As the Federation was making losses, the charge of<br \/>\nAdministration was taken by the Board. The respondent was retrenched<br \/>\non 30.03.1989 by offering retrenchment compensation. Thereafter, the<br \/>\nrespondent filed suit before Board of Nominees and obtained ex-parte<br \/>\ninjunction against retrenchment but the same was vacated after<br \/>\nhearing the federation. Another retrenchment order dated 08.08.1989<br \/>\nwas passed against respondent along with other workmen by paying<br \/>\nretrenchment compensation notice pay etc., which was refused to<br \/>\naccept by the respondent and he preferred Reference before Labour<br \/>\nCourt being Reference ( LCN) No. 17 of 1990. The respondent herein<br \/>\nobtained Sanad and is a practicing advocate in Nadiad since 1994. The<br \/>\nLabour Court ultimately has passed the aforesaid order. Hence, this<br \/>\npetition.\n<\/p>\n<p id=\"p_2\">3.0\tThe<br \/>\nLabour Court has granted only full backwages from the date of<br \/>\nretrenchment i.e. 08.08.1989 till the respondent has obtained Sanad<br \/>\nfrom the Gujarat State Bar Council in the year 1994.\n<\/p>\n<p id=\"p_3\">4.0\tLearned<br \/>\nadvocate for the petitioner has raised contention that inspite of the<br \/>\ndocuments produced by the petitioner, the Labour Court has wrongly<br \/>\ngranted full backwages to the respondent from the date of<br \/>\nretrenchment till the respondent obtained Sanad for practicing as an<br \/>\nadvocate in the year 1994.\n<\/p>\n<p id=\"p_4\">5.0\tLearned<br \/>\nadvocate for the petitioner has also raised contention that findings<br \/>\nof the Labour Court regarding production of seniority list and<br \/>\nretrenchment notice is contrary to the evidence on record.\n<\/p>\n<p id=\"p_5\">6.0\tHeard<br \/>\nlearned advocates for both the parties.  There is translation of<br \/>\noriginal award into English language. The original award and<br \/>\nretrenchment notice dated 08.08.1989 are produced on record. Except<br \/>\nthese documents, no other documents are produced on record to take<br \/>\ncontrary view from the Labour Court.  However, there is seniority<br \/>\nlist  on record but it is not exhibited.  An attempt is made to refer<br \/>\nto  evidence of the present respondent before the Labour Court,<br \/>\nhowever, same is not accepted. The original award which is in<br \/>\nGujarati language is produced on record. Before proceedings with the<br \/>\nreference, if any authority is desirous to hold that the findings<br \/>\ngiven by the Labour Court  is perverse and contrary to the evidence<br \/>\non record, those documents are required to be dealt with. But no such<br \/>\ndocuments are produced on record. Hence, I am of the view that<br \/>\nobservation made in para 7 of that award stating that Federation<br \/>\nemployer has not made retrenchment on the basis of the seniority list<br \/>\nand no seniority list has been produced is required to be accepted.<br \/>\nIt is also observed that as the respondent was permanent employee,<br \/>\nhe can be retrenched in view of his seniority. However, no such<br \/>\ndocuments in that regard were produced. Hence, there is no evidence<br \/>\non record to take contrary view from the award of the Labour Court.<br \/>\nHence, it is difficult to take contrary view from the findings of the<br \/>\nLabour Court.\n<\/p>\n<p id=\"p_6\">7.0\tIn<br \/>\nthe premises aforesaid, the judgment and award of the Labour Court,<br \/>\nNadiad dated 26.05.1999 passed in Reference ( L.C.N.) No. 17 of 19990<br \/>\nis just and proper. The petition is devoid of merits and the same is<br \/>\ndismissed.
