Whether the judgment should be reported in                NO\n      the Digest?\n\n\nANIL KUMAR, J.\n<\/pre>\n<p id=\"p_1\">*<br \/>\n     After some arguments learned counsel for the petitioners wants to<\/p>\n<p>rely on certain documents, which were not filed before the Tribunal,<\/p>\n<p>some of which have been filed in the writ petition along with an<\/p>\n<p>application for taking additional documents on record.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C) 7408\/2010                                                  Page 1 of 2<\/span>\n<\/p>\n<p id=\"p_1\">         Since these documents were not considered by the Tribunal, the<\/p>\n<p>learned counsel for the petitioner, on instructions, seeks to withdraw<\/p>\n<p>the writ petition with liberty to approach the Tribunal and impugned<\/p>\n<p>the order of the Tribunal on the basis of these documents, which were<\/p>\n<p>not filed earlier, by seeking review of impugned order dated 30th<\/p>\n<p>September, 2010.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">        In the circumstances, the petition is dismissed as withdrawn with<\/p>\n<p>liberty as prayed for.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">        However, the interim order granted by this Court shall continue<\/p>\n<p>for 15 days, whereafter the Tribunal will decide whether the petitioner<\/p>\n<p>shall be entitled for interim order or not on the basis of the merits of the<\/p>\n<p>case.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">        All the pending applications are also disposed of.<\/p>\n<p id=\"p_8\">                                                ANIL KUMAR, J.\n<\/p>\n<p id=\"p_9\">\n<pre id=\"pre_1\">MARCH 16, 2011                                  VEENA BIRBAL, J.\nrs\n\n\n\n\n<span class=\"hidden_text\" id=\"span_1\">W.P.(C) 7408\/2010                                                  Page 2 of 2<\/span>\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Delhi High Court Sh.Pranay Sinha &amp; Ors. vs Union Of India &amp; Ors. on 16 March, 2011 Author: Anil Kumar * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) No.7408\/2010 % Date of Decision: 16.03.2011 Sh.Pranay Sinha &amp; Ors. &#8230;&#8230; Petitioners Through Mr. V.K.
