He has not committed any offence<br \/>\n\tas alleged against him and he has been falsely involved in the<br \/>\n\tcommission of offence. There is no material on record of the case to<br \/>\n\tconnect the applicant with the commission of offence punishable<br \/>\n\tunder <a href=\"\/doc\/1119707\/\" id=\"a_4\">Sections  395<\/a>, <a href=\"\/doc\/1865117\/\" id=\"a_5\">397<\/a> and <a href=\"\/doc\/844968\/\" id=\"a_6\">412<\/a> of Indian Penal Code. Thus,<br \/>\n\tconsidering the role attributed to the applicant, he deserves to be<br \/>\n\tenlarged on bail.\n<\/p>\n<p id=\"p_2\">Ms.\n<\/p>\n<p id=\"p_3\">\tKrina Calla, learned Additional Public Prosecutor, representing the<br \/>\n\trespondent-State, while opposing the bail application, submitted<br \/>\n\tthat applicant is involved in the serious offence punishable under<br \/>\n\t<a href=\"\/doc\/1119707\/\" id=\"a_7\">Sections  395<\/a>, <a href=\"\/doc\/1865117\/\" id=\"a_8\">397<\/a> and <a href=\"\/doc\/844968\/\" id=\"a_9\">412<\/a> of Indian<br \/>\n\tPenal Code. Considering the role attributed to the applicant<br \/>\n\tand the manner in which he has committed the alleged offence along<br \/>\n\twith other accused, no discretionary relief be granted to the<br \/>\n\tapplicant and the application be dismissed.\n<\/p>\n<p id=\"p_4\">Heard,<br \/>\n\tMr. Yatin Soni, learned advocate for the applicant and Ms. Krina<br \/>\n\tCalla, learned Additional Public Prosecutor, representing the<br \/>\n\trespondent-State, at length and in great detail. Considering the<br \/>\n\trole attributed to the applicant, which is reflected in the FIR at<br \/>\n\tAnnexure-A to the application, manner<br \/>\n\tin which he has committed the alleged offence along with other<br \/>\n\taccused, provisions of <a href=\"\/doc\/1119707\/\" id=\"a_10\">Sections  395<\/a>,<br \/>\n\t<a href=\"\/doc\/1865117\/\" id=\"a_11\">397<\/a> and <a href=\"\/doc\/844968\/\" id=\"a_12\">412<\/a> of Indian Penal Code, quantum of punishment etc.,<br \/>\n\tantecedents of the applicant and<br \/>\n\tsince main accused Rajendrasinh Amarsinh<br \/>\n\tVaghela who has been already released on bail, I am of the view that<br \/>\n\tapplicant deserves to be enlarged on bail.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be enlarged on bail in connection<br \/>\n\twith I-C.R.No-205\/2009 registered with Mahemdabad Police Station, on<br \/>\n\texecuting a bond of Rs.10,000\/- (Rupees Ten Thousand Only) with one<br \/>\n\tsurety of the like amount to the satisfaction of the Trial Court and<br \/>\n\tsubject to the conditions that he shall:.\n<\/p>\n<p id=\"p_6\">[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p id=\"p_7\">[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_8\">[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p id=\"p_9\">[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p id=\"p_10\">[e]\tmark<br \/>\nhis presence at the concerned police station on any day of first week<br \/>\nof every English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;;\n<\/p>\n<p id=\"p_11\">[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_12\">[g]\tmaintain<br \/>\n\tlaw and order.\n<\/p>\n<p id=\"p_13\">If<br \/>\n\tbreach of<br \/>\n\tany of the above conditions is committed,<br \/>\n\tthe Sessions<br \/>\n\tJudge concerned will be free to issue warrant or to take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_14\">Bail<br \/>\n\tbond to be executed before the lower Court having jurisdiction<br \/>\n\tto try the case.\n<\/p>\n<p id=\"p_15\">\tAt<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_16\">\tRule<br \/>\n\tis made absolute to the aforesaid extent.
