>\n<p>        438(2)<\/a> of the Code of Criminal Procedure.<\/p>\n<p>U.
