      W.P.(C).No.25573  of  2006,   filed  by  seven  individuals,<\/p>\n
was not entertained by the learned single Judge, observing<\/p>\n
that it would not have been possible for the Court to issue a<\/p>\n
direction to the Joint Registrar of Co-operative Societies to<\/p>\n
dispose of an application  filed  by them.   They  were  former<\/p>\n
employees of The Tellicherry Taluk Co-operative Marketing<\/p>\n
and   Processing   Society.     The   Society   was   not   having<\/p>\n
working   funds   and   a   decision   had   been   taken   during<\/p>\n
August,2005   for   selling   away   certain   landed   properties<\/p>\n
possessed   by   it   for   an   amount   of   Rs.1,20,50,000\/-.     Such<\/p>\n
amounts   were   to   come   to   the   Society   and   the   petitioners<\/p>\n
pointed out that as on the date of filing of the writ petition a<\/p>\n
sum   of   Rs.38,23,056\/-required   to   be   earmarked   in   their<\/p>\n
favour   partly   towards   retirement   benefits   and   partly<\/p>\n
towards pension funds.  They prayed for a writ of mandamus<\/p>\n

directing the Joint Registrar of Co-operative Societies, Kannur<\/p>\n
to   issue   directions   which   were   appropriate   to   keep   aside<\/p>\n
sufficient  amounts from the funds which could have reached<\/p>\n
the institution because of the sale of properties.  The learned<\/p>\n
single Judge  found that perhaps it would have been possible<\/p>\n
for the petitioners to resort to remedies under Section  69 of<\/p>\n
the Kerala Co-operative Societies Act, but the prayers as put<\/p>\n
forward were not possible to be granted.<\/p>\n
       2.      The   appeal   is   filed   by   the   appellants   feeling<\/p>\n
aggrieved   about   the   judgment   as   above.     We   had   heard<\/p>\n
Mr.K.V.Sohan appearing for the appellants.   Mr.M.Sasindran<\/p>\n
with   reference   to   counter   affidavit   filed   by   the   second<\/p>\n
respondent   in   the   appeal,   submitted   that   the   prayers   in   the<\/p>\n
appeal are totally unsustainable.\n<\/p>\n

       3.      Going   to   the   merits   of   the   claims,   Mr.Sasindran<\/p>\n
submits   that   the   amounts   claimed   as   due   have   no   relation<\/p>\n
with actualities.  He also submits that the petition to the Joint<\/p>\n
Registrar   of   Co-operative   Societies   was   not   legally<\/p>\n
sustainable,   as   the   Society,   as   a   body   corporate,   alone   had<\/p>\n
authority to decide on policy affairs.   The  monetary  claims of<\/p>\n
the   petitioners\/appellants,   some   of   whom   had   retired   a<\/p>\n

decade   back,   according   to   him,   stood   fully   settled   and   of<\/p>\n
course   there   was   defaulted   payments   to   the   Pension   Fund,<\/p>\n
but that arose because of oversight on the part of one of the<\/p>\n
petitioners,   who   was   functioning   as   the   Managing   Director.<\/p>\n
He submits that the Society  was indebted to third parties  to<\/p>\n
the tune of Rs.one crore and every effort was being made to<\/p>\n
revitalise   the   institution   and   there   was   no   possibility   of<\/p>\n
earmarking   any   funds   towards   any   liability   before   hand   and<\/p>\n
such   a   procedure   was   never   followed   by   any   institution.<\/p>\n
Therefore,   in   any   case,   the   Joint   Registrar   could   not   have<\/p>\n
advised the Society to adopt  such procedure.<\/p>\n
       4.      We note that the submission as above requires to<\/p>\n
be accepted.  The retired employees of course have a right for<\/p>\n
demanding   payments,   which   are   due   to  them,  but   it  may  be<\/p>\n
premature   for   them   to   insist   that   funds,   which   are   in   the<\/p>\n
possession of the Society, are to be earmarked in their favour.<\/p>\n
It is especially conceded that there  has not been any  decree<\/p>\n
or order secured by them in respect of specified amounts.  We<\/p>\n
also   note   the   submission   of   Mr.Sasindran   that   retirement<\/p>\n
benefits   have   been   granted   to   all   the   petitioners\/appellants<\/p>\n
and   some   of   them   have   entrusted   the   amounts   with   the<\/p>\n

Society as Fixed Deposits.  It may even be possible for any of<\/p>\n
them  to   close  the   account  prematurely,  but  such   matters  do<\/p>\n
not come within the purview of this writ appeal.<\/p>\n
        5.        We   find   that   the   reliefs   prayed   for   cannot   be<\/p>\n
granted.     Relegating   the   appellants   to   appropriate   remedies<\/p>\n
available to them as recognised by the statute, the writ appeal<\/p>\n
is dismissed.\n<\/p>\n
