Registrar (Admn.) &amp; PIO,\n                                             Indian Institute of Technology Bombay.\n                                             Powai, Mumbai - 400076\n\nRTI Application filed on             :       19\/06\/2008\nPIO replied                          :       22\/07\/2008\nFirst appeal filed on                :       09\/08\/2008\nFirst Appellate Authority order      :       18\/08\/2008\nSecond Appeal filed on               :       20\/01\/2009\n\nInformation Sought :-\n<\/pre>\n<p id=\"p_1\">   The Appellant had sought information regarding Mr. Umesh Yadav, Roll no.1039286<br \/>\nappeared in Joint Entrance Examination 2008, held on 13\/04\/2008 through following<br \/>\nquestions.\n<\/p>\n<p id=\"p_2\">   1. Marks obtained by the candidate subject wise.\n<\/p>\n<p id=\"p_3\">   2. Cut off level of marks individually for Physics, Chemistry, Mathematics for General<br \/>\n       and OBC candidates separately (for IIT).\n<\/p>\n<p id=\"p_4\">   3. Total marks obtained by the last ranker in General and OBC categories separately (for<br \/>\n       IIT).\n<\/p>\n<p id=\"p_5\">   4. Copy of Model answer sheet.\n<\/p>\n<p id=\"p_6\">   5. Copy of answer sheet of Shri Umesh Yadav (the particulars described above).\n<\/p>\n<p id=\"p_7\">The PIO replied :\n<\/p>\n<p id=\"p_8\">1 to 4. This information will be made available on the IIT website on 1st August 2008, as per<br \/>\nthe decision of the joint Admission Board (JAB) for JEE 2008.\n<\/p>\n<p id=\"p_9\">5. The requested information relates to personal information the disclosure of which may<br \/>\nlead to violation of <a href=\"\/doc\/223928\/\" id=\"a_1\">Section 8(1)(j)<\/a> of RTI Act, 2005, the same can not be provided. Also<br \/>\nplease note that this information is not made available to individuals as per the policy of the<br \/>\nJEE system as approved by JAB. In case of litigation, the ORS sheet and the details of the<br \/>\nmarks scored, will be available to the Hon&#8217;ble Presiding Judge.<br \/>\n The First Appellate Authority ordered.\n<\/p>\n<p id=\"p_10\">&#8220;The answers to question Nos. 1,2,3, &amp; 4 are already available on the website of IIT Bombay<br \/>\ni.e. www.iitb.ac.in, which may please be viewed.<br \/>\nRegarding information of question No. 5, it is stated that the information relates to the<br \/>\npersonal information and disclosure of the same may lead to violation of <a href=\"\/doc\/223928\/\" id=\"a_1\">Section 8(1)(j)<\/a> of<br \/>\nthe RTI Act, 2005. Hence, the same cannot be provided.&#8221;\n<\/p>\n<p id=\"p_11\">Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_12\">The following were present<br \/>\nAppellant : Mr. G.P. Yadav<br \/>\nRespondent : Dr. Indu Saxena PIO<br \/>\nThe PIO and the First appellate have wrongly refused the information under <a href=\"\/doc\/758550\/\" id=\"a_2\">Section 8<\/a> (1) (j),<br \/>\nsince the answer sheet being sought was of the appellant&#8217;s son, who would have gladly given<br \/>\nhis consent to giving the answer sheet. The PIO states that all the answer sheets have been<br \/>\ndestroyed as per the weeding out rules for JEE-2008 passed on 24 August 2008. The said rule<br \/>\nstates, &#8221; It was proposed that all confidential materials relate to JEE-2008, except the soft<br \/>\ncopies of the data of JEE-2008 and those which have entered litigation are to be disposed off<br \/>\nafter December 01, 2008. The Board approved the proposal.&#8221;<br \/>\nSince the matter of this answer sheet was under litigation under RTI, it should not have been<br \/>\ndestroyed. The PIO states that a mistake has been made inadvertently. The PIO will get a<br \/>\ncertificate from the Chairman of JEE-2008 certifying that the answer sheet of Shri Umesh<br \/>\nYadav has been destroyed in violation of the JEE- 2008 weeding out rules.\n<\/p>\n<p id=\"p_13\">Decision:\n<\/p>\n<p id=\"p_14\">The Appeal is allowed.\n<\/p>\n<p id=\"p_15\">The PIO will send a certificate from the Chairman of JEE-2008 certifying that the answer<br \/>\nsheet of Shri Umesh Yadav has been destroyed in violation of the JEE- 2008 weeding out<br \/>\nrules to the appellant before 15 May 2009.\n<\/p>\n<p id=\"p_16\">This decision is announced in open chamber.\n<\/p>\n<p id=\"p_17\">Notice of this decision be given free of cost to the parties.\n<\/p>\n<p id=\"p_18\">                                                                                  Shailesh Gandhi<br \/>\n                                                                        Information Commissioner<br \/>\n                                                                                   29th April, 2009<\/p>\n<p>(In any correspondence on this decision, mentioned the complete decision number.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Central Information Commission Mr. G.P.
