JOSEPH, J.\n\n           ````````````````````````````````````````````````````\n                   W.P.(C) No. 7396 OF 2004 E\n           ````````````````````````````````````````````````````\n              Dated this the 29th day of May, 2008\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">           Petitioner&#8217;s case in brief is as follows.                The<\/p>\n<p>petitioner retired from service on 30.4.2000 from the<\/p>\n<p>respondent Corporation. While in service, the petitioner had<\/p>\n<p>met with an accident and his right leg was amputated. Ext.P2<\/p>\n<p>is the disability certificate. The petitioner relies on <a href=\"\/doc\/639570\/\" id=\"a_1\">section 47<\/a><\/p>\n<p>of   the  Persons        with    Disabilities(Equal        Opportunities,<\/p>\n<p>Protection of Rights and Full Participation) Act, 1995, which<\/p>\n<p>reads as follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8221; 47. Non-discrimination in Government<\/p>\n<p>       employment &#8211;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            (1)     No establishment shall dispense with,<\/p>\n<p>       or reduce in rank, an employee who acquires a<\/p>\n<p>       disability during his service:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>            Provided that, if an employee, after acquiring<\/p>\n<p>       disability is not suitable for the post he was holding,<\/p>\n<p>       could be shifted to some other post with the same<\/p>\n<p>       pay scale and service benefits:\n<\/p><\/blockquote>\n<p id=\"p_1\">WPC.7396\/04<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              : 2 :<\/span><\/p>\n<p>            Provided further that if it is not possible to<\/p>\n<p>       adjust the employee against any post, he may be<\/p>\n<p>       kept on a supernumerary post until a suitable post<\/p>\n<p>       is  available  or   he     attains   the  age    of<\/p>\n<p>       superannuation, whichever is earlier.&#8221;<\/p>\n<p id=\"p_2\">      2.   According to the petitioner, after the accident he<\/p>\n<p>became unfit for the duty of driver. The respondent<\/p>\n<p>Corporation was bound to post the petitioner in a suitable post<\/p>\n<p>with the same pay scale and service benefits and in terms of<\/p>\n<p>the second proviso to <a href=\"\/doc\/639570\/\" id=\"a_1\">section 47(1)<\/a> of the Act.           If the<\/p>\n<p>aforesaid was not possible, he ought to have been kept on a<\/p>\n<p>supernumerary post until a suitable post is available or he<\/p>\n<p>attains the age of superannuation, whichever is earlier, he<\/p>\n<p>submits. But, in this case, it is not done, he complains. The<\/p>\n<p>petitioner was paid full salary for the months of October to<\/p>\n<p>November 1996 and half salary from December 1996 to July<\/p>\n<p>1998.    He preferred Ext.P4 representation before the 2nd<\/p>\n<p>respondent. Ext.P5 is a complaint filed by the petitioner under<\/p>\n<p><a href=\"\/doc\/639570\/\" id=\"a_2\">section 62<\/a> of the Act before the 3rd respondent. Counter is<\/p>\n<p>filed on behalf of the respondents, wherein it is, inter alia,<\/p>\n<p>WPC.7396\/04<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                : 3 :<\/span><\/p>\n<p>stated that &#8211;\n<\/p>\n<blockquote id=\"blockquote_3\"><p>             &#8221; 3. The petitioner was a driver in the service<\/p>\n<p>       of the KSRTC at Muvattupuzha depot.         He was<\/p>\n<p>       transferred to Kasaragod for a period of one year<\/p>\n<p>       on administrative ground. While continuing in the<\/p>\n<p>       service at Kasaragod depot he met with an<\/p>\n<p>       accident on 4.8.1996 and sustained major injuries<\/p>\n<p>       and became disabled to perform any kind of duty in<\/p>\n<p>       the Corporation.     In his representation it was<\/p>\n<p>       clearly stated that he has become permanently and<\/p>\n<p>       totally disabled. The State Medical Board has also<\/p>\n<p>       assessed his disability at 100%. Corporation has<\/p>\n<p>       sanctioned the following:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>             (a)    Leave salary at full rate from 5.8.96 to<\/p>\n<p>       11.5.99 by sanctioning disability leave.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_5\"><p>             (b)    Full salary for the period 12.5.97 to<\/p>\n<p>       3.6.97 by treating the period as duty.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_6\"><p>             (c)    Salary for the period from 26.6.97 to<\/p>\n<p>       4.8.98 has been sanctioned by granting special<\/p>\n<p>       disability leave.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>             (d)    Full pay leave has been sanctioned<\/p>\n<p>       from 5.8.98 to 29.8.98 and salary paid.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_8\"><p>             (e)    Salary has been paid from 30.8.98 to<\/p>\n<p>       5.9.98 by granting HPL.<\/p><\/blockquote>\n<p id=\"p_3\">\n<p id=\"p_4\">             4. Thereafter the petitioner became totally<\/p>\n<p>       disabled and not attended in the office for any kind<\/p>\n<p>       of job till 24.4.2000.   On 25.4.2000 he reported<\/p>\n<p>WPC.7396\/04<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                 : 4 :<\/span><\/p>\n<p>        before the District Transport Officer, Muvattupuzha.<\/p>\n<p>        Corporation has taken humanitarian consideration<\/p>\n<p>        and permitted the petitioner to join duty and to<\/p>\n<p>        retire   from     service     on    30.4.2000    on<\/p>\n<p>        superannuation. All the retirement benefits were<\/p>\n<p>        sanctioned to him in accordance with the Rules<\/p>\n<p>        existed then.&#8221;\n<\/p>\n<p id=\"p_5\">      3.    The petitioner has filed a reply affidavit also. The<\/p>\n<p>learned Government Pleader submits that action was, in fact,<\/p>\n<p>being taken on Ext.P5.\n<\/p>\n<p id=\"p_6\">      4.
