Advocate\n\nHon'ble Rajesh Dayal Khare,J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for the applicant and the learned AGA for the<br \/>\nState.\n<\/p>\n<p id=\"p_1\">The present application has been filed for quashing the proceedings of<br \/>\ncriminal Case No 6116 of 2008 (arising out of Case Crime No. 1550 of<br \/>\n2009) State v Nikahat Fatma, under Section 3(2) of the Public Property<br \/>\nDamages Act, 1984 and 448 <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>, PS Kotwali, District Ghazipur pending<br \/>\nin the court of the Chief Judicial Magistrate, Ghazipur and also for<br \/>\nquashing of the charge sheet dated 25.07. 2008.\n<\/p>\n<p id=\"p_2\">The contention of the counsel for the applicants is that submersible<br \/>\npump was being installed in the public lane under the permission of the<br \/>\nNagar Palika concerned and therefore no offence under Section 3(2) of<br \/>\nthe Public Property Damages Act, 1984 can be drawn against the<br \/>\napplicant nor any offence has been committed under <a href=\"\/doc\/1947545\/\" id=\"a_1\">Section 448<\/a> IPC. It<br \/>\nis further contended that that applicant is a lady so her bail prayer may<br \/>\nbe considered by the magistrate, if possible, on the same day.\n<\/p>\n<p id=\"p_3\">From the perusal of the material on record and looking into the facts of<br \/>\nthe case at this stage it cannot be said that no offence is made out<br \/>\nagainst the applicant. All the submission made at the bar relates to the<br \/>\ndisputed questions of fact, which cannot be adjudicated upon by this<br \/>\nCourt under <a href=\"\/doc\/903398\/\" id=\"a_2\">Section 482<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_3\">Cr.P.C<\/a>. At this stage only a prima facie case is<br \/>\nto be seen in the light of the law laid down by the Supreme Court in<br \/>\ncases of R.P. Kapur Vs. State of Punjab, AIR 1960 SC 866, State of<br \/>\nHaryana Vs. Bhajan Lal, 1992 SCC (Cr.) 426, State of Bihar Vs.<br \/>\nP.P. Sharma, 1992 SCC (Cr.) 192 and lastly Zandu Pharmaceutical<br \/>\nWorks Ltd. Vs. Mohd. Saraful Haq and another (Para-10) 2005<br \/>\nSCC (Cr.) 283. The disputed defence of the accused cannot be<br \/>\nconsidered at this stage.\n<\/p>\n<p id=\"p_4\">The prayer for quashing the proceedings as well as quashing of the<br \/>\ncharge sheet in the aforesaid case is refused.\n<\/p>\n<p id=\"p_5\"> However, considering the fact that the applicant is a lady, it is provided<br \/>\nthat if she appears and surrenders before the Court below within a<br \/>\nperiod of 30 days from today and apply for bail, then her paryer for bail<br \/>\nshall be considered and decided, expeditiously, if possible on the same<br \/>\nday, in accordance with law, For a period of 30 days from today or till<br \/>\nthe disposal of the application for grant of bail, whichever is earlier, no<br \/>\ncoercive action shall be taken against the applicant.
