NIMA CHANDPURA,\n                 DISTRICT- BEGUSARAI.\n                                       -----------\n<\/pre>\n<p id=\"p_1\">6   21\/04\/2011           Heard learned counsel for the petitioner, learned<\/p>\n<p>                  counsel for the private respondents and learned counsel<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                     -2-<\/span><\/p>\n<p>for the State.\n<\/p>\n<p id=\"p_1\">        A frontal attack was made on the reasoning given<\/p>\n<p>by   the     District   Teachers   Appointment   Appellate<\/p>\n<p>Authority, Begusarai which is the impugned order<\/p>\n<p>contained annexure 12 to this writ application that the<\/p>\n<p>finding recorded by the Appellate Authority that addition<\/p>\n<p>of vocational marks in the merit list is contrary to the<\/p>\n<p>Circular and direction of the Human Resources<\/p>\n<p>Development Department is erroneous per se.            He<\/p>\n<p>submits that there does not exist any circular of the kind<\/p>\n<p>and, therefore, the direction issued by the Appellate<\/p>\n<p>Authority to deduct such marks from the merit list and<\/p>\n<p>thereby creating a fresh merit list based on which right<\/p>\n<p>accrues in favour of Md. Sufyan is wrong.<\/p>\n<p id=\"p_2\">        A counter affidavit on behalf of the State has<\/p>\n<p>been filed where a categorical statement has been made<\/p>\n<p>that vocational marks or extra subject marks cannot be<\/p>\n<p>added for creating merit list and on that account the<\/p>\n<p>continuation of the petitioner, therefore, cannot be<\/p>\n<p>sustained.\n<\/p>\n<p id=\"p_3\">        Next submission of the learned counsel for the<\/p>\n<p>petitioner is that if a mistake has been made by the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                           -3-<\/span><\/p>\n<p>        Panchayat in preparation of the merit list in such a<\/p>\n<p>        fashion, then the entire panel is to be scrapped.<\/p>\n<p id=\"p_4\">                In this regard the Court can only record that the<\/p>\n<p>        issue of appointment of the petitioner on the post at the<\/p>\n<p>        cost of other persons having more marks but having<\/p>\n<p>        been denied the benefit because of wrong addition of<\/p>\n<p>        marks in favour of the petitioner, contrary to the<\/p>\n<p>        direction   of   the    Ministry   of   Human       Resources<\/p>\n<p>        Development Department, if on re-working on deduction<\/p>\n<p>        of vocational marks, the petitioner does not remain in the<\/p>\n<p>        merit list on the basis of which he has got appointment,<\/p>\n<p>        he has no right to remain on that post.
