These two appeals arise out of one and the same<\/p>\n
order passed by the W.C. Commissioner, Mandya. The<\/p>\n

first respondents in these appeals are the respective
\nclaimants before the WC. Commissioner and the<\/p>\n
compensation claimed by them in respectV..V_:o..i”dl~.._the<\/p>\n
accident which, according to them, is <\/p>\n
occurred on 2.11.2006 leading _to…ir1juri_e.s”,’ <\/p>\n
by the WC. Commissioner ‘a.nd’_’_’icomp.ei1satic\u00a7-._divas<\/p>\n
awarded in a sum of.\n<\/p>\n
to the respective cla.imant.s—-i\ufb01rith’*\u00bb.interest-.at~’i12% p.a.
\nThe said order of the _i’sN\u00a7C,l;”iomr1ilissioner is called in
\nquestion byfhe  in these two<\/p>\n
appeals.\n<\/p>\n
2.  the learned counsel for the
\nappellariiflnsurance is that, no accident ever<\/p>\n
tooili ‘place as  by the respective claimants and. in<\/p>\n
  to,:estab1ish the factum of the accident, the<\/p>\n
  not produced any documents before the<\/p>\n
 Cporhlmissioner. No F.I.R. copy was produced nor<\/p>\n
 A’-array  case was registered and no l.M.V. report<\/p>\n
 produced to indicate the damage caused to the<\/p>\n
tractor–cum-trailer and, under these circumstances, the<\/p>\n
Commissioner for Workmen’s Compensation could not<\/p>\n
3″\n<\/p>\n
I<\/p>\n
have rnechanicaily accepted the case of the claimants
\nmerely because the owner of the vehicle sails along with<\/p>\n
the claimants. Therefore, the submission ma_deV_t*i.sdithat<\/p>\n
the order of the Commissioner cannot <\/p>\n
law as the claimants have faile_d…to4  <\/p>\n
sustained injuries in the accid*vent’_’_which_d’v’aroseV::’fiuf:,Qf
\nand in the course of their  V    <\/p>\n
3. The submission of thevV:A”‘ilearned.’connsel for the
\nrespondents–claimant’s:is  Of the tractor-
\ncu1n–trailer ha:s.,  of the accident<\/p>\n
W.C.:’:Cornmis’sVi–o_ricr.’w__iVioi’eover, production of the FIR.
\nis not a”roequirement.o’f~.lai2v and the Insurance Company<\/p>\n
also did not evidence to show that the claimants’<\/p>\n
. ‘case is a false one.\n<\/p>\n
    of the aforesaid submissions put<\/p>\n

3  Comrnissioner, it is noticed that except producing the<\/p>\n
“‘..i>\\”roiind certificates and X–ray reports, the claimants have<\/p>\n
“not produced the F.I.R.. charge–sheet and I.M.V. report<\/p>\n

to show that in respect of the damage caused to the
\nvehicle, he has approached the Insurance Company for<\/p>\n
compensation. In the absence of an iota ofve\\}*i\u00abde~nce<\/p>\n
forthcoming in regard to the aforesaid <\/p>\n
enough force in the submission put the<\/p>\n
learned counsel for the insurance_ACCvompa:aj}f <\/p>\n
Commissioner for Workmevn~’.s Co’mpensa_ti’c.n””‘was in”<\/p>\n
error in allowing the pp c1ajrn*’*va’ppiication’s’ ‘despite there
\nbeing no positive evidlence to  of the
\naccident on    claimants.\n<\/p>\n

are allowed’ -‘and’Vthe_”ord–er of the Commissioner for
\nWorkmevn’siiCompensation is set aside and the matter is<\/p>\n
reniiityted to Commissioner for Workmen’s<\/p>\n

 ~partiesiiberty to adduce additional evidence in<\/p>\n
reuspecta of their respective contentions and the<\/p>\n
